Hi everyone. I know the USC has to earn above the 125% povertly line, which for a family of 2 is $17,500 annually. One question I have is do they just look at the income or the loans that they have also. My fiance has a student loan and a car loan. He earns above the poverty line but I am wondering if they would calculate the earnings he has and the loans. He does not own his house he rents.

Yes London does allow the beneficiary to use their funds but need to show how the funds will be transfered.For point 2, as YuAndDan said, it's the petitioner (US citizen, i.e. your fiancée) who should provide the support. I read somewhere on VJ documents that assets of the beneficiary (i.e. you) can help if they are readily "convertable to cash". in all cases, you should rely on either your fiancée as your sponsor, or someone she knowns, anyone i mean, in the u.s. ready to "co-sponsor".Best of luck man.

I know i have seen this somewhere on here but can't find it now. I was born in England and moved to Canada when I was 14. For my police report do I need to get one from England aswel or just from where I have lived since age 16 (which is always been in the same place in Canada)

On the i-129 form in section C it askes if you (the US citizen) has ever been convicted of 3 or more crimes related to a control substance or alcohol not in the same offence. My Fiance had a DUI in 2000 and then driving on a suspended license due to the DUI 6 months later. Does he need to answer yes to this question or no? I just don't want an RFE, but the way I read it is its only if you had 3 seperate convictions?

I thought that you only needed to supply evidence if you had been convicted of 3 or more offenses relating to drug or alcohol. If you just have 2 then you don'n't need to check yes on the I-129 form. Maybe I am wrong

Just wondering If and when my K1 visa gets approved and I move to the USA, can I apply for EI benefits? I heard somewhere that if you have been employeed for 52 weeks you can apply for EI benefits if you are moving to another country for marriage.

I read the K1 guidlines and all it says in there is that form I-134 has to be notarized, but yet I was just reading the recent posts and someone who is applying for the K1 said they had their letter of intent to marry notarized. I did not know you had to have this one notarized too. Anyone know what forms have to be notarized?

So today is one of those days.....we both seem so down and just want one another so badly....we talk daily on computer, over mics, through web cams etc.....somedays it just is not enough
We have not seen one another since May 2007. Gonna be over a year since we have seen one another by time he gets here....for those who read one of my intros around here we won't visit one another now until all is clear since well he spent 14 hours in a jail cell when he attempted to come here in December since they thought we were gonna try to ]
I feel for you. your situation makes me feel a little guilty. I see my baby usually every 2 or 3 weeks as i live in canada and lives in usa we are only an hour flight away. I was just there for easter and came back on monday but this week has been miserable for me its always so hard when you leave even though i know we will be together again in a few weeks. I hear your story and realize i really have nothing to complain about. GOOD LUCK

My Fiance had a DUI abot 4 1/2 years ago (idiot!!!, he was young I guess) In the state of massachusetts they have what they call a Continuance without findings which means you were not found guiltyand you can put on your job applications etc NO you were never convicted of a crime. Do you know if this will effect his entry into Canada when he comes and visits me. He came to MTL last year by land and they gave him no issue but this time he is flying. I am wondering if they would ever know, as long as he answers no to he hasn't been convicted of a criminal offence how would they as its not linked to your passport is it. I know Canada does see DUI as inadmissiable but as he was not convicted I am confused. Anyone Help. I posted this in the Russia forum by mistake, boy are they cranky over there!!!

My fiance had a DUI about 4 1/2 years ago he was not convicted it was a continuance without finding which in the state of massachusetts its not the same as a guilty plea the case is dismissed and sealed after you serve your probation and you can honestly answer NO on a job application etc to the question have you ever been convicted of a criminal offence. He came to Canada last year by land entered into MTL and had no problem. I am wondering will he have a problem flying? as he will have to use his passport?

Can anyone confirm if you can travel during the process your K1 is getting approved. My fiance lives in the US and I am in Canada. We want to get the process started but I saw someone where that I would not be able to go visit him during the process. Can he come visit me?

Hi Everyone Is it the criminal background of the USC or the fiancee they are concerned about. The I29f askes the quesion of the USC not the intended beneficiary. My fiancee has 2 charges one for DUI and the other for driving on a suspended license when he was 19. They ask for 3 or more so we are putting no but just wondering if that will creat and RFE, as I heard they do criminal bacground checks on the USC.
