  1. I recently filed my wife's AOS forms on 1/22 and they were received at Chicago on 1/24. So far my checks have not been debited yet. Does anyone know the approximate timeframe that I will receive a letter back from USCIS that our applications are received and they are in processing pending there are no RFEs? We live in Los Angeles, CA so will each state have different response times? We're just curious because we have another friend who lives in Seattle and filed her papers roughly two weeks ago and her checks were cashed a day after they were received and she already got notice to make her biometric appointment.

    My wife and I live in Los Angeles, CA. She is here in the US on OPT and we'll be filing for her AOS and submitting all the forms in together. Since I'm filing everything together the instructions say to mail to the Chicago Lockbox. However, for part a) do I fill in with Chicago, IL or put Los Angeles, CA or there is another California service center in the form instructions with a Laguna Niguel, CA address? Which one is correct?

    For part B since I've filled in part A then part B is not applicable, right?

    Form I-485 Part 3 : Were you inspected by a U.S. Immigration Officer?

    I checked Yes because she had to go through immigration for her last US entry. I assume majority of the people entering the US legally will check Yes for this question. Just want to confirm.

    I don't know why the recorder's office takes so long to file the marriage certificate, but that's probably their standard policy. I'll be asking them tomorrow why it takes them so long to file and to get a certified copy. I'll probably just get some generic answer that has always been their policy and everyone has to wait.

    Our paperwork is relatively easy after going through all the forms. If I wait 6-8 weeks to receive the marriage certificate before mailing in the entire packet am I potentially putting her status to be able to remain in the US at risk? Or should I go by your advice and send the packet in with a copy of the "customer copy" marriage certificate and if it's rejected I can send in a certified copy afterwards. The thing is if the packet is rejected for any reason that still doesn't give my wife conditional status to remain in the US while we wait for the all the approvals to process through does it? I'm sure that's the case, but perhaps you can give me an actual answer, but the uscis website is a maze of information and you really can't find anything easy there.

    Is anyone here married in Los Angeles or California?

    I'm getting all the forms together to apply for AOS for my wife. I understand the uscis doesn't require original documents or certified copies of documents anymore. When I submit Form I-130 where I have to include a marrige certificate can I submit the customer copy that I get after our court ceremony? They told me that the customer copy version just has the "Customer Copy" watermark across the paper, but it's exactly the same document that gets filed. The county clerk told me that it's not going to be a certified copy since it hasn't been officially recorded at the county clerk's office yet. If I want a certified copy I will have to wait 6-8 weeks for them to mail it to me. They are unable to give certified copies right after the ceremony. I want to get the packet mailed out so the uscis puts it in pending status so my wife can remain in the country as her OPT status is expiring in May '08. Just wanted to make sure I can mail in a photocopy of marriage certificate customer copy. I plan on getting a certified copy for our own records to use in the interview if needed. I can wait for that since the interview won't be until later. I just want to get the initial forms sent in asap.

  5. my fiance is on F1 optional practical training status. We're getting married in January '08. Her OPT expires in May '08 and I'm planning to get all the forms submitted as soon as she can get the check up with the civil surgeon and we can complete the I-693. I'm wondering what if we don't get the PR approval by May '08 wen her OPT expires will she still be able to stay in the country while we wait for the approval? If we submitted all the forms in January is that plenty of time to get the green card? I'm thinking of what if situations say if we submitted the forms in February will we be cutting it too close? I don't think it's 100% clear to me what authorizes her to remain in the country - is it once the USCIS receives all the forms or only after we have our interview and if approved by the officer they stamp to give her conditional PR status.

  6. Hey everyone...

    I'm a US citizen and my fiance is here in the US using her OPT status that expires in May 2008. We plan to marry in January '08. reading through the forums i've seen it take up to 6 months to receive the green card if the person is a direct relative and the spouse files submits the I130 with the I485. We have a few more things to get completed like her medical examination by the Civil Surgeon. I'm wondering if she will have no problem staying here in the US once the I130 and I485 are received and approved? Since she is a direct relative and will be eligible to get an immigrant visa immediately is that what will authorize her to stay in the US while she waits for the PR status to complete? We're not sure if we should be concerned because her OPT status expires in May '08 and I think she gets a 60 day grace period to stay in the country. We're also submitting form i765 to get her the EAD. Will that basically mean she can stay in the country and work and say if the EAD comes before the AOS approval it means she can remain in the US regardless. Is that the right assumption?

  7. I'll be getting married in 01/2008 to my wife who we're petitioning for PR and I'm a US citizen. I'll be planning to file the following form

    I130

    I485

    G325A

    I864

    I765

    I693

    I131

    We both live in Los Angeles now. We live at two different addresses right now to make our work commutes closer. She currently lives in an apartment where the lease will end around May 2008 and we both travel back and forth between each other's residences. Afterwards depending whether she has to go to a different state or not she may move in with me. For the time being she's going to add me to her apt. lease. We're just curious whether during the interview process will the immigration officer request to look at our driver's licenses and see two different addresses on there and start questioning us about it. We can easily explain the situation, but just want to try clean up these little things to avoid any the questioning in the first place. She might not be living in the apartment after may 2008, but we're thinking to use the address when filling in the forms because for form I130 we will have to provide evidence that we have a lease showing joint tenancy. So I'm not sure if I should go change my address at the DMV to her apartment address in case they ask for our driver's licenses. Has anyone been asked to show both driver's licenses before?

    Forms I485 and I130 all require G325A attachments. The instructions say to file both forms together to the Chicago Lockbox address. Wasn't sure if i could submit 2 sets (myself and my wife) to satisfy the requirement for both forms or is it safer to just submit separate G325A forms for each of the I485 and I130 separately. What are your thoughts?
