  1. Hello,

    It's seems me that you talk about the I-94 whose the validity is the 3rd of december.

    One thing, you have to marry before this date. It's an obligation.

    After, you have to adjust status.

    It's the process.

    You can't marry legally in january, because if they catch her, she will have to go back to her country.

    If you do it, you have to start again all the process about adjusting I-130 (they already gave you this information).

    In conclusion, you have no choice.

    You are forced to get married before the 3rd of december ( and not '' My fiancee is due to leave on December 3rd'')

    And she can't go anywhere (outside Usa) now, before adjusting status (AOS), if she plans to go outside USA before receiving the AP (after sending AOS package), she can't go back in USA , and you will have to satart again all the process.

  2. If you are planning on a K-1 visa she has a one time arrival in the US on that visa. She cannot leave and come back again on that visa. Once she is here she has to get married within 90 days or she cannot adjust status based on the K-1 visa. Has she activated the K-1 visa yet? If so, then if she leaves the US without getting married she will not be allowed back in to get married later. You would have to start the visa process all over again from the beginning. If she gets married but hasn't received an Advance Parole (permission to return to the US) if she leaves the US you will have to start the visa process all over again from the beginning as well.

    If she is here now but not on the K-1 visa, then she can leave and return to the US when the K-1 visa is issued to get married. There is no guarantee that she will get the K-1 in time for your January wedding, however, if she isn't returning home until December. On what status is she in the US right now? On what status will she be returning to the US in January? Does she intend to stay in the US after the wedding in January or return home again to finish a spousal visa?

    If she is here on a K-1, then basically, going back home in December will negate all of your immigration paperwork to this time. Why is she going back?

    She is here on a K-1 Visa she arrived September 4th, the 90 day period expires on December 3rd. Our plans aren't until January, I we didnt want any legal complications so, originally I just wanted to know if she would be penalized for overstaying past the 90 days.

  3. Sorry for those who did not understan my question...my brain was fried on Monday, and I had no connection the last 3 days....

    My fiancee arrived in the US on Sept 4th...She is due to go back home on December 3rd....however our wedding plans are for january...I was wondering if anyone had a similar scenario...

    Thanks for ur answers and comments...I just dont want her to have to go back home and start all over again....our plans have been to marry since we started this :)

  4. Yes I have attached the majority from online statements...I just dont really know how valid would be.

    I mean I make enough my bank statements show it. I'm just trying to get all this over to her before the 12th of August, and I know that Ukraine mail is very slow. I still don't have some documents, so I'm thinking of just mailing what I have.

    As it stands now they have 2 years of taxes, 1 year of all my bank statements and financial info. My main concern was the I134 i had sent was from August 2007. I was going to update that with a new one, and attached I would send an employment letter along with a letter from my bank officer.

    Since the beginning of 2008 I have gone paperless and do not have a lot those documents. Requesting them would take some time, although i have done so, I don't think it will be here in time for her interview on August 12th.

    From the KEV-1 instructions packet:

    Any evidence from your American spouse/fiancé(e) which will show the consular officer that you and members of your family who will accompany you will not become public charges while in the United States. Documentation regarding financial support can be in any form – preferably one year of tax returns, W-2s, bank statements, earning statements, letters from employers. PRESENTING ONLY THE AFFIDAVIT OF SUPPORT I-134 FORM IS NOT SUFFICIENT.

  6. I do not receive paystubs....that was the reason i went with the employer letter.

    The question was whether you dan demonstrate YTD earnings. Commonly this is done with pay stubs, not employer letters. Don't your pay stubs have a YTD amount on them?

    Based on the tax info they have on me its shows income of 120k annually....my previous employer went bankrupt.....and my current salary is of 60k annually which is what my letter states. But in my HR department they did not put the YTD in the letter. They followed the instructions stated on the 1-134.

    From what I've experienced and seen others experience, I've learned the better approach is to do all you can to comply with the best practices and actual requirements. And in a conversation seeking help, it's best to answer direct questions, directly.

    I actually had to file an extension for my 07 tax returns because of accounting issues with my previous employer. However they have my 05-06 returns.

    I hope that doesnt become an issue.

    My fiancee did not receive the packet 3 in the mail...so I downloaded it online. However now to schedule the interview they are asking me for a case number that I do not have...It begins with KEV where can I find this number?

    If you're sure that the case has been delivered to the Embassy (and you don't have your NVC case number), call them and insist on checking by her last name. That what I did. They couldn't find by NVC# but found it after I gave them my last name.

    About the translations, I can give you the contact info of a notarized translator in Kiev but it's not hard to find a place anyway in both regions, and the capital.

    On a top of what I said, it wouldn't hurt to call the office in Kiev (044)280-13-32 and ask if they do via mail. They are independent and provide fast services for little $$ :)

    DS230 Part I & II are for immigrant visa only. Excerpt below from the instructions as provided on the Kiev website.

    APPLICATION FORMS:

    At the time of the interview fiancée visa applicants must submit filled out DS-156 and DS-156 K forms. The forms could be filled out either in English or Ukrainian.

    The immigrant visa applicants must present DS-230 Part I and II forms. These forms must be filled out in English only.

    I went to the Embassy website in Kiev nad downloaded the packet 3..you are right there is no mention of mailing anything. Seems like its just show up with the documents. So I guess I will call for her interview once she has her police report.

    mail them back and wait for packet number 4.

    According to the Embassy page for the Ukraine here on VJ...the beneficiary does not send anything back to the Embassy, they simple take everything with them to the interview.

    Please double check the instructions in package 3 though, things may have changed since that page was last updated.

    Everything should be written out telling you what to do.
