  1. Wife's K3 visa issued after over 2 months in AP. While K3 was held up in AP, CR1 case moved to NVC by using I824. The CR1 was assigned Embassy case number, DS3032 and I864 fees paid and forms mailed, DS230 fee paid. Question: Can wife enter USA on K3 visa and return to Thailand when CR1 interview date is set, receive CR1 visa and reenter USA on new CR1 visa? Or does use of K3 visa stop ability to receive CR1 visa? The K3 visa is good for two year but has annotation that K3 application expires 12/5/08. The original I797 said K3 application expired May 28, 2008. The Embassy must have extended the expiration date to 12/5/08. Wife was told she needs to come to USA before 12/5/08. The entry date before 12/5/08 must activate the K3 visa which expires in two years August 2010. We want to come back to Thailand in December and spend the winter which will probably coinside with interview date.

    The K3 was originally meant to speed up couples reuniting in the US and then returning to their embassy and getting the CR-1. It is called the LIFE ACT. MUCH better to have the CR-1 and not deal with AOS for the K3.

    Do you mean if wife enters on K3 she must Adjust Status (AOS) and can not go back to Thailand and complete CR1 process and get CR1 visa, or is it optional to enter on K3 not AOS and go back to Thailand and get CR1 since CR1 case is in process to come to Thailand. I realize it is an extra trip back to Thailand but we want to come anyway. If she can come on K3, we can be together in US for a couple months and come back and get CR1.

  4. What I am reading in this tread does make scense. For some odd reason my I-130 and i-129f were not paird together. I am a late July (I-130) filer and early Aug (I-129f) filer. So I only paid the $199 for both applications. Which to me never seemed write, but I wasn't to complain. My I-130 was approve some what early. I'm thinking now if the two were paired, then I would still be waiting for an approval.

    Did the notice I797 which approved your I130 instuct you to file form I-824. Have you filed the I-824? My I-130 was approved 1/29/08 and instructed me to fiel I-824. The same day my I129F was approved and instructed me my to file I485. Insturctions said my I129F would be forwarded to NVC but the I130 instruction did not say the file would be forwarded to NVC.

  5. If she enters on a tourist visa and does not tell them she is her to see her husband, and she is caught she will be denied entry, and your case will be in jepordy or slowed. If she tell the truth and she can prove she has good reason to return and not overstay they might allow entry. However, the boarder patrol do not like people entry like this and deny entry. The law is on your side but the power is in their hand. Therefore, if she is denied entry you've wasted a plan ticket, caused her and the baby problems. Only takes one boarder patrol to send her back. I've read the law and tried to understand USCIS reasoning. The way I read the law she can enter on a tourist visa as long as she does not work, returns within the allowed time, enterer the USA for the reason stated in the visa application, does not use social services. and has job in foreign country and compeling reason to return to foreign country. USCIS thinks everyone who enters the USA want to work and if married will stay in USA beyond visa allowed time, so they deny entry. I believe Home Land Security should publish this problem more clearly. Many people including myself have been seriously hurt because of this missunderstand

  6. Nothing for me either. I called the CSC and they told me I was in extended review (ie - background search). I calmly asked for the supervisor and told them I work for a large defense company and have clearances, so there is no way I'm in extended review. The supervisor admitted my file has not been looked at yet but was assigned to an officer. I was told the same thing 6 weeks ago. Only in a government position can you take 6+ weeks to complete assigned work.

    Still waiting, but being very noisy about it. Sending letters to senators, congressmen, the US attorney general, the president, first lady, Comptroller General of the GAO, etc.. I know it's useless for my case, but if everyone starts doing the same, by the time we do our Adjustment of Status, or remove the condition on our spouse's green card, there may be new faces in charge at USCIS. Wishful thinking.....

    We're in the same boat. Even worse every step of the way we have had gross errors made by USCIS. Calls to USCIS and personal trips to local office to report these error only causes a black mark for me. I wrote my congressman and got the same response that I was under extended review and background search. My record is very clean so I thought there mybe some identity theft or problem. Now I realize USCIS is the problem. They brought back many retired USCIS employees to handle added case load with lots of overtime offered. So these people have an incentive to keep the problem going. Job security for them.

  7. Does anyone know if I would have a better chance of crossing the border to get into the u.s. with my u.s. husband with me while my k-3 visa is pending. I didn't want to wait in Canada till my interview and I'm afraid of being denied entry if I try to cross by myself. What do you all think .... are my chances better crossing by myself or are they better if my u.s. husband flies up to Canada to get and then cross over with me.

    Before I was married my wife had a 10 year multi entry visitor visa. She traveled twice to USA to visit me. 5/18/07 she traveled with me to USA and was denied entry in Seattle because she told the boarder patrol she was visiting her fiancee. I can not find in the law where she can not travel to visit as long a her intent is to return within the allowed time and does not work or receive social services form USA. She had a return ticket and never work and does not intend to work. To resolve the issue I had to return to Thailand get married and return file I130 and I129F. We are still waiting. Immigration has a very narrow view of the law and I can not understand what there problem might be but they have the power so dont enter while your case is being processed.

  9. I'm new to VJ. Mailed I130 June 11, 2007, did not get I797 but learned of the WAC # from Boise field office. With the number I was able to register for email. CSC showed I797 was sent June 20 but we did not get. Requested another copy. I was told they were not able to mail receipt because CSC ran out of paper. June 29 Boise office said to send I129F with copy of email that showed I797 had been issued and assigned a WAC number. The I 129F reciept notice was form I797C issued July 11 from WSC said to check www.bscis for updates. Could not log on, thought www.bscis was a new web site under construction. Later learned this was a error and www.bscis was the old web site before uscis. 1st error I130 reciept notice I797 and 2nd error in I129F receipt notice. I realized USCIS has cerious problems, but telephone calls were useless. Receieved transfer CSC I797 dated July 11 issued July 24 stated that if premium processing had been requested call ##. Called the number but was told I129F do not qualify for premium processing only I129 job related application qualify. Tele to USCIS - told them wife does not want to work, i'm retiring and we want to travel. He said we would have hard time convincing them she does not want to work. More frustration, delays, and tele to USCIS. Went to Boise field office and asked to speak with sr officer. He did not know why I received notice about premium processing, but I130 would probably finish before I129F. August 2007 CSC processing time schedule dropped K-3 and only shows time for K-1. Looks like June USCIS made the change to drop K-3 but did not publish processing procedure change. Late October was told case should be adjudicated and call back in two weeks if I do not receive notice. 2 weeks later I called and they did not know what I was talking about. Boise office said I129F was still in WSC and would not be used, and I should probably call my congressman. The lady said their records showed I had called 7time and that was a record. I call because they make all the errors yet I'm punished because I want correction to their errors. November, came to Thailand for the winter, but would like to bring wife and myself back to the states in March or April to enjoy spring and summer in Idaho. Dec 19 received response from congressman w/ attach from cis my case was waiting more investigation. I have not received request for more info. I'm 24 days past the 180 processing time table. Any help you can give me would be appreciatied. I'm frustrated and need help so I joined VJ. Wish I had known about VJ earlier. :help:

    If you actually filed an I-129F and not an I-129, then it sounds like they might have put your case in the I-129 queue by mistake. USCIS didn't stop doing K3 petitions, they just stopped processing them anywhere but CSC and VSC and changed their processing times display.

    I did file I129F not I-129 and USCIS assured me it was a I129F and sent to CSC as K-3
