  1. My spouse was detained while crossing the border on 12/24/14. He received a positive credible fear determination from an asylum officer and has been in removal proceedings ever since. He submitted an asylum application and the i797c shows received date was 12/28/15. I am a US Citizen and filed an i130 for him, which was approved in 2017. Our case was referred to NVC and he has an appt for his IR1 visa interview in Honduras in September, so he is awaiting voluntary departure from the IJ. Based on this info, will my husband need an I601/I601A waiver? I appreciate all help/responses!

    Yeah I definitely plan on doing so but I’d heard that it was also good to update everything online beforehand. I guess providing everything at the interview will have to do. Thanks so much for your help!

    Thanks for bringing that up. I have not updated it. I also have to upload updated police reports but I haven't yet figured out how to upload updated docs to ceac. I noticed it only allows me to add docs under "Additional AOS Supporting Documentation" or under "Optional Documents" for the civil docs. Is that the best way to upload the most up to date documentation once the previously uploaded ones have been accepted? 

  4. I’m a US Citizen and have finally been able to schedule a visa interview for my spouse. He’s scheduled to be interviewed in Honduras in July. I’ve found out recently that Consular Officers are requesting Tax Transcripts instead of Tax Returns. I have the Tax Transcripts and all docs for 2021 and 2019. For 2020, I have the Tax Returns and W2 but the Tax Transcript shows “verification of non-filing”. I’ve filed taxes for 2020 but had to mail it in, and the IRS has yet to process it. Not sure if it’s due to COVID, but IRS says there’s nothing I can do but wait. Anyway, I’m super worried that this will be an issue and cause them to put our case on Administrative Processing. Does anyone know if they’ll still take the Tax Returns in lieu of the Transcript? I’ll be providing add’l docs such as paystubs, employment verification letter, w2, etc. Any insight will be helpful! Thanks
