  1. My AOS has been transferred to the CSC...no online update, just hardcopy letter. I begin to get the idea that they only update it when they feel like it

    Sorry what does CSC mean. California Service Center? I am in Texas and I was wondering what the significance of the transferring is. It seems like some people get their EAD before their file was transferred, while others do not. Also when they transfer my case will it go to the closest office to the city I live in (i.e. San Antonio) or does it go to the regional office center for Texas. I am wondering this because on they USCIS website I think they have waiting times for both for an EAD. So frustrating... :unsure:

  2. I'm wondering if anyone has been in my shoes. I'm married to a US citizen, have been here on an H1B, which expires Feb 18/08. I'm applying for my AOS and EAD. I want to know if I can work between the time my H1B expires, and I recieve my EAD. I'm getting conflicting answers. Some indicate that technically I shouldnt but since i'm married to an American, I can, and it will be 'forgiven'. I'm also finding some information that says since i'm applying prior to losing my 'legal' work status, I can continue doing so until i get my EAD.

    I'm hoping someone out there can help me out....i'm so confused, and sooooo stressed!!!

    It's a grey area. I am in the same situation. Even on this site there can be conflicting opinions. Call USCIS.

K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

    So what you are saying is a K-1 holder is "Work Authorized"??? Meaning I can work?

    Sorry I'm confused.

  4. I'm glad to find a subforum that has Canadians on here. I asked for the EAD stamp at my POE in Blaine, WA and they looked at me like I was speaking french. (sorry Quebecers) ;) I'm from Vancouver. Now I'm living in San Antonio, TX. I was just wondering can I work right now while on a K-1? I've already got married and applied for the required AOS/EAD/AP? I was just hoping to get part time job a restaurant or something for now. I plan on teaching in the fall. I'm bored as hell. :help:

You may be thinking about the EAD stamp, it is not USCIS policy to issue this stamp, it is optional, and JFK POE does it as well as others, I have read many posts where people have got the stamp at other ports of entry. JFK can also discontinue this at any time, the stamp is not required to get a SSN from SSA.

    K-1 is NOT a work visa, it is a marriage visa.

    I was wondering if I did go to the local airport here (San Antonio, TX) and asked them for the EAD stamp. I've already entered on a K-1 with my I-94. I asked them at the border (Blaine, WA) when I entered for the EAD stamp and they told me to apply for a I-551 when I got down here. They probably were unclear on this issue. There is an immigration office at the airport here.

    I want to start working but I am very unclear after reading several posts on this website if I can or cannot work while on a K-1. I have a SSN but it has "with INS authorization." :wacko:

  6. EAD approval has more to do with filing date than with biometrics. If you have been waiting around 90 or so, regardless of when you had your biometrics, you should be almost approved.

    In our case, because our ASC is so backed up, we have biometrics on Friday and the card production was ordered on the following Monday.

    Thanks that is starting to make more sense. After reading several people's timelines; some people get their EAD card a week after their biometrics, while others have to wait another month or more!

  7. Just a quick question for anyone out there. After the biometrics appointment, how long generally till the EAD is approved? (I filed it with my AOS and AP) I know every case is different, but just wanted to get an idea. Looking at the timelines here, I find that people tend to forget to update them or put incorrect dates. Also I've been reading about having the EAD card ordered? Will I have to order it or does USCIS? Also can I work prior to physically receiving the card once I have approval? I want to start working ASAP and it is really frustrating.

  8. I am a K-1 Visa holder and just got married. I am from Vancouver, BC. I am now filing for my AOS, EAD and AP. However while looking at the "Section 6.0 .. After Marriage - Adjustment of Status" I got a little confused regarding my vaccinations. It says:

    "The I-485 instructions mention that no additional medical is required if filing for AOS within a year of the medical required to obtain the K1/K2. You should simply send in a copy of the I693A (sheet that lists your vaccinations) that your doctor should have provided overseas when you had your medical."

    I had my medical exam done and Vancouver and I supplied my vaccination records. I was given a worksheet from the doctor's office that was put in an envelope by the Vancouver Consulate. It states my vaccination records. However it is not a USCIS form I693A like the Visa Journey guide suggests I had received. Also there is no form listed as I693A on the USCIS.gov website. Does this form exist? Do I need to have it?

    So can I work or can't I right now? I know I need a SSN which I will be getting this week. In my passport I have my I-94 and 2 stamps that say K-1 Visa. Any clarifications would be much appreciated.

  10. Should I file an EAD before our wedding? Is it worth it?

    I am Canadian and my fiancee is a U.S. citizen. I just arrived on Nov. 21/07 (San Antonio, TX) on a K-1 Visa. Our wedding is not until Jan. 26/08. However I would like to be able to work before then. I have some jobs available. What would be better to do:

    a)get married ASAP (judge,courthouse) and file for EAD and AOS. **Question** Does the AOS fee include the fee for the EAD? We would still do our wedding in January eventhough we would already be married.

    b)file EAD now and file AOS in January after wedding. **Question** Do I have to file another EAD in January even if I have already received an EAD?

    I would like to be able to work as soon as possible. Just wondering if one of these routes would be faster than the other. If not I am going to BestBuy to get an Xbox 360 and start waiting. ;)
