  1. Well, she did over stay more than 180 but less than a year,

    her I-130 took 2.5 years to get approved and now we will get her interview date, her three years are complete in Feb 2010, so i think i should just ask my lawyer to start working on the waiver now rather than later, so in case if the interview does go south and she gets it rejected then we can file the waiver right away.

    another question though, for the interview, can i go with my wife to the embassy and can my kids also come along ?

  2. My wife finally got her K3 and I-130 approved today.

    Now the questions is what are her chances of getting a visa.

    She overstayed less than a year and has already been out of the USA for 2.5 years. In feb she will complete her 3 years.

    Do you guys think that the consular will reject right away or might approve the app in the embassy

  3. i was under the impression that fbi backlogs were done, just a side note, my background/security check for citizenship was never done until the court ordered them to do it, they were just sitting on it. i feel that it is not her background check but my background check as i applied for her

    just as a side note also that i am a muslim of pakistani origin and i think that plays into it

  4. I have applied for my wife, I-130 in Jul 07 and I129F (K3) in Aug 07. The case has been pending ever since. I have contacted my senator and Congressman and all i get is that the case is pending Security Check.

    My questions is that what options do i have to pursue this is any further. I have two kids who are US Citizen and they are have been growing up without a father.

    Is a lawsuit an avenue or what. I am just tired of waiting and it is affecting me, my wife and kids more than before.

  5. I applied for my wife an I130 and I!29F in August 2007. No response from the USCIS other than a response to my Senator that it was in Name Check, this was in March 2008.

    I have two kids and wife is in UK and is a resident there not a Citizen. My both kids are US citizen and they were born in USA. she over stayed her visit visa by 11 months. I just want a decision on my case i guess be it an approval or rejection so i can take other decision or appeal it.

    Any idea or suggestion what my next step should be. My name check was stuck for 4 years nearly and took a lawsuit to get that taken care of.

    I don't like the Lawusit avenue but is there any other way ??
