  1. Here is my story..

    I'm a physician in training.. I was planning to apply for training in the US and I was advised to get a green card first as my wife is a US citizen (It is SUPER difficult for foriegn doctors to find training spots in the US). Anyway I applied to both Canada and USA (Canada is even more difficult but I had to maximize my chances). Few days after my GC card interview I know that I was accepted in Canada so given the above mentioned I accepted the offer immediatly (medical training is much more valuable to me than a green card). After 2 months I received my green card and I did my firt landing in the US in June 2010. Being a physicin in training makes you very busy with few off days. I don't have the chance to enter the US. 9 months from my initial entry I decided to go to apply for SSN and open a bank account. The visa officer did not like it being away for such period and warned that I may lose my LPR status and advised to get a reentry permit and wrote that on my passport! He said I can apply for the permit while im "outside the US" (which proves his ignorance or mine).

    What should I do now? I don't think it is possible to apply for a reentry while im in Canada and I don't have the time to wait in the US as it needs at least a month for the initial acceptance. Is there anything I can do to keep my green card or it is better for me to abounden it? Im planing to come tolive in the US after 2-3 years for a subspeciality training that why I would like to keep it...

    Any help PLEASE...

  2. It's possible, but it's going to be a slow process. If you haven't been assigned an SSN you will need to apply in person somewhere. If you are going back to the U.S. any time soon, I would just wait until you go back. What country are you in right now?

    I'm in Canada right now and I might not be able to go to the US soon. Is there anyway I can know whether I was assigned a SSN or not? If i was not assigned one how to apply by mail?

  3. firstly, you are not interviewing for a greencard but a visa. greencards are only issued after you arrive in the USA

    If the baby does not have a claim to US citizenship (which you say he/she does not) then AFAIK then the baby will need an I-130 petition.

    I know that it is only a visa, I just use the name inter-changably..

    Yea the baby doesnt have a calim to US citizenship.. Do you have to do an file a whole new application from the start for the baby?

    You already have the answers to the baby's citizenship. You need to add the baby to the CR1, I would guess. Who and how you do this will depend on the stage you are at with your petition.

    I'm confused to how you're filing for CR1 if your wife isn't resident in the US? I'm probably ignorant to the facts, but thought that residence was required by the USC to petition for a CR1 visa.

    We cannot apply for a US passport for the baby since my wife didnt live in USA for more than 5 years after her birth there (It is written in your answer), so he cannot be a US citizen for the meantime..

    You can file for IR-1 visa even if both US citizen and spouse is living outside US.. there is a whole section here in the forum for DCF (Direct Counsel Filling), which the way we went through.

    I want to know what to do now, should I apply a whole new application for the baby, since I almost finished my own process, or there is a way to add my baby to my original application prior to the interview which is next month??

  5. Ok here are some facts..

    1) I'm the husband and I'm a non-US citizen, my wife is the US citizen and she is sponsering me

    2) Our child was born outside USA, and since my wife didnt live in US after her birth there, they said the baby cannot apply for a passprot now but he can apply for a green card then a passport at a later stage

    3) I'm in the final stage now which is the interview prior to issuing a green card for me

    4) All our family is not in USA now

    5) I have not done anything regarding the baby issue, ie, the emabassy is not aware that i have a baby now

  6. Good Day everbody...

    Im a Saudi and my wife is american citizen, I would like to start a new thread regarding DCF in Saudi Arabia, my personal experince in particular..

    I went with my wife today to the American Consulate in Dhahran to file I-130, the documents we took:

    1- I-130 form

    2- G-325a forms, one for me and one for my wife

    3- The original US passport of my wife and ALL pages copy, but the officer took the original passport and made a copy herself

    4- The original passport of me, she made a copy also

    5- The original marriage certificate with official translation

    6- 2 passport-size photos, one for me and one for my wife

    7- A cash fee for I-130, 355$ which was about 1340 SR

    The officer explained to us what immigrant visa means, and we were asked whether we fully-understand the issue, we said YES!

    Then the officer gave us a reciept of the fee, and said she will send the application to the US embassy in Riyadh, which will further contact us by mail

    That is it for now... will update you in case of any developments

    Updates:

    On 24 Feb my petition was approved, I received no notices from the embassy

    On 1 March I received Packet 3 by mail, and assgined a "case number"

    I will write u the contents and the instructions in the packet later
