"You were engaged to a USC and were planning to get married tomorrow no files or petitions were found on your behalf." That's the problem.
I had very similar situation that the POE officer alleged my girl friend had intention to stay in US and got 5 years ban. She never entered US before. I think you need to file K1 and after interview with embassy, they'll tell her to file I-601. It's going to be a long process. Good luck!

I'm a USC. My girl friend and I visited US together in late Oct. 2007. She got a removal due to the immigration officer alleged her intention is to remain in US with a B1/2 visitor's Visa. That's a 5 years ban under sections 212 (a)(6)©(i), 212(a)(7)(i). We took the next flight back to HK at our own expense (return ticket). Then, we got married later that year and I filed I-130 for her. Now, the US consulate interview is scheduled for May, 2009. Do I need I-601 or I-212 ready before the interview? I don't want any more delay if the consulate ask for it. It tooks a year and half to get to this point.

I thought I broke the record with 344 days to receive NOA2 since the I-130 mailed. Anyway, I got approval notice today from email.

8/14/2008 Case tranferred from VSC to CSC

Did anyone else file their I-130 in November and is going through Consular Processing? Let's compare notes and keep track. I am still waiting for NOA2. Anyone else still waiting?
I filed I-130 on Dec 12, 2007. and still waiting for NOA2.
Check visajourney's processing time for CR1/CR2, it indicates March 1, 2008 hass been processed for VSC. Why I haven't heard anything yet?

The immigration officers in Minneapols have very bad attitude. They treat us like we are criminals. They claim my fiancee is lying because she carried too much clothes, personal belongings. She was travelling with me but in deed, we didn't plan to get married on this trip. Now, it seem to get married and apply for I-130 then K3 is the only solution for her to come.

My fiance traveled with me to USA with B1/B2 Visa. However, the INS deport her back before entering US at airport and barred for 5 years under INA 212(a)(9) due to she has intention of staying in US. Can I still apply K1 Visa for her to come? Are there other actions that I need to take? I know I can file K3 Visa for her, but we want to get married in US with my family member present. Please advice.

Sidp69: Long story. I filed I-601and I-212 myself but got denied because of lacking of "extreme hardship". You need a third person in US licensed to prove that you are "extreme hardship". For example "Psychological evaluation". If you get denied, don't try to appeal the case in court rather than file I-601 and I-212 again. It saves you time to do so. The immigration attorney in US don't even know that. I had to tell the attorney to withdraw from the appeal court which took additional 2 months delay. I spend almost $3000 for immigration attorney, and $750 for Psychologist. The I-601 finally approved in October, 2010. Good luck! We suffered 2+ years for this stupid mistakes.
