  1. To all who responded. If you carefully check the time lines of K-1's virtually all those who had their cases transferred were approved without an interview

    at their local office. I also have a friend who is an Imm. Attorney and he told me that if you provide "plenty of evidence" that you are factually married

    and are living together there should be no problem. If there is any suspicion of fraud in your paper work on the I-485, you will get an RFI and probably

    need an interview. (an RFI triggers an interview regardless of the outcome of the RFI)

    He also told me that because of the massive case load it is virtually impossible to interview all applicants.

    My belief is how close you are to the nears field office.

    On the Island of Oahu, EVERYONE goes. Not sure of outer island, maybe not. they can chime in.

  2. I've noticed that those KI applying for AOS who have had their cases transferred do not generally have to have an interview before their Green Card is

    approved. Is this the general rule and if so why? If there is sufficient proof submitted then does the file get transferred and then a decision is made my

    the office where the file was transferred. Our file was transferred to Calif. and we live in Virginia. We just received the EAD card.

  3. My wife and I received the NOA 1 on our I-485, I-765 and I-131 on 9-23-09 . All were filed at Chicago Office. Our receipt number begins with

    MSC which I learned stands for Misouri Service Center. We have registered online with USCIS and when entering our Receipt number to add our

    case to portfolio we get a "not entered correctly and number does not exist".

    How long does it take for the number to be accessed on the web site or is this just another Government SNAFU.

    We have called the 1-800-375-5283 and have never been able to talk to anyone live. (no surprise to me)

    This happening to you as well?

    Hello, my friends here in VJ, i just wanna spread the good news about my visa interview, I was interviewed 05-20-09, and luckily i got the PINK slip!! :dance::dance::dance::dance::dance::dance:

    The CO ask me a few questions like my name and my petioners name, where he work, where he lives.. Then he ask when is our wedding anniversary I said MAY 17, 2007, he said HAPPY ANNiVERSARY which brought happiness in my heart so i laugh so loud (he's laughing at the same time), and i said thank you,.. Then, he said you are cute couplez upon looking at our wedding pix..

    He finally said "Dont forget to bring him pasalubong(presents), because your visa has been APPROVED, good luck and have a happy life in AMERICA"

    The CO who interviewed me was so cool, seems i was just talking to a friend, we keep on laughing all the time. Am so happy, very happy, i will be seing my husband so soon, and no distance can break us apart..

    I thank God for sending me an angel during my inetrview.. :yes::yes:

  5. Nice going!!! My Fiancee got her VISA yesterday and will be here in the States on June 19th. I plan on posting the interview results soon. Please

    My wife passed the interview today. We pick up the visa on saturday and now can begin to live our dream. Sasha, I am still here for your and I did meet JB here on Monday.   6. Hi. She just returned to Chongqing and I have updated our timeline. She is very tired and went to GUAZ with her mother. I was unable to go because of

    pressing business commitments in the States although I had visited her 3 times in China. I will soon post all the details in the interview section but

    basically because all of our documents were in good order they just asked the oblgatory simple questions, I believe 5 or 6. Lasted about 3 minutes. She had

    the young American VO.

    Once she received the visa 2 days later she went back to the Hospital and got 3 shots. She will be arriving in the states on June 19th.

    Right now I am so happy and soooo relieved that this is finally over. (until of course the AOS)

    Keep you eye on the Consulate section for the interview details.

    Just remember what I indicated earliar. Have your act together with plenty of documentation, be polite, confident and think PINK. The rest will

    fall into place.

  7. My fiancee had her interview in GUAZ. China today and passed. I cannot stress to all on this site the importance of spending a lot of time preparing

    all the proper documentation for the I-134, proof of residency and proof of relationship. I spent countless hours providing originals, copies for submission

    and one extra copy. My Fiancee brought all the docs with her to the inverview including 30 pictures of us together and some with myself, her and her parents.

    I used and presented a table of contents which did not include my first trip to China in June of 2008, but that documentaion was provided for the I-129F. My fiancee brought the original documentation for all the docs submitted for the I-129F.

    When she presented all the docs, neatly layed out with an easy to follow table of contents and with more than enough documentation, it was a slam dunk for

    us. We of course practiced question and answers and she was well prepared. She got her hair and nails done the day before, put on a very nice dress,

    was polite and spoke English. She was asked 5 simple questions and will pick up her visa on Friday.

    If you've come this far be very, very prepared and the Pink will come. Good Luck To All on this exciting journey. (Now I can't sleep)

  8. A good friend of mine is an Immigration Attorney. His suggestions:

    1.) Save your money for a good Immig. Lawyer. You have broken the law and could be deported after an Immigration hearing.

    2.) Get all your personal things in order because once ICE finds out and they know where you live you might be arrested soon

    and be in jail until your hearing. (might be 6-12 months with the way things are now-moving- very slowly) If arrested you will be

    considered "a flight" as in likely that if you are released from jail you will be difficult to find later. You may be held in jail without

    bail. If the judge decides to allow bail, it will be very high. You will not likely be able to come up with the bail money.

    3.) Kick yourself every day for doing what most Imm. Attorneys see as the most stupid thing you could have done; not viewed

    well in the eyes of the law.

    Read the following:

    Section 212(a)(9)(B)(ii) of the Immigration and Nationality Act (INA) defines “unlawful presence” as follows:

    [A]n alien is deemed to be unlawfully present in the United States if the alien is present in the United States after the expiration of the period of stay authorized by the Attorney General or is present in the United States without being admitted or paroled.

    Further Section 212(a)(9)(B)(i) imposes two types of bars for people who overstay without a valid permission. If the overstay is for a period of 180 days or more the person who overstays is then precluded from re-entering USA for a period of 3 years from the date he leaves USA. If a person has overstayed without valid permission for more than a year then after he leaves USA he cannot re-enter USA on any category of visa for a period of 10 years.

    I know some of you will start judging me right away but pls don't, i'm in need of help right now so i don't really want ppl telling me that i haven't made the wisest decisions in the past. I already know that and I would really appreciate it if I can get some answers :yes:

    I came to the US approx. 6 years ago, i entered the country as a tourist and decided to overstay (i got 6 months to stay).

    I don't want to type a huuuuge thing so i'm just going to say i went through a lot of stuff and decided to start working ilegally (using fake documents). <-- I know that was very stupid.

    A few years ago i met my husband (we just got married last month) and now we're trying to adjust my status so i can become a resident.

    I'm not currently working (i quit last year when my husband (back then boyfriend) and i decided to move in together and i had to move far away from where i was working at that moment).

    Back when i was working, Even though I was doing it ilegally, I always did my taxes, every single year (I got an ITIN number form the IRS).

    My husband and I are currently working on the whole package to send to immigration and I don't know what to do regarding the question about employment history on form G-325A.

    I don't want to lie but I'm scared. And sadly we can't afford an immigration lawyer since their rates are extremely high; we decided to take care of the whole thing by ourselves and luckily i found this great site.

    I asked a person that works with immigration lawyers (she's like an assistant or secretary) and she told me I shouldn't tell them I've been working ilegally because they could deport me and that it doesn't matter that I'm the wife of an US citizen.

    She claims that's what the lawyers she works for always tell their clients.

    I told her that i don't want to lie, what if they find out (they could check with the IRS and see I've been doing my taxes, right?) and I'm not able to adjust my status?

    Basically I'd like to know if any of you have gone through this and what did you guys do? What's going to happen when i send my G-325A with my ilegal employment history? Should i also send my taxes transcripts? How do i attach them? or should i wait and see if they ask me to take them to the interview?

    I'm really lost because I don't know if I should lie about working ilegally or just give them my employment history and expect to be forgiven for being the wife of a US citizen.

    Any pointers?

    Greetings all!

    I know how much I love to read the joyful stories of others who have been approved and I would like to post ours as well.

    Monday was our day, 2 pm at the San Jose, Ca center. We showed up about 50 minutes early and I had packed a bunch of snacks into my wifes purse before we left the house. She kept asking if we were going to have a picnic! Since we were early I immediatly dove into my wifes purse to start eating the fruit snacks and Quaker Peanut Butter snacks. (Yes, I like to eat when I'm nervous).

    After washing that down with a bottle of water we headed inside. The security guard let us in and we headed upstairs. Imagine our surprise when arriving into the waiting area (it was large - maybe 70 feet by 30?) and finding only 1 other couple there! I thought the place would be mobbed! What gives?

    After dropping our interview letter in the box and sitting down, the girl who was waiting ahead of us immediatly got up, walked over to the box, pulled out her sheet from below ours and put hers on top! I was like !? I didn't care, but I couldn't understand why she would do this - especially since its by appointment! About 2:25 a person came in and took the couple in front of us.

    Nervously we watched the time tick by, 4 staff members wandered in and out of the room -none for us. Finally 2:12 a very kind Gentleman walked in and asked for us to follow him (we could tell he was a Sr. Officer).

    Sitting down in the office he swore us in, then he proceeded to tell us that we looked like an honest couple and told us there would be no funny business from his side. He proceeded to ask my wife when we met, how old she was, how long shes been here. He asked her general questions about being a terrorist or being arrested.

    He then asked us very basic questions, and wanted to see our drivers license and my passport. He never asked for any pictures, or previous taxes (I had tax returns AND transcripts), or anything else. Boy was I surprised, we had brought 2 large bags full of all kinds of evidence, and he didn't ask for a single bit of it. Oh well.

    The entire time he was stamping, scribbling things on our forms, typing on the computer, and near the end he said (about 35 min later). Well, you guys are all approved! as of now you are a permanent resident. I will take your work cards and all you have to do is wait for your green card! Congratulations!

    Woo-hooo! What a blessing! After a scary miss-hap (we being scheduled in Chicago when we lived in Ca, and then getting denied for not showing up even after we had a letter from the director in INS approving our request to move it). So instead of finishing in Nov, we are completed in April. Now we just have to wait for the GC to show up.

    yay! So you guys still waiting, don't give up! Hang in there and you will soon be smiling with your GC in hand!

  10. Thanks, I have all the same info you suggested and am well above the poverty level. If you look at instructions on the Letter to K1/K2 Letter

    it states it is optional. Seems logical that she takes it with her. Just one of many conflicting statements included in the mass of Govt. paper.

    I belong to Candle but also find their site to be extremely difficult to navigate and really appreciate your thread below.

    There are also many conflicting statements about how many Passport sized photos. Medical, interveiw, etc. To be safe she is bring 6.

    Must she also have all of her shots before she leaves China? I understand it is usually just 2 or 3.

    LETTER TO K1/K2 APPLICANTS

    Submit these items during your interview:

    ● Evidence of support. Although optional, we recommend you submit form I-134, and a copy of the petitioner’s most recent tax return, and proof of current employment.

    US Citizen petitioner fills this out and attaches financial efidence to it, and profides it to the benificiary for the interview.

    For GUZ it is best to do this just after getting packet 3.

    The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

    In our case this what the I-134 included.

    • I-134.

    • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS

    • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

    • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

    • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
    My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property

    I will highly recommend that you join and study the interview FAQ on "A Candle For Love" That pord is specific to that consulate.

  11. Sorry about this everyone. Every time I search the forum I get an error message. I also cannot change the fonts here. Also, every time

    i post something it gets "bounced" to some other section and I can never find that "section". This site is more frustrating than all the

    Govt red tape.

    My fiancee has an interview om 5-20 and has received both padkets 3 and 4. There seems to be conflicting info on the I-134.

    So, when/where does the I-134 get filed? Mine will be complete for her to bring with her but where or how does it actually get

    filed. Dows she also need one? I am her petitioner and she has no visible means of support.

    This is my first post sp I hope this is the correct location. I received letter from NVC on 3/17/09 informing me that my petition would be forwarded to GZ. THEN I learn there is a 4 to 6 month delay in GZ. I had not seen that information before so I was sad to learn of this delay.

    Is the delay taking 4 to 6 months?

    Who else is waiting for mail processing and how long have you been waiting?

    Can/should this be added to the timeline information? It is probably there and I missed it.

    NOA1 was received at the Vermont Service Center 9/15/08.

    Last updated 9/18/08

    Have NOT had any touches since.

    I called USCIS and they were not able to provide much clarity or specifics on when I will receive my NOA2.

    Anyone else in a similar situation in regards to the filing dates?

    Any estimates on when I may hear back with the NOA2?

    I've waited a little over 3 months, I'm just worried that USCIS will request a RFE...and that will push back the processing time even more...

    If the USCIS does request a RFE approx how long will this delay the processing time? What sort of RFE do they usually request for?

    After browsing a handful of posts, I've come across people with very fast turnaround times for the NOA2 to very slow ones.

    Any thoughts, feedback, and responses?

    Hurry up and wait. Surely you are kidding? Look in the advanced time line and set for China and VSC.

    Average time is running about 4-5 months. However if your interview is in Guanzhou, expect to wait another 4-5 months before you get called for the interview assuming all your "packets" are in order. It's a very long journey, so be patient. Expect to wait a long, long time in China for the interview. Get your feet better grounded in reality. Hurry up and wait. Good luck. Our Noa 1 date is 8-20-08 so we are also waiting.

Yesterday was almost a a tragic day for us, My husband is terribly depressed about the whole thing, We were expecting last week & this week of our NOA2 after we responded the RFE , but it was so frustrating, still no email from CRIS-Vermont until now, looking at the thread of some members here they got approval after 10 to 15 days, thats why my husband was expecting the same. We both feel the same way now we are sooooo pathetic waiting and waiting ,don't know now how much longer we gonna wait for more, we don't know what will happen to us now. Yesterday morning, my husband was crying out loud when i talked to him in the internet, At this point in time he's very deeply affected of the situation, he was sitting there, saw him hysterical, his mom, trying to comfort him, he shouted all his anger & frustrations. He keep on crying suddenly told me better to ''kill himself'' and speaking words he ''don't want to live anymore '' my life is useless without you sweetheart'' why it so hard to live with my wife'' why don't they approve us yet, why those people (Vermont) screwing us they don't care our feeling,,they want us to separate'', I was crying & screaming trying to stop him, i comforted him & I did my best to calm down, I talk to him with Love & affection ,just to cool his anger,.. Oh, i really pity him, i know what he feels now, I keep telling him that no one can help us except to have more patience & might as well ignore the petition in the meantime, & he answered, I been so patient for the last 300+ days & its over.

    Things are so complicated, Our relation being husband & wife is so much important to him more than anything else in this world, he want us to be together, last Aug/Sept when were not yet approve he wanted to come & live with me here but i just stop his plan & told him to just wait until we get approve. Now he want to pursue it by early Jan. 2009 he will come, don't know yet if he will return to the States or not, but sure he will lost his job, & losing his job might be an issue in the Consulate interview, am afraid it may jeopardize granting me a visa. Don't know now what to do. We are in the verge or uncertainties.

  17. After nearly 2 years of nonsense tomorrow we finally go for our interview, although we only found out about it last week :unsure:

    To make things worse our lawyer just called to say we have been unfortunate and have the worst Immigration officer in Los Angeles, apparently the Lawyers call this woman 'The Dragon' now I am worried, although I have everything together for the interview...

    Wish us luck, again thanks to EVERYONE who has helped me with silly questions over the past 2 years :thumbs:

  18. Hey everyone! Yesterday I checked on my USCIS account to see if there'd been any touches and sure enough, it had been 'touched' (date changed to yesterday's date)! That was yesterday and I hadn't checked for a week or two so I was pretty psyched...I checked again today and it was updated again with a STATUS update that said on October 15 my approval had been sent for the Fiance Petition! (no email notification as I requested on the account, so looks like they don't keep up on that part but as of right now, i don't even care!) Woo-hoo! After 125 days....pretty good for California right? Ok, onward through the rest of the process and good luck to everyone else...
