  1. Yes CR-1 = Conditional Resident Visa.

    If you your marriage is less than 2 years old at time of entry on a CR-1 you will get a 2 year conditional green-card.

    1) You will file I-751 to remove the conditions within 90 days of the card's expiration, two years after entry to the USA.

    2) YES, give SSA about 15 - 30 days after entry, then apply for a SSN if one does not show up in the mail, you will then use the SSN when filing a joint IRS return.

    My wife and my self finally traveled to US from Kuwait on Dec 08 and cleared all immigration process smoothly.

    Thanks to you all for the much needed support and guidance.

    I had some follow up questions now.

    1. What is the next step? I believe CR1 is a conditional residence. How some can I get rid of the condition. What all forms do I need to file?

    2. Can I file joint tax return for this year 2008? Do I need SSN Number to do so? It seems that I need to wait for Green Card to show up before filing for SSN? I have a feeling I did not select the option of automatic SSN assignment, hence have to apply for it my self.

    I am glad to tell you all that our Application has been completed at NVC and we have received Nov 11 as the date of Interview. I hoping that the date remains same and constant.

    I just wanted to get an idea from you all regarding what happens on the day on Interview. At the end of the day, go you get travel document on the same day? What do they ask you or make you do? Do you need to carry any thing with you? Any help in this direction would be very helpful.

    Need some help and direction.

    We are working on our Visa Application (DS-230 Part 1 and Part 2) and as a part of this we have been asked to send Certified/Attested Copies of Birth Certificate and Marriage Certificate. Today when I took the originals to a Notary to get copies attested I was referred to following website: http://www.nationalnotary.org/news/index.c...=83&focus=1

    and they refused to certify the copy.

    The web site mentions:

    Notaries may not certify copies of vital records

    It is common for applicants to be asked to supply a "notarized copy" or "certified copy" of vital records such as a birth certificate, a death certificate or a marriage license. An example of this is a person asking a Notary to certify a copy of a birth certificate in order to travel to another country.

    However, because the originals of these documents are kept by a public office, Notaries may not certify copies. The only acceptable way to obtain certified copies of vital records is through the agency that holds them, often a county clerk or registrar/recorder's office. Despite frequent improper instructions to obtain "notarized" copies, these are the only agencies that may lawfully certify copies of vital records.

    Sadly original documents for Benefitiary in this case are from Kuwait (which is her country of residence) and are currently with me in US (Appointed Point of Contact for all future correspondence).

    Would it be ok to provide regular copies at this time and produce originals at the time of interview? What would you recommend in this case?

  6. I just received NOA1 for I-130 Petition.

    1. Should I stay put with I-130 or go ahead with I-129F (K3) Application?

    2. Also if I go for I-1129F... I am a little confused.. what consulate should I apply for? Our marriage took place in India (New Delhi) but my wife resides in Kuwait and all current addresses in the application are for Kuwait.

    The web site says "The embassy or consulate where you, the spouse of an American citizen, will apply for a K-3 visa must be in the country where your marriage took place."

    I dont want to confuse and cause delays in process as it is already slow and long..

    Also I had visited DHS (Dept of Homeland Security) in Delhi Consulate and they said that all dealings should happen in Kuwait embassy as thats where my wife resides... Do I go with the website and apply for Delhi (which will be hard to manage as she does not stay in India and Delhi Conulate may get confused as none of the address is for India/Delhi and hence may end of sending back the application or delay the process) or Kuwait.

    May be I can write a detailed explanation for choosing Kuwait and file I-129F... with a hope that folks here would understand.. I have very little hope in the system though...

    Please help me out with this.. :help:

    Now I am thinking.. is it worth filing I-129F for K3?

    I was not aware that I could have filed it before (along with I130; with out NOA1).

    What do you guys recommend now? Do you think it may slow down my application or have no impact?

    Hi Venkat,

    Do we have to wait for NOA1 before we send K3? It seems you mailed both together. Did you go through and attorney for this process? Do you have to mention in K3 application that I-201 has also been applied?

    I am about to submit I-130 for my wife and needed some help with what was needed to be submitted along with the application.

    I am submitting following:

    • pictures (4 in number)
    • marriage certificate
    • affidavit from parents and relatives
    • Joint bank account letter

    Do I need any this else?

    For example do I need to submit:

    • Passport stamps for exit ad entry into India for both of us
    • Itinerary and Boarding pass receipts for both of us

    I did not want to over whelm them with papers.

    Any help would be much appreciated....

    Lets say my Fiancee gets Visitor visa approved in Feb but we plan to get married in India in Apr. So far I was planning to file K3 Visa once I come back after marriage. So lets say she comes with me to US (only for Visit) and then while she is here we start I-130 process.

    Q1: Would this be a problem? Can she enter US on Visitor visa prior to starting I-130 Process?

    Clearly our intentions are not to do change of status once she is here. Only to get her adjusted to the environment and people.

    Once I-130 is nearing approval or her visitor Visa is expiring, she can head back to India and then wait for couple of months.; do the paper work for K3 and come here on that visa.

    Q2: Does this seem like a viable option for us?

    This way we can at least spend some time together. Other wise.. if I come back after marriage and apply for 130/K3.. it may take 6-7 months...

    It's a perfectly viable option if a visa can actually be obtained.

    In case Visitor Visa is rejected .. then would it impact K3 Visa application few months down the line?

  12. Hi Folks,

    I am planning on applying for Fiancee Visa but I don't have a picture of both my fiancee and my self in one frame. I do have individual pictures with other family members for the day when we meet first time but none for both of us together.

    What are the chances of 129F approval without this?

    I do have passport stamps and itineraries that puts both of us in the same city.

    Any suggestion/pointers would be appreciated in this regards.
