While you're trying to get them some other way, why not fill out the form and order them by mail? We did and it didn't take very long... a week and a half? We were getting nowhere trying to reach an office or phone number that would allow us to order them any other way. We concluded the office here does not offer that service, and there was something going on that we weren't able to order them online. I would get it in the mail while you pursue other means. It's free.

I finally got them in the mail and mailed everything last week.

Ok having a problem with calling for tax transcripts. I entered all of my information and it says that it can't process it for the years that I entered. I'm guessing it is because my husband filed them jointly as the head of household. If I enter his social security number and get his tax transcripts, would anyone happen to know if it will have my tax information on there as well?

I keep calling and entering different options and can't get anyone on the line to talk to.

Canadians are treated somewhat differently at the border. Don't worry about it, put it down in the application, mention what happened and move on. It's very unlikely this will cause any issues with your application.

Regarding the tax transcripts - i included them with the package sent to USCIS, and I will also bring a copy to my interview.

Sorry to bother you with so many questions but I'm not finding how to get my tax transcripts. Did you call the IRS or go to their website for it?

Deportation and Exclusion are the old names used before 1996. After 1996 they are both called Removal.

When you fly from Canada to the US, don't you usually go through US pre-clearance in Canada? Or did you fly from a small airport that didn't have that? Or you weren't flying from Canada?

Anyway, if you flew to the US and were denied entry, one of two things happened: either 1) they let you voluntarily depart on your own, or 2) they "removed" you. Did they give you any papers or stamps from that incident that would indicate which of those happened?

I flew from Ottawa to Toronto. While going through customs in Toronto is when they searched my bags and told me to go back home and get proof that I wasn't fleeing Canada. Nothing was stamped in my passport at that time. I got a bunch of proof and drove to the closest border (my boyfriend got in his car and drove 20 hours when I told him they wanted proof) and met my boyfriend there. I went in and gave all of my paperwork to customs and they allowed me to enter on a visitor visa.

If they allowed you to withdraw your application for admission (which is very likely if you are coming from Canada), then it wasn't a removal/exclusion proceeding.

I tried to fly to the US in 2007 to visit with my boyfriend at the time (whom I later married on the K-1 Visa) but they searched my bags and thought that I was trying to flee my Country which was definitely not true. They made me fly back home and said not to come back until I had proof that I wasn't fleeing. I immediately got bank statements and a letter from work stating that I would be back on such date. I flew back the next day, showed all of my proof and was allowed to visit.

I'm wondering if that would be considered excluded as I wasn't allowed that one day.

I would put it down in the form and briefly explain what happened. Explain in detail if asked at the interview.

Yes, the N-400 instructions explicitly call for the proof that you have been filing your taxes. I recommend getting tax transcripts from IRS, they are free.

I am getting everything ready to mail my application in and have a few questions that hopefully I can get some answers to.

1. Part 11 question #33. Have you ever been removed, excluded or deported from the US?

In 2007, I was refused admission to the US due to a misunderstanding. It was resolved and I was allowed entry the next day. I provided information about that incident when I applied for my K-1 Visa. Would refused admission be considered excluded as asked in the question in this application?

2. I am applying on the fact that I have been a resident of the US for at least 5 years, do I need to send in tax forms or need them for the interview part at all?

3. I see two addresses to mail the packet to. I read comments saying to mail it standard priority. Would it be the first one?

I got a wonderful surprise in the mail today... My approval letter!!!!!!!! I have no idea what the guy was talking about yesterday saying it could be another 60 days. Oh well, very happy right now! It says that I was approved on September 30th!

I just called the Customer Service line and they said that VSC is processing Jan - Feb and that it might be another 60 days before I could be approved. Ohhh, the waiting game sucks!

When we did a search yesterday, we found this:

A: Still, the alien must have been married to a US citizen for 3 years, before becoming eligible under Section 319 of the INA. In the case of a remarriage to a US citizen, the alien will accrue 5 years of permanent residency becoming eligible for naturalization in accordance with the regulations specified inSection 316 of the Act, prior to the new marriage qualifying the alien under Section 319.

I hope this is the right forum to post this, if not... feel free to move it to where it belongs.

I trained a new employee for my department yesterday and it turns out that he moved to the US a few years ago on a K1 Visa from Ottawa, Ontario (Canada) as well. Such a small world!!

We were talking about Canada and the things we miss and he brought up that he got a divorce from his ex wife after two years of marriage and filed for Removal of Conditions and was approved. He will be filing for Naturalization in December as he will have been a Permanent Resident for 5 years. What striked me as odd is that he got remarried to a US citizen last year.

The odd part about that is I thought I read somewhere that you can't remarry a US Citizen until being a Permanent Resident for 5 years. Hmm, I might be wrong but he is worried that it will mess things up for him in the future, when it comes time for the Naturalization process. We searched on here yesterday but we didn't find anything about this type of situation. I told him I would check to see if anyone knew of anything and told him that he should make an account on here because everyone is very helpful.

So, what he is wondering is will it mess things up for when he files for Naturalization or will he be fine? He was also wondering, if there is this 5 year rule for people that get divorced before 3 years of marriage, why was he given a Marriage License? I doubt if they typed his name in the system that a big advisory flashed saying, not allowed to remarry for X number of years! Lol then again, maybe it did and the lady ignored it? Ha!

Any ideas, opinions, suggestions, etc are appreciated. I feel bad that he is worried now.. I didn't meant to make the guy worried!

This is straight from what A&M posted, she drove to the Atlanta office to do her biometrics (she also is about to have a baby ANY day now!)

Here is what she wrote:

Updating our biometrics. We took a chance and drove the almost 2 hrs to Atlanta today. They THANKFULLY let me walk in. The security guards were super nice to me (not sure if it was just because I look like I could pop at any moment) but they were laughing and joking and asking if it was my first etc. I think we arrived at about 9:45am maybe a bit later. Hubs waited in the car in the parking lot while I went through security. There weren't many people in line at that time. I filled out a form, got in line to hand it in, the same nice security guard collected and stamped it and checked the front and back of my hands, I was then given a number and asked to go sit in some chairs and wait. They were at 119 and I had 137. I waited until my number was called then went and got the finger prints and photo taken. I took my time afterwards, but was back to the car by 10:30am. So glad they let me get this done and over with. Now this baby can come whenever he/she wants! Overall it was an easy stress free procedure!

I recently moved (it was very last minute) I called and USPS and USCIS with my new address but I'm worried that the appointment letter was mailed before I was able to change the address. I hope it will be forwarded to the new address!

Has anyone done early biometric in Atlanta? If so, how is the staff - do they allow or turn you away?

I havent received my biometric date yet but I'd like to know as well because I would like to get it done early when possible.

We will be mailing ours this week. My 90 days will be Feb 5th so, I don't know if I should mail it on the Friday or wail until Monday. Can't wait to get this next step started!

Hi, I'm going to send mine hopefully by the 16th... started to get everything ready today, but the 90 days begins on the 17th... Trying to figure out if I have to submit passport pictures or not for the new green card, and if I need to copy my passport or just the 2 year green card?

I'm wondering the same thing. Do I have to submit a new passport picture for the new green card? Do they require a photocopy of my Canadian passport? Also, Eric's address on his drivers license says our old address and mine says the new address. Do I even need to submit a photocopy of mine if I don't send a copy of his? I know it doesn't hurt to send it in but I would like to keep it simple and not send in way too much unnecessary stuff.
