  1. Hi all,

    2 days after I call them, I just got an update email from USCIS saying "On December 16, 2010, we mailed a notice requesting additional evidence or information in this case N400 APPLICATION FOR NATURALIZATION....."

    Does this mean my biometric letter is coming?

    If yes, with this appointment letter, can i just show up at local office for walk-in biometric or I have to wait until the appointment day? anyone with experience in walk-in biometric please advise me.

    My NOA is 11/02, now it's 12/14 already and I still not receive my biometric appointment yet.

    I called the customer service, and they said they will make a request to the USCIS about my case and I need to wait for 30 days more, if still nothing, then call them back.

    What should i do now?

    I've heard about walk-in biometric without appointment letter. How does it work? please advise. Should I get an infopass or what?

    I got my NOA on 11/4/2010.

    It's been 6 weeks now and I still not received my biometric letter yet. Is this normal?

    Should I call them or just wait a little bit more? how about infopass? I've heard some person that didn't even receive a NOA, he got biometric done with infopass at local office. Is this really possible?

  4. Reading Jim's reply, I wonder if I have totally missed something here, and it's possible, as I'm not feeling well lately.

    Was that you, anh, who at another post asked how you could get a copy of your I-751 or was that somebody else?

    At this point, I venture to say that since you are a Green Card holder for 5 years now and have a 10-year Green Card for 3 years, I do not feel that the I.O. will have a closer look at your I-751. Your petition was approved 3 years ago and at this point of your journey the marriage is of no concern anymore.

    Of course, Jim is very thorough, so I have to have a second look.

    I'm trying to collect as much document as I can to explain my marriage at that time, but not much of which I can get :( 5 years already All I can get now is some wedding pictures, joint tax, bank statement, divorce decreee. That's it.

    would getting an immigration attorney help?

  5. Perhaps D was selected in part 2 of the application.

    "I entered into the marriage in good faith but the marriage was terminated through divorce/annulment."

    That wouldn't be quite correct as at that time the marriage was not terminated.

    But checking A wouldn't be correct either as the marriage was in the process of being ended.

    "My conditional residence is based on my marriage to a U.S. citizen or permanent resident,and we are filing this petition together."

    Normally in a situation like this, best to write in, "See Attached Sheet" then explain your situation.

    Regarding making any kind of a judgment, way over my head, see an immigration attorney. And always good to make complete copies of everything you sent in.

    Now you know why I'm confused and worried.

    So, how you think? is my problem serious? I'm going to see an attorney.

  6. If she didn't file the I-751 jointly then she would have to wait until she's been a PR for 5 yrs and meets the other criteria to file N-400. To the OP: you say you "MAY NEED".....Why do feel you need the I-751? Do you have any divorce documentation? USCIS most likely will have the orginial I-751 and supporting documenation in your file. I would assume they approved your removal of conditions since you applied for naturalizaiton and have had a valid green card ever since your conditional one expired.

    forgot to tell you that, I do have my divorce decree, but didn't file it with my I 751 because by the time to apply for I 751, my divorce was not finalized yet (it took 6 months) although the separation started 3 months prior to the day I applied for I 751.

    So, timeline is:

    - 7/ 2007: filed for divorce, separation started

    - 10/2007: filed for I 751, not jointly

    - 1/10/2008: I 751 approval, no interview

    - 1/26/2008: divorce is finalized

    I said "I may need..." because I just want to prove USCIS that I didn't file the I 751 jointly by the time we were separate, but maybe there's no need to prove this since you said USCIS should have the original I 751 in my file already,

    And yes, they did approve my 10yr GC without interview.

  8. You filed for ROC singularly, with a waiver, which is the correct way to do this.

    Now you waited for the 5-year mark.

    You did everything by the book and don't have anything to worry about.

    Yes, Bob. But the question is how to prove to them that I didn't file my I 751 jointly. or they should be able to know that when processing my case? As I said, they approved my 10yr GC without interview before my divorce official finalized, and never asked me a divorce decree.

  9. Rabbit's question is valid. Your waiver request cannot be legally accepted until your divorce is final. According to the timeline you provided, you started the divorce the month after you received your 10 year green card.

    I would be very worried about this. Not only was your divorce not final when you submitted your I-751 with the waiver request, you hadn't even started the divorce process yet. I don't know how you managed to get away with this. Either you lied when you submitted the I-751 (which is probably true, since you claimed the marriage had been terminated), or USCIS severely screwed up when they approved it. If USCIS determines you lied then it would definitely be a material misrepresentation, since you weren't eligible to have the I-751 approved yet. Not only could they deny your application for citizenship, they could revoke your green card and deport you.

    If your timeline is not correct, or there's something you've not told us about this, please clarify this. Otherwise, you should talk with an immigration lawyer. This is serious.

    I did start the divorce before I filed I751 singly (it was on July25 2007), but it took 6 months for the divorce to be finalized (Jan 26 2008) --> I didn't lie anything.

  10. Are you asking about the form itself or the NOA? The NOA holds much more value in it since it is an official document generated from USCIS. I would schedule an infopass and try and see if you can get copies of items you need. Did you get extension stamps in your passport? Those would help too.

    I'm asking about the form inself, because what I need to prove here is that I filed I751 under "the marriage entered into goodfaith but terminated with divorce...", not filed jointly.

    can you be more specific with infopass steps?

  11. All depends, if you entered the marriage in good faith, not a problem, but if the USCIS can prove fraud, then there is. I-751 has provisions for marriages that were entered into in good faith but didn't work out.

    Yes, Nick. That's why I applied for I751 myself, not jointly, under this option "marriages were entered into good faith but terminated through divorce"

    I think I will need to get a copy of my I751 showing that I didn't apply jointly, but too bad, I don't have it. Anybody knows how to get a copy of I751? can we ask any department/office for that? or USCIS should already have that in there system already?

  12. You are filing based on the 5 year rule so marital status should be a non factor. They may ask about it but it shouldn't be a determining factor unless the ex filed some claim

    It's just that somebody told me they may get suspicious about that if the marriage which granted me a GC is real, and this may lead to the worst - they get my GC back and deport me. This sounds so scary.

    In my opinion, if they didn't trust me by the time i applied for I 751, they wouldn't have granted me a 10yr GC, right? So, they did trust me then, now for N400, there's no need for them to back track and scrutinize my marriage one more time. That's just my thought. Please let me know if I'm right or not.

    I'm about to apply for N400 based on the 5 year requirement. Here's my timeline:

    6/2005: got married

    1/10/2006: got 2-yr GC

    7/25/2007: separation

    10/2007: I ,myself, filed I 751 under "entered the marriage in goodfaith, but the marriage was terminated through divorce/annulment"

    12/2007: got 10-yr GC (without interview)

    1/26/2008: divorce started

    ------

    now, my GC is reaching the 5-year requirement. My question is the fact that my separation happened before I singly filed my I751 will affect my N400 application or not? will this provoke any suspicion during the N400 proccess? Do i need to prepare any document relating the marriage?

    Please, i need your advice

    I already filed my joinly I751 and my biometric appointment will be in 10 days (11/14/2007). All fee was paid ofcourse.

    Since my divorce will be finalized by the end of January, I'll refile I751 (waiver ) do i need to pay for the second time the fee? Do I need to get the biometric done again??? I would already have all of these things done by that time.

    and also, is it possible that I'll get approval for my joint I751 qhich was filed on Octover 2007 before my divorce will be finalized in January? If this happens, what should i do?

    I really realle need your advices...

    I filed I751 with my husband already while waiting for my divorce to be finalized. I'm also got biometric done. So, when I reaply I751 with a waiver and with a divorce decree to amend my original I751 which was filed in Oct 2007, do I need to have biometric done one more time??? do they totally restart my I751 all over again or do they just update my case with a divorce situation?

    Plese help me.

    This is very important since I need to go out of the US next year, I just want to make sure what I have to do before I go.

    My case is similar like yours.

    We filed divorce on July 2007(this will take at least 6 month to be finalized), and we filed a joint I751 in Sep (90 days prior to my card expiration).

    I wll have my biometric appointment on 11/04/2007.

    I assume that my divorce will be done by next Jan 2008, at that time is it correct that I will need to file a new I751 with a waiver separately?

    I also want to know do i need to redo my biometric one more time? because apparently, at that time, i already got my biometric done on 11/04/2007 (this comes with a joint I751 we filed on July 2007). And also, do I need to pay for the fee one more time?

    Does it mean that when you refile your I751 separately after divorce, everything will start all over again, including fee, biometric, etc.?

    I'm in LA. So i guess that will be CSC taking care of my case.

    Please help me with these questions. I appreciate that alot

  18. Hi all

    We filed divorced on July, before the ending of two conditional year of my GC.

    Then, we still filed a joint 751 on Oct because our divorce case has not been finalized yet. It means that we are not legally divorced yet, so i'm still married (or legally separate) and we still have to file it jointly. This is what I was advised that you can not file the I751 by yoursefl if your divorce is not finalized.

    My question is what will happen next?? Is it right that I willl have to refile my I751 on my own (not jointly with my husband) after my divorce will be finalized in January 2008? in that case, how to refile?

    and if I refile, does it mean that my case of removing the condition will be restarted all over again? any idea how long will it take?
