  1. Hello Frieds,

    I am a US citizen and got married in June 2007 in India and my wife came to US on CR-1 visa in June 2008. Its now time to apply for removing her conditional residence on her green card and somebody told us that we could apply for her naturalization instead. I have checked the eleigibility requirements for naturalization of spouce of a US citizen and all rules say that my wife needs to have continuous residence in US for 3 years preceding application for naturalization. Since my wife has only been in the US for two years yet, i beleive we are not eleigible for applying for her naturalization. But I wanted to check with everyone here to see if I am not missing anything. We would rather apply for her naturalization if we are eligible now so we get done with everything in one go and don't end up paying more fee for her naturalization later. Please advice if there is a loop hole somewhere which makes my wife eleigible for citizenship at this point.

  2. Given your absence from the US, I don't really see how you can attend the biometrics appointment within the given time frame, so I would strongly advise you to revise your travel itinerary. If you insists on gambling, however, your I-751 would have to be mailed about 20 days before August 1.

    I was reading this post regarding some querries i had. Could someone please provide further clarification. My wife came to US via I-130 about 2 years back and she is currently on conditional permanent resident status and she will be eligible to apply for removing the conditional permament resident status in beginning of March. We are planning to travel to our home country in Novemeber for about 3 weeks. Although that gives us more than 6 months after she applies for I-751 but i am wondering what if her application processing takes more time and she does not have her permanent green card by Novemeber. her current green card would have expired by then. If we schedule an appointment at INFOPASS, will they be able to issue some documentation to let my wife back into US without her permanent green card. Please clarify. Thanks!

  3. you would need the interview letter to get a medical examination done. depending on which country the interview is held usually the US embassy has service where they can distribute duplicate copy of the interview letter a week b4 the interview if you still haven't received the letter. You might want to call at the embassy and check before hand in case u have to take that route.

    i have question about certified copies to NVC as part of DS 230. i understood from reading here that if you are sending original documents then the photocopies you attach with those documents don't need to be certified. but what is everyone doing for the copy of the passport. since I will not be sending the original passport of my wife to NVC, does the photocopy of the biographical page of the passport need to be certified by the passport issuing authority in my wife's home country or is it acceptable to get it notarized by a US notary public b4 sending to NVC. any advice will be appreciated.

  5. Hello friends,

    I called NVC this morning and heard the typical "information missing" message. I have read on here that this typically means they have processed yr I-864 and IV fee bill and waiting to recieve DS-230. Does this mean I can send DS-230 now? here is a lil backgroud information on my timeline.

    I-864 sent on March 3, 08

    IV fee bill recieved on March 10, 08

    IV fee bill sent on March 11, 08

    Although I am still working on getting all the documents ready for DS-230 but can I send it as soon as i am ready or do i have to wait for the checklist from NVC? (the automated message said," we have received your packet of forms and have found information missing. A letter was sent on March 17th informing you of the information missing.") Also now do I send the DS-230 to ATTN: DR or CMR?

    Please advice.

  6. I think I went a little overboard by trying to give NVC extra info instead of missing info. This is what I did-

    I sent a copy of my tax returns , w2 and w7 form for year 2007 and also transcripts of years 2006, 2005 and 2004 from IRS. The instructions on I-864 did say the most recent three tax returns so in my understanding 2007 had be included without fail.

I have a question for those whose beneficaiaries are/were in new delhi, india - i have come to know that the passport office requires a formal letter from the NVC instructing the benificiary to get a police clearance certificate. Is this really true? My wife was getting ready to go get the PCC from passport office but didn't go when she was told this by someone else. It is my understanding that even when she gets the letter from NVC asking her to complete DS-230 and the supporting documents, the letter only points her to the downlodable instructions available online for the documents required for appointment posts and not specifically list the documents needed in the letter. If that is the case she will not be able to satisfy the passport office's requirement for a letter from the NVC - what is everyone's opinion? please advice.

  8. I read above in this thread informing everyone that bombay and chennai are appoitment posts now. I wanted to let everyone know that new delhi has also been changed to appoitment posts now. I do not know if this is good or bad but gives me a feeling that my wife will have to do less in india before her interview.

    I also have a question for those whose beneficaiaries are/were in new delhi, india - i have come to know that the passport office requires a formal letter from the NVC instructing the benificiary to get a police clearance certificate.     okay i know i am jumping the gun, in that i am way to early in the process. we have filed a 129-f. so when we get the notice from the NVC i send all those documents listed, birth cert, divorce decree, etc. out to the NVC? i thought that when i send my fiancée the copy of the original packet sent to the CSC i enclose all the originals for her to have at the interview.

    sorry for being confused

    This part of the NVC process applies to IR1/CR1 visas only - not K visas :thumbs:

    I wanted to add to what I said below, it should have read: NVC does not receive the documents for Standard processing posts. They just request a copy of the biographic page of the passport and part 1 of the DS-230 I believe. Not many posts are standard anymore.

    for the standard processing does nvc still receive the original documents and then forward to embassy? there are 2 standard processing embassy's in india and 2 apptointment now and if I am not mistaken they are different it how they receive the documents. I think only the appointment processing have you mail to nvc and then vfs is out of the loop, at least that was my understanding from nvc when I asked them about chennai (chennai and mumbai are appointment processing now).

    Standard processing posts do not receive the documents.

    Bombay is Appointment processing.

    My question is when should I send I-864 to NVC. The automated message says they have received my AOS fee bill and DS-3032. Should I call the NVC to check with an agent if I-864 has been generated before I send completed packet of I-864 or should I send it without even calling? Please let me know

  11. My boss is on vacation till tues next week and was wondering if there was a way around this. So i guess i will have to wait till then to get this letter signed and the I-864 packet sent. I hear it takes about a month for them to generate the IV fee bill, which means sending my I-864 a little late would not really delay anything.

I was wondering that with regards to leeter from employer - do I need to send a letetr from my employer with my current slalary, position signed and dated recently by my employer or can I send the appoitment letter that I recived from my employer when I was hired by them? Please advice.

    I sent a letter from my employee stating how long I`ve been with company, what is my position, how much I make and been dated and signed by my boss.

    First of all, thanks to everyone who have come up with these shortcuts and are still actively working towards improving them!!! We all appreciate your efforts and are definitely benefiting from them.

    I have read on here that the IV fee bill has been raised to $400. I am wondering if anyone is aware of what the updated break-ups are (i.e. the application processing fee and security surcharge). I have downloaded IV fee bill from Chris P's topic and have completed it with the top bar code and other information. hopefully indianheart will give us a good news about experimental bill being successful and we can all follow quickly.

    Indianheart - it would be helpful if you attach a copy of the IV fee bill you sent with the bottom bar-code pushed to the right margin where the last 9 digits appear to get cut by the printer. If your strategy is successful, we can all start using your template to make ours look similar. Thanks and all the best to you! My prayers and wishes are with you!!!
