    I am ready to post I130 for my mother and like to check with you to make sure everythinh is alright.

    I am going to submit the followings:

    1. A cover letter stating what documents are enclosed.

    2. Completed and signed I 130

    3. Photocopy of my naturalization certificate and US passport

    4. My Birth Certificate

    5. Application fee $355 payable to U.S. department of Homeland Security

    6. Post to (As I am living in California)

    I am preparing I130 for my mom and am confused with one question.My father died 20 years ago and my mother has not married again. What would be the answer to question 8 where it asks to write the date and place of present marriage when she is not presently married to anyone? What would be the answer to q-11 where it asks to write names of prior husband. Well, my father is not her prior husband as the marriage did not end?

    Would they (USCIS or NVC) ever gonna ask to submit my mother's marriage certificate?

    I am excited to share with you that my wife's interview has been scheduled on April 21. Now I am concerned about AP/AR. Is it true that every interviewee must go thru security check ? I saw some applicants got their visa in the same or next day and some applicants got AP/AR. what causes them to get AP/AR? Please share your knowledge/expereince. That would help me a lot. Thnaks

  4. Would anyone please explain why they( USCIS ) can't ask for what is needed once? Why ask for this and when they receive this and then they wan't that. I called today after recd. e mail overnight. Could not say for what this time have to wait for the letter to arrive. This system needs a complete overhaul. WHAT THE HELL.... I HAVE AN IDEA.............IDIOTS :help: !!!!!!! I wish ....

    I think they enjoy playing this game....

  5. Just wondering, obviously many of the forms require both signatures from you and your spouse. Are you guys mailing the actual docs to each other via snail mail or will a simple fax and sign work? Is that acceptable?

    My wife downloaded, printed and sent me the signed forms by fedex. Faxed or scanned sign would not be acceptable.

  6. I am confused - is one required to send these into the NVC prior to an interview being scheduled? Maybe I misunderstand, but I thought they are to be brought to the interview with the applicant?

    Yes you are required to send them to NVC, some consulates are not appointment posts - but San Jose is an 'Appointment' post, therefore your documents are submitted to NVC.

    NVC keeps changing rules and we are suffering, that's a pain. Another pain is people around me who are following this visa processing thinking me stupid, as if I was unable to follow NVC's instructions and keep receiving RFEs...................

  7. I am tired with the game that the NVC playing with me. First they told me to send DS230-I and passport photocopy, then they sent me a checklist for missing documents, which are birth certificate, marriage certificate and DS230-II. After responding that, while I was waiting for my case to be completed, they have prepared another checklist for missing document which is benificiary's photograph. As soon as I have heard that, I have overnighted it. Now wait another 2-4 weeks to learn some other documents are missing ! What those could be? My wife's bood, flesh, skin.....................

  8. What's going on with with NVC telephone line? Now I can't even here the updates from automated service. When I press 1 to hear english, spanish comes first, and then the english voice says"all operators are still busy now and you will transferred back to our automated system ' and the line cuts off :angry: . Anyone out there has similar experience?

    I am ready to send some missing docs(originals) to NVC in response to a RFE. My question is, should I put my case number on the original docs?

    You should follow the instructions on the RFE exactly, which include enclosing a copy of the RFE itself with anything you return. Unless these are US government forms that bear your original signature or that of your spouse, you wouldn't normally send originals. What documents were requested?

    Thanks for your reply. They asked my wife's original BC and MC. If I put case number on these originals, what will happen if I need to use them for any other purposes?

    Yes, that would be the usual time range. Did you get an RFE? If yes, what is about? Also what did you find out from US Embassy regarding to submit DS 230 packet (submit both parts) along with birth certificate, marriage certificate to NV or not?

    Embassy just avoided my question and asked my to contact NVC as my case was with NVC. I talked to 4 different reps at NVC and they all confirmed that I did not have to send DS230-II and other docs, so I did not send them.Now NVC mailed me a checklist for those missing doc. The rule has been changes as of Jan 01, 2008. When I asked why they did not tell me before when I called them about this issue, her innocent answer was "we did not know"....WOW!!

    Gosh, it is frustrating. So now they are asking you to send DS 230 part II, her birth certificate, your marriage certificate, etc? Just send them away. Hang in there for little longer. I would email NVC and explain them that now your case is being prolonged for their fault.

    If the NVC can complete my case by end of this month, can I expect the interview in 2nd week of March?

    My wife received packet 3 for K3 visa and at the same time we are waiting for our IR-1 case to be completed at NVC. Obviously we want to pursue IR-1. If my wife responds to the K3, she might get an interview date at end of this month, meanwhile, IR-1 case can be completed. Question is, can we then request to Embassy to reserve the K3 interview date for IR-1?

    Please advise....

My husband worries a little about the income requirement for the affidavit of support form because his income for the past two years is very low because he was not working the whole year for the past two years because of health reasons. But the year 2007, his annual income is fine. Does his income for the past two years affect? Do we need to get a co sponsor just because of a low income in the past two years? Thanks a lot.

    Don't worry about the income of past years. The income of present year does matter. So you would be fine.

  14. I received an I-797C notice of action. It stated that to process my application, uscis must capture my biometrics. I'm instructed to go to the local Fort Smith, AR office and bring this form and proof of identification. Has anyone else ever got one of these notices or know what it's about ;) ?

    Did you enclose G325A forms when you filed I130?

  15. Toward the end of the G325-A Form, there is a question asking

    "The form is submitted in connection with an application for:"

    and they give you 3 options -

    1 - Naturalization

    2- Other (specify)

    3- Status as Permanent Resident

    This paper is for my wife. I marrierd her in Japan and we choose to do the

    CR1 visa so she would be a permanint resident. With that said,

    ...would I put

    "Other" and write I-130 Form

    Or

    do I put "Status as a Permanent Resident"?

    Since you are filing for CR-1 visa, you are applying for permanent resident status.

    I think either will work but technically, filing an I-485 is "applying for permanent resident status". In the OP's case, the G325a is not submitted in connection with an "application". It is submitted in connection with an I-130 petition intended to grant a beneficiary the right to apply for a visa. Once the visa is applied for and secured, permanent status will be granted upon entry.

    Other and I-130 is the technically correct answer when a visa is involved but either WILL get the job done.

    I also noticed that the Mumbai embassy has changed from Standard processing to Appointment NVC processsing after a VJ friend asked me what docs to submit with the DS-230.

    I guess same must be for Bangladesh. I think you should rely on the website.

    One more thing you have to send the originals OR certified notarised copies.This for sure for the Mumbai Embassy. I would advice you dont send anythin in original. Its better to send notarised photocopies of the originals Even if they need only the page of passport copy in their processing at NVC office they will throw all the notarise copy of docs you have sent ..... which wont do you any harm as you still have the ORIGINALS with you.

    BUT

    If you just send the page of passport and then you get an RFE to send the rest of the docs... your process willl be more delayed. So its better you do what the Website says rather than listening to the operator. Thats what I feel. Another reminder... send the notarised photocopies and not the originals.

    By "Certified copy of documents" I understand it's a replacement of an original when original is unavailable and the certified copy has to be from an appropriate authority (the issueing entity). It's not a photocopy of orginal and attested by a notary. Say for instance, my parents did not obtain my birth certificate when I was born, but I have obtained it from my city corporation now. So it's a certified copy of my birth certificate. NVC wants original or certified copy from appropriate authority, not a notarized photocopy.
