  1. Yes I mailed them a copy of my EAD card. I started receiving benefits even before they had that though. Maybe they didn't receive it in the mail yet?

    On April 30, 2008, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action. Please follow the instructions provided on the notice. We will notify you by mail when a decision is made.

  3. We want to get married and live here but we're not sure the quickest way that will allow him to work here almost immediately.

    The only way to have him work as soon as he enters is to get married and file for a CR-1 visa. Takes around a year to process, can be more or less. (That's a long time to be away from your husband, at least for me)

    Is it quicker for me to fly up there and marry him in Edmonton then file the paperwork when i get back home to Texas? Or, is it quicker to get the fiance visa, marry him here, then wait for the greencard?

    The K-1 visa takes approx. 6 months to get, sometimes less. After he gets his visa, he will come down to the US and you can get married. He will be able to stay after you get married (has to be within 90 days after he enters the country). Then you will file the I-485 for adjustment of status. Along with this you can file for the I-765 for work authorization (abbreviated as EAD) and the I-131 for Advanced Parole (abbrev. AP). Both of those applications (I-765 and I-131) are free to file as long as they are filed along with the I-485. The cost for the I-485 is currently $1010.00. The EAD takes around 3 months to process, so that means he'd be stuck here unable to work for 2-3 months, but at least you'd be together during the wait. Also, with a K-1 visa he cannot leave the country until his Advanced Parole gets approved, which also takes about 3 months.

    With a CR-1 visa you would be married before applying for the visa. He would have to remain in Canada while the visa processes which can take a year or longer. The pros to this visa are that when he enters the country he will already have his greencard and be eligible to work.

    Is there a visa that will allow him to live here immediately after marriage?

    The K-1 will allow him to live with you immediately after marrying, he just won't be able to work or go back to Canada for a couple of months.

  4. As said before, sure that is in the guildelines/rules for the AOS app. But you are at the mercy of a single USCIS officer, who may or may not interpret the rules the way they were intended. Many people feel it is much safer to go ahead and get the I-693A, which is easily and cheaply done, than risk getting an officer who doesn't know his stuff and getting an RFE. That is my opinion on this whole argument. :rolleyes:

  5. We send it to Chicago and my guess is that they separate all the different files (I-485, I-765, I-131) and send them to their specified departments. AOS being sent to MSC/NBC. Then, at the NBC the AOS is looked over and they decide whether or not you will need an interview. If you don't, they will send it to CSC, if you do, they will send it to the nearest field office to you. That is at least my understanding of the process :whistle:

  6. We aren't sure if my hubby's EI has been approved or not...he has been waiting for over 2 months now for his Record of Employment to come, but they said they sent it to EI electronically. He has been getting cards and signing them ever since he got here. When will he start getting payments? Does the fact that he is getting cards mean his EI was approved?

    My I-485 and I-765 were last touched on the date of the biometrics (4/2) Our cases have not been touched since...

    Should I be worried, or is this normal?

    Please let me know.

    Our I-485 and I-765 have not been touched since the biometrics either. The I-131 isn't even online yet :lol:....so I don't think it's abnormal that yours hasn't been touched yet.

  8. just came from biometrics... it was esy.. no people at all ... but they couldn't take my biometrics for so long as I have (regarding them) wired fingers.... :)

    Looked at my case online and my I765 (EAD) was touched again!!!!! So I guess it happened because of biometrics??? Then why not I131 (AP)???

    The biometrics appointment is for the AOS and EAD, it has nothing to do with the AP. Therefore, no touch. ;)
