  1. You are lucky to be going through Frankfurt. As long as your HSL and supporting evidence was well put together, you have very high chance of approval and the best part is that Frankfurt has historically been one of the quickest to respond on waivers. I haven't seen one on the boards in a while but they have averaged 4-6 weeks turn around in the past.

    Thank you blueblue. I have heard many good things about Frankfurt and the approval rate is very high. We did have some really good heartships and it was put together very well. I also saw that the average was right around 5 weeks. They told me 60-90 days. I had to deal with the consulat in Frankfurt before because of our sons citizenship. They told me back then 3-4 weeks for the passport etc and it was at the house in 11/2 weeks. They were really nice there.

  2. I had my interview on Feb 22nd in Frankfurt Germany. It went very smooth and a few questions were asked, but I have to tell the staff at the consulat was very nice and friendly.

    I had to file a 601 waiver for overstay. Filed it on the same day. Does anybody have a timeline for the Frankfurt consulat on waivers???

    I am trying to find out how long it will take. I was told 60-90 days before, but the staff at the consulat didnt tell me a timeline at all.

Our laywer just finished our waiver package and my husband is bringing it next week. He is coming to visit with our daughter.

    Have you been given a time line as to how long it will take for your waiver to be processed? I do hope you all have a wonderful time together, I know how awful being apart can be.

    The amount I gave you shouldn't change so much that it would be bothersome to you. As for a tip all I will say is don't concentrate on the waiver, keep your thoughts on your relationship and family and keep strong. The waiver process is a very strong energy sucker and needs to be kept in check.

    We took a 5 month break after the interview, it was disheartening and I needed the time to get the anger out of my system and collect my thoughts so the waiver process was done correctly and we also had Sharon's fathers hospitalization and subsequent passing to deal with.

    I have a criminal conviction dating back to 1976, nothing serious but still a conviction, which may have passed had the interviewer not noted in my file that she could smell alcohol on my breath and thought I was drinking before the meeting, which I beleive was the kicker. Not to bad all in all, 1 conviction in 63 years and sober for the past 23 years. According to the consulate 5 months ago I have 12 to 18 month wait after the papers are submitted for the ajudication to be done in Vermont, I hope it is much less by now.

    I am so very sorry to hear about your case. This process is very heartbreaking and I cant imagine what you guys must have been through.

    I knew from the beginning starting the CR1 process that we had to file a 601 waiver because of my overstay. I was a student in the US on a student visa and then was married in 1995 to my first husband and he never ever filed a petition in my behalf. I travelled back and forth from US to Germany numerous times and never had an issue. Was divorced from my first husband and now I am remarried and we have 2 children.

    Our daughter is 31/2 and in the US with my husband because when I came to germany I found out I was pregnant and had to be on bedrest because of the stress. That was no way of living for a toddler. She went home with my husband and I havent seen both in 8 months. I miss them sooooooo much. I gave birth to our son 3 months ago and my husband has not met his son. Now he will.....

    My husband during this time also lost his father to prostate cancer 3 weeks ago....his grandfather passed on the day our son was born. Its been a hard hard year.

    Frankfurt suppose to be excellent with the waivers. Very fair and fast. They did expedite our case because of my father in laws illness, but too late now. But the consulate has been a pleasure to work with so far.

    They told me 60-90 days for the waiver, but people I talked to that filed in Frankfurt averaged 5 weeks.

    I wish you guys the best. this is the hardest thing anybody has to go through. I just hope that soon your journey has an end. Be positve. I know it is very hard.

  6. Our laywer just emailed us yesterday, stating that even after our case was complete at NVC they needed more papers from me (immigrant). NVC wanted my police report from Germany, German birthcertificate, marriage license and my divorce papers from my first marriage.

    Our lawyer told us that NVC requests now the Package 3 and then makes the interview appointment at the consulat in Frankfurt and from them we just get the package 4.

    It should go faster then. Just wanted to give heads up...I am not sure if that is now the procedure for every consulat, but just in case get all your documents ready if NVC should already ask for it.

    Good luck...I think this way the interview should go faster our lawyer said, because the consulat will not sent out a package 3 anymore just the package 4 with the interview date and medical exam, which you can already do 1 year in advance.

    Additional derivatives: During the petitioning process, a principal applicant may have to add names of newborns or adopted children as derivative beneficiaries of a petition. To register the new derivative family member(s), NVC or the Embassy must be advised of the addition(s). The proper documents establishing births or adoptions should be submitted to NVC or the Embassy. The Affidavit of Support should cover the additional derivatives.     I was in your situation and just gave birth to our son 9 weeks ago here in Germany while I am going through the visa process. My husband did not have to be here in Germany when I received our sons american passport and filed for a birth certificate abroad. Maybe it is different by country. Ours was very easy. Had to bring german birthcertificate...proof of my husbands us citizenship (certified birthcertificate) ..he had to fill out 2 forms that the consulat sent to him in the us and had to sign and fill them out there in front of a notary public and i took them to the consulat with proof that he has lived in the us more than 5 years since the age of 18 ....and my info...got our sons passport in the mail 2 weeks later...now we are just waiting for my visa...but we are almost there...

    the birthcertificate aboad and american citizenship for our son was a very easy process

    call the consulat in the philipines and ask what you need...it was better for me to talk to them personally...they told me on the phone he did not have to present in germany...on the website it said he had to

  8. Ohh and sorry. Yes you are right there is a different way that you have to do it when the USC is in the military. I received a papers explaining both ways. If the USC is military or civilian. If he is in the military it is even easier because you dont have to show all the proof ...just some documents from the Military. She should be able to do it without her husband being present. Like I said with us it was no issue with my husband not being here in Germany at the consulat.

    Ohh and Dylan's wife. I saw your journey and timeline. HOpe your daughter is ok and you received your interview date. Its horrible when children are involved and especially if they are sick. good luck

    Normally, the USC needs to appear before the Consulate to claim citizenship for the child. With the USC father being in the Military and currently deployed is there a different protocol?

    no my husband is in the us and he didnt have to show up at the consulst. they sent him 2 papers to fill out in front of a notary public in the US, given me permission to get our sons passprt etc. and he had to prove his citizenship by providing me with a certified copy of his birthcertificate and US passport. he also had to prove he lived in the US more than 5 years since the age of 18. tax returns or college transcripts and letter from his company how long he has worked there. i went to the consulat with our son with all the papers. no problem he was not present.

    Yes he can. I have a 9 week old son and he received his american birth certificate ABROAD and US Passport when he was 4 weeks old. You have to have a lot of paperwork ...call your consulat and they tell you what you have to bring. Once you bring all the paperwork to the appointment WITH YOUR CHILD to the consulat it took them 10 mins to look it over and 1 1/2 weeks later I received his us passport and us birth certificate abroad in the mail NO ISSUES. He will have no issues getting his american citizenship.

    Now we are just waiting for my I130 to go through. Ask if you have any more questions. We have 2 children and I have been through it

    Is one of his parents a american citizen?? It has to be. Who is where at this point? He is in Panama with whom and who is in America? I am asking to understand your case a little bit.

    Yes one parent is U.S. citizen. Both parents are in U.S. Mama has visa and is in U.S. And yes he is in Panama. I had an idiot help me with my paperwork amd now am paying for it. :help:

    Ok I am confused. I am asking this because I have 2 children with an american citizen and one was just born here in Germany where I am waiting to get me I130 approved. He didnt have to go through the process. He was given american citizenship right away because one of his parents is american. I applied for his american citizenship at the american consulat here in Germany and he got his american birth ceritificate abroad and us passport within 3 weeks. Thats why I am asking. If one parent is american he is automatically an american citizen. Maybe I am misunderstanding something....let me know...I have a great lawyer and she could maybe answer some questions. I hate when children are involved. I miss my husband terribly, but missing your children going through this process is heartbreaking. Let me know

    we have a lawyer working for us. So we dont receive a DS320...he automatically is our agent. So instead of sending the agent form out ...they send out both bills at the same time.

    Hope it is moving for you soon. It took our bills to be generated 1 week from getting a case number, but I heard it takes 2 weeks on the average.

    Always check Tuesday...they update their automated systems usually on mondays

  14. Uhh I feel for you. I am a german citizen married and here waiting in germany for my CR1 visa to come trough

    I was in the same situation as you are in right now. I just had our son on October 29th and ..when we started the process it was back in May and I was pregnant and even had a very high risk pregnancy because of complications and prior experiences.

    We tried everything...called the congressman...etc...NOTHING. USCIS told us it could not be expedited because Germany was a country with a very good health system and I was taken care of here in Germany as well as in the US.

    We also already have a 31/2 year old little girl and she had to go back to the US because I was on bedrest ...they didnt even consider her and us being seperated as important enough.

    I would try your congressman, but dont get your hopes up....If I could help you guys with any questions..let me know..if your wife needs someone to talk to that was in the same situation or has questions...I am still here in Germany...I would love to have contact with someone in the same situation.

    Keep your head up high...you will get through it...IT IS VERY HARD....my husband has not seen his son as of yet...but we hope to be done soon.
