  1. What can I say, even if you earned a penny assuming you are doing a Schedule C for self employment, that has to be shown on line 12 of your 1040. That $400.00 cutoff only applies to whether you have to pay FICA taxes on your net income. Make a cent over $399.99 and the government takes 14.8% of that.

    Can you explain this part? 2010 was the first tax year for which I filed out a self-employment schedule. I did not for 2008 or 2009 because it was not over $400. In fact I was mistaken and thought I did not need to include it anywhere at all, stupid mistake, and now I want to go back and include it. But are you saying I need to fill out a self-employment schedule for 2008 and 2009? Don't I just need to include it under miscellaneous income or hobby income since back then it was not over the threshold for self-employment income?

    Should I mess with this before his naturalization or after? Will it affect him in any way??

  2. I think I may include a note instead of actually crossing out the number on the forms.. because some have said that can be bad..

    Still not sure!! Sounds like people have been successful either way. Odd that they won't just make a correction to the form or 2 separate forms..

    I asked a lawyer and they said you still need the information for 5 years because some of that information may be relevant to determining good moral character.. however I thought the statutory period for good moral character when applying through marriage was 3 years.

  3. In 2010 I made significantly more than $400 in self employment income and filed the required schedules. We also have regular jobs.

    In doing previous tax returns in other years (2008 and 2009) I did not realize that I had to report income from the same activities (Amazon Turk and Amazon Associates in 2009 and just Amazon Associates in 2008) because it was less than $400. I guess I was supposed to put it as hobby or miscellaneous income.

    Dumb mistake I know. But now I realize this and I want to amend my taxes to reflect this.

    Will me not realizing this and having amended taxes affect my husband's naturalization? The ability to prove good moral character? It was MY mistake. We have also amended 2009s taxes once already because some W-2s that we had forgotten about came late. So 2009 will have been amended twice and 2008 once.

  4. If your N-400 application is based on marriage to a U.S. citizen - should you use the 3yr instead of 5yr timeframe when filling out employment, time out of country, addresses, etc.? Even though the form asks for 5yr? The checklist for N-400 on VisaJourney says that you only need 3 yr tax transcript instead of 5yr so wondering if it applies to the other things like employment as well. I'm thinking it makes more sense to cross out the 5 and put 3 wherever it's applicable.. and only put jobs, addresses, etc. for only the 3 year time period since the Permanent Residency was granted. Because this is all they care about when naturalizing. Or is my logic flawed? What did the rest of you do?

    Oh I should explain that the reason my husband has any information in the U.S. prior to the 3 years is because he was here illegally and we did the I-601 waiver. But he has been an LPR for almost 3 years.

  5. I'd like to know if any of you have done/are doing the waiver process with your K3 .. I am waiting for my interview in CDJ and I want to know what the differences are between the waiver process with a I-130 and the process with the K3 .. I can't seem to find many people who have done it .. any experiences/advice is appreciated.. thanks !!

  6. Guys please help me as I don't know what to do.. I sent the I-129f because I wanted to speed things up.. now things have changed and I feel like that was the STUPIDEST decision I made in my entire life.. I don't know why I ever filed the dang thing. I got touches on my I-130 yesterday and now today on BOTH.. I keep debating back & forth whether or not to cancel the k3 or just let it ride and see what happens.. has anyone gotten just the I-130 approved lately? I know, I know I should have realized this before but I just really regret sending that dang k3 !!!!!! :wacko:

  7. Hello! I want to be able to help with documents and things because most of them are in english and I will have my passport, it never leaves my side in another country!

    So, then, why am I hearing from people that the American Spouse can not enter the counsulate? Does that mean that I need to just give her all my docs and sit outside. . . her without cell phone or anything?

    If I could wait with her for hours inside where it is safe, it would be ideal. And I could help with sending her into rooms with the proper paperwork and stuff.

    Could someone tell me?

    Spouse can not go inside. I do not think cell phones are allowed either.

    POSSIBLY with the new consulate this could change but not sure when that one opens either.

  8. Hey guys.. I am from the other forum (I2us) I've been reading about this and finally had to post..

    I filed the I-129f a few weeks ago before I knew about any of this and now I am REALLY wishing I did not! I had filed my I-130 in very early November and WOULD be 3 months into a '6 month wait' if it wasn't for this.. Is this really happening? Has ANYONE who filed for a K-3 after July 31 / no fee been approved ??

    *sigh* We need to get some answers !
