  1. We had interview Sept 2006 and got touched only once Oct 2006 and touched again yesterday after almost 5 months. IS THIS A GOOD SIGN????

I would say it's a very good thing. we had almost the exact same thing happen. No touches since October and then we started getting touches last week, got the welcome letter and yesterday got the word that the GC is being produce and will be here in 30 days or less.

    Good luck!

  2. I just want to know guys if your case has been touched recently or when was the last time it was touched? Ours never been touched for 3 months since our AOS interview.

We applied for AOS at the end of May 2006, had our AOS interview in August and were told that the name check was pending. The last time our case was touched was October 7, 2006. My wife is from Hong Kong.

  3. Something very similar happened to my wife recently. We applied for both AOS and EAD last May and although we understand that the green card can take so long we should have heard something on the EAD, so we made an INFOPASS appt. and they told us that the EAD was approved months ago and that we should have received a notice telling us to go for a 2nd biometrics appt. We never received that notice, so she had us go immediately to the place where we had the first biometrics and then we'll get the EAD. We would have had no way of knowing what was going on if we had not made an INFOPASS appt. The phoneline service was useless for getting any real information.

  4. My wife and I filed for AOS and EAD in May of 2006 as well. They totally screwed up on her EAD and never sent us any notices on it. We had to make an INFOPASS appt. that we went to yesterday to straighten it out. They failed to send us any kind of notification for it and we ended up going to get her second biometrics yesterday after the INFOPASS and supposedly it will be on the way soon. They told us it would be good until August of this year and to reapply for extension 90 days before it expires, not 6 months before it expires.

As for the AOS, we had the interview in August of 2006 and they told us it was approved pending the FBI name check and we have not heard anything since. Our case was last touched in October according to the online case status website and when we inquired at the INFOPASS they told us it was still pending and that it could take anywhere from months to years and to check back in six months if we have not heard anything by then. Can you beleive that sh*t? 6 months! She is an RN from Hong Kong with not a speck of questionable activity in her life. I'm an honorably discharged veteran and I feel totally let down by my government.

  5. You are very lucky to have this so fast. Most people here are waiting forever.

My wife and I filed for AOS & EAD last May and just got our EAD approved yesterday after an INFOPASS appt.

As for green card, we are stuck in name check hell and are told to check back in another 6 months if we don't hear anything by then.

She is from Hong Kong, is a nurse, has a spotless record and is the most harmless person you could imagine. We never had any RFEs and even went to our AOS interview last August where we were told that she was approved pending the name check. We're still waiting and all the while she is becoming more depressed from the situation.

  6. Hello once again. From what I've read, my fiancee, who has recently arrived on a K-1 visa, should apply to get her SS card after being here 2 weeks. However, is there a way I can call to make sure she is in the database, that way I don't waste my time at the Social security office in case she can't get her card yet. Should I call the toll-free SS number? Or do I just have to go to the office after 2 weeks and hope her name is already in the database. I rather make sure before I go to the Social security office, because it can be a long wait and I dont want to be there for nothing. Please inform, thanks

Don't worry it will be in there after the two weeks. Just get there early when they open to minimize the wait.

  7. I am wondering what the percentage of people who are filing for AOS after k-1 visa did so with the assitance of an immigration lawyer. Myt wife and I went it alone. The forms were simple enough, we had all our ducks in a row. We never recieved any RFE notices and we had our AOS interview about three months after we filed. At that time we were told our case was approved pending the FBI Name Check.

It seems like there are a ton of people here in the same boat as us and I am curious if having the lawyer would have made it faster. My wife's friend who is also a nurse from Hong Kong married a U.S. Citizen who is in the Navy a year and a half ago. She came here on a K-3, got married and got her EAD and GC all in less than a year. There was no delay with name check or any of the B.S. that a lot of us are going through. It seems that a laywer may be able to help you make sure all the paperwork is in order before sending it off, but can they really make the name check go any faster?

  8. Well Alice and I went downtown to the Federal Building for our INFOPASS appt. After waiting for about a half hour, our number was called. When we told the person behind the counter that we had our AOS interview last August and were told to contact them in 90 days, she said that our case is still pending the name check, which we knew already. She said it could take months to years and to come back in 6 months if we have not heard anything by then. Then we explained that we filed for the EAD at the same time and still do not have that. SHe checked the computer and said that the EAD was approved. She asked if my wife had been fingerprinted and I told her about our 1st biometrics appt. that we had last summer. She said that we would need to now get the second set of finger prints done and gave us a form to take to the ASC place in Gardena. We went there and took care of that and now we have to just go back to waiting for the EAD to show up. My wife is so frustrated at the slowness of the system here and there is not much I can tell her other than be patient and that at least the EAD should be coming soon with any luck.

  9. My wife and I are in the same boat. She came here last April, we were married that month and also got her SSN number. She was unable to get a CA state driver's license though becuase there was not enough time left on the k-1 visa by the time she got here. We filed for AOS and EAD at the same time at the end of May 2006. We got the NOAs, biometrics and AOS interview within 3 months after that, but our case has not been "touched" since October and is sitting in the long line of FBI name checks at the Missouri center with a lot of the other people on these forums.

We have an INFOPASS appt. this week to try and find out what's going on.

She is a nurse and has been out of work in her profession for a year now and is really getting bummed out.

  10. What the f*** does that mean! Have I become part of the background check posse, what aspect

of administration needs resolution, do they need to chat around the coffee machine.

I feel more unsure of my position now than before the interview.

    Any answers out there?

I had the same problem with my interview last week. I guess its a matter of sitting and waiting..

Alice and I went to her AOS interview on the same day in August at the L.A. office. We are still waiting as of today, January 11, 2006.

Hopefully it will not be too much longer for the both of us. We have an INFOPASS appt. next Thursday.

    Good luck!

  11. We have been 14 months since they were sent to the FBI and 11 months since his interview. There is nothing to do but wait believe me, even a senator cannot move them. Yes he is from a North African country but I saw someone else on this board with a long wait from Scotland, and someone else from Morocco who got theirs right away so it doesn't make much sense.

Yeah, the country of origin does not always seem to be the reason why they take so long from what I can tell. My wife is from Hong Kong and we had our AOS interview in August. The interviewer was very nice and said that we would be recommended for approval, but that the FBI was still pending with the name check business and to contact them in 90 days if we have not heard anything. Well it's January and still no word. I have scheduled an INFOPASS for the 18th of this month. Hopefully we'll hear something before then, but it's just a hurry up and wait situation. Alice is a nurse and has been out of work for a year now and is dying to get back to work.

  12. I would like to go to Brazil a few more times and get to know her better, but my work is in the US and I can't take more than 3-4 weeks off a year. If the whole process takes 9 months I want to get started now and get to know her in the meantime. If I wait until I've known her for a year before I begin the process, it could be two years from now before she can get married. That's a long time to wait.

Dude... take your time. This is a HUGE undertaking and not for the faint of heart. I know everything seems rosy in your relationship now, but I doubt that you are seeing clearly.

I went back and forth to Hong Kong whenever I could for over three years before I asked my wife to marry me and then we went through the k1 process. It took 1.5 years to get that visa and we had none of the problems particular to your case to deal with. I can only imagine how long it would have taken we did. She moved here this year and we were married in April, 5.5 years after we met. We are still waiting for green card and work permits that we filed for last May.

If after reading all of this you are still convinced she is the right one for you, then I strongly suggest you get a lawyer.

    Good luck!
