  1. I found my x husband's A number, that was back in 2001. But I don't remember the exact date of filing, would that be an issue ? Has anyone ever written YES to this answer and submitted supplement to this question? Please advise if anyone have had similar experience. Back in 2001, I was still in college, pretty naive and wasn't much involved in his process of obtaining a greencard from his initial F1 Visa for his MBA.

  2. They really don't care when you kissed, talked about getting married, or shared an ice cream cone together. Not to be smart-####, really. But the reality is you will get to the interview and they will say "What's all that?" You will answer "This tome, sir, is the evolution of our unique and most romantic relationship" He will say "hmmm, got any photos?" "Why yes" you will answer and produce your multiple albums..."Give me four photos...thanks, go wait to be called for your interview" You will go to the interview and they will ask either no questions OR no questions that have anything to do with the evolution of your relationship. "What is the name of your fiance's mother?" for example. If she knows the name, it is enough, it doesn't matter that you told it to her under the Eiffle Tower on your third visit to Paris.

  3. Hi everyone,

    I just started filling out the forms for the K1 visa, I have a few questions I need your help answering. I find the whole process very tedious that I am to the point where I am flirting with the idea of hiring a lawyer. What is stopping me is the fact I had a conversation with one who promise me the K1 visa approval by August; after saying the New York/Trinidad process take 7 months but he can get it done for me sooner. I know from reading the post on VJ things can not be rush things happen when it happens.

    Here are my questions; I hope one of you great people will be able to help me with an answer.

    1. Question 12 of the I-129 :If your Fiancé (e) is currently in the U.S., complete the following: He or she last arrived as a: my answer yes as a Crewman

    Arrival/Departure Record (I94) Number: He does not have an I-94 he has an I-95

    2. There is a spot to enter the I-94 record number which consist of 3 numbers follow by a dash and 8 more numbers. However, on the I-95, I only see an OMB NO. Which consist of 4 numbers follow by a dash and 4 more numbers. Has anyone encountered this? Do I put the OMB number or is there another number on the I-95 that goes there? Should I leave it blank? I am planning on including a copy of his I-95 in my packet. Is that wise?

    3. There is an arrival date on the I-95 but I do not see where the expiration date is located on the I-95.

    4. Is it true that it is taking longer to get a K1 visa if the fiancé (e) is from Trinidad?

    5. What is the different between a tax transcript and a copy of your tax return (1040)? Which one should be sent?

    A lawyer will not speed up your case! They are likely just trying to get your money.

    Being from Trinidad doesn't make the process a lot longer. It might take a couple months beginning-to-end for everything to be completed from the Trinidad embassy's point of view, but that holds true for most countries (some take a lot longer). As for everything else, it takes about the same amount of time as any country.

    Check out our timeline for a good overall estimate, as well as using the site's timeline function. You will need some patience, but it can be worth it in the end. :)

  4. What evidence do you have of required vaccinations? If you have proper evidence, you can get that transcribed directly to an I-693a, and no DS-3025 should be needed.

    The only evidence we have is her original vaccination copies that she received in Brazil. All of them has been translated to English.

    Were we supposed to receive a DS-3025 copy from the medical exam doctor in Brazil?

    We are located in PA and I am not sure what Civil Physical could provide answers ot our questions.

    Could the original vaccinations be approved evidence for filling out the I-693A?

    Most people (us included) have used Dr. L.E. Arnold to transcribe the I-693a. In my correspondence with her, she said that we just needed evidence of vaccinations, so I'm guessing she will accept the vaccination copies as evidence. I suggest contacting her to ask if your evidence meets her requirements.

    my fiancee came over on a musicians work visa, and we married 5 days later. only after the fact did we know this could be bad for his green card paperwork.

    i know people who come over on a tourist visa could be in hot water for getting married quickly, but could the same be said for a musicians visa? he was planning to come here to work, and is still working for the organization that got him the visa. does anybody else have a similar situation?

    I don't have a similar situation, but a couple thoughts.

    He won't be in hot water for getting married on a work visa, but he might be when he tries to adjust status.

    Work visas are not intended for permanent immigration, just like the visitor visa.

    Assuming your fiance came intending to marry and immigrate on a work visa, it sounds like you did plan to commit fraud, even though it may have been unintentional. Many people have gotten away with it, but 5 days is pretty quick, and is likely to at least throw up some red flags. It's simply a judgement call on whether you want to just go ahead with the AoS or not. Surely others on the board will toss in their opinions.

    I just want to understand the timelines that all the options are going to give me if I'll come there and...what are the options that I'll have. U know, just to have in from of me the complete pictures of what is going to happen in all kind of situations that could happen

    1. That would vary with the marriage laws of the state. Many states have a waiting period. My suggestion was that she marry you in your country, in which case your country or local government would be the regulating factor.

    2. Using VWP with the intent to "stay there" is fraud.

    3. Depends on which type of visa. I think the K-3 is a little faster right now, but you're probably looking at 7-11 months either way. That varies though, so check out the timelines section of this site. If your love is true, it will survive the wait. Thousands of VisaJourney members have survived that wait.

  7. I would try to go there because she's got job when I've not one legal now in Italy...so I have the chance to move without to be worry. But your advise is the best and more sure thing to make and I'll take that in a very good consideration about to solve the situation.

    Not sure I understand your question, but check out the info on the different visa types in the guides here.

    If you two marry, the IR-1/CR-1 will get you a green card right away, so you can work and travel as soon as you get to the states. For these reasons, it seems to be the more popular option for married couples.

  8. yes guys I'm scared for her because I dont want anything happen to her...she cannot come here untile her son will be adult and that means 4 years...that was our original plan but I got tired and I want to meet her...this is my intenction originally...just to meet each other but I want to know...if my feelings for her will become so much strong that I dont want to leave her nomore...that I want to get merry...can I be able to make it?

    Specially thinkin about her ex that without me could act stupid...he had already a reatrictive order from her....so about that we are covered but it's not enought if U think that her son lives with her and she have to let him meet his son.

    Anyway he's not scaring me cuz I have the abit of this kind of people...I grew up in the ghetto here so...I know how the this things goes and I know that he feels strong just because he knows her by herself. Everytime that something happened between them, was alway because her relatives was not home...but are few mounths that the things calmed down.

    Anyway beeing with her he will know that she's not by herself and this is what I want.

    I understand you are in a very tough situation, and it's not hard to worry so much about a significant other.

    How about this? She comes to visit you for a while... If things pan out, you could then marry and file for an IR-1/CR-1 or K-3 visa. Her ex boyfriend wouldn't need to know any more than "she went on vacation."

  9. Typographical errors happen. It could be easy to explain a divorce date error (ie - "wasn't technically finalized until 2001, but we were considered divorced in 2000"). I wouldn't worry about that one.

    The second note isn't an issue either. Plans change all the time. Just make sure that you use the proper address on the AoS application, and you might want to mention it at the interview.

  10. Is her ex-boyfriend really that scary that she'd be risking her life by dating someone else?

    If so, I think you should attack that problem before immigration problems. Can she get a restraining order, and/or life with some friends/family for protection?

    If you really are afraid of him murdering her, do you think you'll be able to live peacefully? There WILL be times where you won't be there to protect her.

    Maybe she should immigrate to your country (?)

  11. This depends on the embassy, but my (now) wife faced a similar situation. She renewed her passport and didn't have it by the time she got packet 3. The embassy said they'd have the interview, and then just schedule a follow-up when the passport is ready to issue the visa (assuming the visa is approved)

    You might want to contact your embassy to be sure, but I'm guessing they all handle it similarly.

    I don't know, but you can probably create two accounts and both add the same case to your portfolio. Anyone have experience with this?

    A side note: if you have a gmail account, you can set it up to automatically forward the mail to a second address. You can even set up a filter so it only forwards certain emails.

  13. thanks penguin_ie...so what are u trying to tell me is that if I go in the usa and happens that I meet the girl of my life and I want to get marry without come back nomore in my home country...I'm not able to do that?...because I hear that this is possible...even at my girl the court in her city told her that the only thing that we need to do is get marry and afther pass overthere to make any requestions (I think the AOS) and I'll be able to do stay there...the only think that the said is that my VW mustnt have to be expired cuz if that will happen than I'll have troubles. A lot of people made that in her city...a lot of her friends evem her aunt (that is the one that told her to go to the court) made that already....the thing is that I dont have to have my VW expired and that I'll have to wait to move from the USA untill my situation will be not solved.

    I'm not going to say that I'm coming there to get marry or that I'm going to meet someone that could become my wife...I'm coming for vacation.

    We cannot condone fraud, which is what you are planning. Even if others have done it, it doesn't make it legal.

    The local courts do not have the expertise or the jurisdiction to comment on this matter. Your local U.S. Embassy would confirm that your intent is fraud. I suggest you contact them, if you care about the legitimacy of your actions.

    People who use the immigration system in a fraudulent manner only make it worse for us folks who do so in a legitimate, honest manner.

  14. The mail option is a good one. I think SS updates IRS every 10-14 days or so.

    Are you certain her name matches the SS card? Might have two last names in that box.

    So they get the return by mail, and possibly reject it for the same reason? Why is that a good idea? That'd be even more of a pain to deal with.

    Might be better to keep resubmitting electronically (once per month or so)... I think most e-File providers will not charge for this

    Error Code 0503: The secondary taxpayer's Social Security number and last name do not match what the IRS has in its records. The IRS receives this information from the Social Security Administration (SSA).

    What name does the Social Security Administration have?

    What name did you use to file taxes?

    (edit: guessing there was a name change involved with the immigrating party)

    However, does that mean that they'd extend it, in case of problems? I assume they would, if they asked for more documentation or anything of the sort, but one can never be sure... If we get denied, would they still keep it at the embassy and give us some time to react to that, too?

    Yes. They will extend it to allow for a reasonable amount of time to take care of all actions to be performed at the embassy.
