  1. I am filing AOS for my husband and will need a co-sponsor because my income for the past three years has been insufficient. My question--does the co-sponsor need to be a family member or can it be any U.S. citizen? Does the co-sponsor's relationship to us have any bearing on our petition being approved? We are looking to have a family friend be the co-sponsor,and I just want to make sure this is okay.

  2. I would suggest that you include everything that you have available to send as proof of consistent communication. It would be helpful for your husband to obtain his records since he has been in regular contact with you and that will make up for what you have lacking in your records. When I arranged my package, I used a two hole punch with the little metal clips to make things very easy for the person reviewing the records. And I sent in about 5-6 pictures--my husband and I aren't big picture people at all! I think that what they are looking for is proof of an ongoing, valid relationship, so you want to have a few items under each category of supporting documents. I wouldn't worry too much about what you are lacking, because it sounds like you have a good variety of proofs. I sent in all the communication proofs that I had access to from both sides (his and mine)--e-mails and snail mail letters we had sent to each other with my post office/express mail receipts, in addition to my yahoo phone records (which were not complete because my account deleting some of the older month's call histories!), and the travel documents (visas and flight/boarding passes) from the three trips I made to Ghana during our courtship. I sent everything I thought would be helpful, and had no problems at all. Hope this helps and good luck to you!

  3. I am filing for AOS for my husband who came here on a K-1 visa. We married within 90 days but are two years late filing for AOS (won't waste time rationalizing or trying to explain why because in the end it doesn't really matter, does it?). We are both very worried about what will happen because we are filing so late and have consulted with an attorney because of this.

    My question is, is it necessary to pay the extra money for an immigration attorney to safeguard against any potential late-filing problems? Or should we use the money we have saved that is avaiable now to pay for the AOS/doctor's fees and just file on our own? Any feedback would be greatly appreciated!

  4. I am so overwhelmed by this whole AOS process. I am not sure that I will be able to submit the AOS package for my husband by the time his K1/I-9 expires (December 8). My questions are: Does filing the AOS late lead to an automatic denial of AOS? Is it okay if your application is a little late? If so, how much time would be permissable? Also, do you submit the proof of a valid marriage (joint accounts, rental lease, etc.) with the application or is that submitted when you interview? I am going by the AOS step-by step guide and advice from an immigration consultant who only mentioned the required forms and vaccination certification.

    Please help!

  5. Hello everyone,

    My SO just arrived in the States and he said that the immigration officer took the top portion of his I-94 card and stamped and stapled the bottom (departure record) portion in his passport. I thought that the I-94 was supposed to be copied (both sides) and submitted with the AOS application. Was the officer supposed to keep the top portion or was it supposed to be returned in order for us to submit it with the other AOS documents?

    Also, the officer kept the envelope from the embassy, which I believe had the medical documents (vaccination record) from his medical exam. Don't we have to submit this information with the AOS paperwork too? Please, someone clarify these issues for me.

  6. Are you able to be approved for AOS with a co-sponsor if your partner does not meet the poverty guidelines? Anyone know of a case when AOS was denied because the petitioner did not meet guidelines and had to use a co-sponsor? Right now, I am only working part-time and do not meet the guidelines. I have a co-sponsor who works and receives retirement, so her income is well above the guidelines. Would my SO's AOS be denied due to my limited income or are we okay with the co-sponsor? What happens if you are denied? Any possibility of appeal?

I have had significant credit problems and am considering filing a form of bankruptcy in the near future. My question is, how will this bankruptcy filing affect his AOS approval? When we submit the support papers for the AOS, I will have a co-sponsor. I actually had to submit a notarized I-864 from myself and my co-sponsor back in June to the Embassy in Accra, Ghana, in order for our case to be approved. Will I have to submit this again for AOS or will the government have it from when my fiance submitted it to the Embassy? Will my filing bankruptcy cause a denial for AOS?

  10. I am so confused and worried right now. I just called KLM again to see if this really is their policy or if the person I talked to before just didn't know what they were talking about. I was told again by another representative that this is true, that he will have to show proof of sufficient funds to board the flight. I asked if this applied to just the tourist visa or to all kinds, and was told that it was applicable to all kinds of visas. I asked why this was the case because my SO had been approved to immigrate and I had submitted the affidavits of support as required and was told that him being approved for a visa had no relevance at all. I asked if this was just a KLM policy and was told no, that this was a mandate by the U.S. government!

    I have no idea as to what to do. They could not tell me how much money was needed to present at the airport. This seems to be so crazy, I just don't understand why they would care how much money he has, as long as he has the visa, passport, and money to buy the ticket. What gives??

    I have a situation that hopefully someone can shed light on. My fiance is immigrating to the U.S. next month. We were looking into getting a one-way ticket for him directly through KLM. When I called and asked about the one-way ticket, I was told that my fiance would have to show evidence of enough monetary support to "justify" a one-way ticket. I can't understand this. Shouldn't his visa be enough to justify purchasing a ticket? Why get a round-trip when he has no intentions of returning to Ghana in the near future? I submitted all the required paperwork, including sworn affidavits of support from both myself and a joint-sponsor in order for him to be approved for the visa, so why should KLM be concerned with how much money he will be bringing with him? When I asked them how much money would be acceptable, the agent could not give me any specific details! My fiance will be bringing money with him, but what if that amount is not acceptable to the agents at the airport? The agent told me that he would not be allowed to board the plane if he is unable to show the accepted amount of money. Anyone heard of this or have any advice on what we should do?

  14. Does anyone who has had their SO travel to the U.S. to immigrate know if buying a round trip ticket will cause any problems with the immigration officers? I have heard that round trip tickets are cheaper than one way and was thinking of buying a round trip for my SO. But does this cause a problem, since he will not be returning/using the second leg of the ticket? Please let me know if you have any insight into this.

    I have been so caught up in the whole getting approved for the visa drama and have not really researched what happens after your SO comes here and you get married. You have 90 days to get married once your SO gets here, right? Then you apply for the adjustment of status? What is that process like? What are all the fees that are required? What happens after you are approved for the adjustment of status? What is the timeline like?

    It's been over a month since I last visited the site. I have wanted to share my good news with everyone but have not had web access until now. I just wanted to thank everyone who has encouraged and supported me during the past few months and have given advice/feedback to my many, many questions during this process. I also have been looking forward to sharing my good news with everyone. My SO was approved on June 4 and picked up his visa on June 12. We are so excited to have made it through this part of the immigration process! I will be updating my profile and submitting the embassy review soon. Thanks again to you all and I wish those who are still going through this the best of luck.
