  1. you need divorce decree etc, they dont care about who gets the dog etc. it must be in english, so it will need to be translated , you can either do it yourself or have it done.

    Thanks much for the reply. So the divorce document (decree) in the foreign langauage has no specific requirements, like court certified etc..? As long as it is translated in English, correct? When papers are submitted, just don't want to have to deal with delays if USCIS send back asking for more specific info etc...want to make sure to get it right the first time...

    I just had a question about doing all of the AOS paperwork and part of that is proof of past marriage ending, so what do they ask for, a divorce document in this case?

    What if the divorce took place in a foreign country, in that foreign language? What does USCIS require? Does a copy of that foreign divorce document have to be certified/notarized in any way? What about translation, what are the rules in terms of getting the translation for the divorce doc?

  3. Was wondering if anyone knows probability if overseas spouse applies for visitation visa to come here and visit her husband, while the I-130 (spousal visa petition) process has just started, how does that work? What do they ask when someone applies for visitation visa?

    And if they deny her visitation visa application, what effect might that have on the I-130 process?

Just wanted to see if anyone here would know the process for when the paperwork is completed by INS here (National Visa Center?)....Just wandering when they are done and approve from here, and they send the package for processing to the overseas Embassy for issuing the Visa, what exactly do they send there? Is it all of the paperwork or just the papers/documents that are needed over there?

  5. If someone is overseas and does not have their green card with them (lost), I presumre they cannot enter the USA without it (probably can't even board the airplane from foreign airport)? If so, how difficult is it to get a replacement if you are overseas and need to travel back to US? Do you go to Embassy and they do something to help you?

    Does anyone know what the conditions are of the CR-1 Visa? Once spouse gets this Visa from Embassy and travels to US, how long is this Visa good for? When it expires what happens then? What if spouse gets divorced from her petitioner husband after say, 6-8 months, or less than a year? What are the immigration rules?

    Please advise.

The explanation we received from our last call to USCIS, is that I-129F K3 apps were only being administratively closed if the I130 approval was at an earlier date than the I-129F, and as we know this was the recent situation. (They said administrative closing of I129F had nothing to do with who had paid/filed under the previous process). Now that the processing times for the 129F are back to being a month ahead of the I130's (at California), they will process the K3 (of course, not that processing times couldn't change back again!).

    What troubles me, is to see people giving/taking advise not to file for K3 based on speculation and unofficial information (mine or anyone else's!). If you want a K3, file for it!...if you prefer the IR1/CR1 then don't....if you just want whatever is fastest to be with your spouse, consider it a "moving target" and explore what is best at any given point in time for the country your spouse is coming from.

    To clarify my statement...I was not suggesting folks not file for the K-3, but I was suggesting that from the evidence we have at this time in history and from various sources, the K-3 is CURRENTLY being canceled once the I-130 is processed. Based on your interpretation of the conversation with the CSC USCIS rep, there seems to be a glimmer of hope that they will soon approve the K-3s again, at least at the California office. I hope this is accurate but we've heard conflicting things from USCIS reps and the infamous mis-information line.

    This is why i have urged folks to work through your congressional reps and senators.

    The choice to petition for K-3 remains someone's own personal decision. Good luck.

And, yes, I agree 100%, everyone should contact their reps and push for an offical response to this situation.

    I filed I-130 back in May 2007, approved in Sept 2007 and my wife just had her interview a month ago, in Feb 2008. I also filed K-3 (I-129f), priority date was July 11 '07, and it just got approved right before the I-130 interview was scheduled. (the interview did NOT produce a Visa, my wife has been going back and forth for past month, producing documents to the Embassy that they are asking for, per 221(g)). Anyway, the I-129f got approved on Jan 31, 2008 (says that it is good thru May 30, 2008).

    So I don't know what to do now, should we go ahead and submit the documents the Embassy is asking for on the I-129f? They are asking for filled out DS-156, DS-157, copy of letter from NVC, and a passport type recent photo...what do you think our chances are that my wife can get the K-3 Visa, although they are being sticklers on the CR-1 Visa? Would that work, can we go ahead and pursue this, in hopes of getting the Non-Immig Visa sooner?? Or just wait it out and hope they will eventually issue the CR-1 to my wife??

    BTW, the Embassy is in Syria.

    My personal opinion is that you are so close to I-130/CR-1 keep at that and forget the K-3. In my case, my I-130 just got approved recently so a long way to go for me. So if I can ge the k-3 revived, it is worth it for me. My 2 cents.

    Not only is that the best course of action but once the Consulate figures out the I-130 and I-129F are for the same visa applicant they are required to stop action on the I-129F anyway. You cannot be issued a K3 visa when an immigrant visa is immediately available. The State Department interprets immediate availability as the I-130 is on station. Somebody hasn't done their job right. You want that CR1 visa anyway.

    If that's the case I wonder what the purpose of the K-3 is anyway, if they just throw it out, when it was really intended to expedite a visa so families can be re-united, while waiting for the CR-1 to be issued.....??

  9. Has anyone had any experience calling the overseas Embassy to talk to the Consul, about your SOs case? To talk to them and explain, perhaps let them hear from you and try to persuade them to move your wife/fiance's case along, and that your case is a legitimate one?

    Also, do you think it would be helpful if I actually went over there and walked into the Embassy to talk to the Consul about my wife's Visa petition? Does that help if you go in person and let them see you, perhaps they can guage and get a better feel for what you're about, and help your cause?

    If my wife's visa keeps dragging, I'm thinking of calling my Senator to try to get some help - is that a good idea, would it do any good?

    BTW, this if for my wife, I-130, CR-1 Visa petition, already had interview 3 weeks ago but they keep asking her to come back and bring more stuff with her (proof of relationship), and 221(g) letter, so this is getting really frustrating...

    Please if anyone can advise for these approaches.

    5/11/07 I-130 Sumbitted

    8/27/07 I-130 Approved and sent to NVC

    9/21/07 Sent IV Fee Bill to NVC

    10/18/07 Sent AoS to NVC

    11/19/07 Sent DS-231 to NVC

    12/11/07 Case Complete.

    2/3/08 Interview at Embassy - they asked lots of detailed questions. They asked to see more proof of relationship and phone bills etc, told my wife to bring this information back when she gets it

    2/5/08 My wife dropped off the phone bills at Embassy. They took her fingerprints and told her to come back 2/19/08 for decision.

    2/19/08 My wife went to Embassy - they gave her 221(g) letter telling her they needed more proof of relationship, letters, cards, photos, and a signed/notarized letter from me describing relationship.

    2/20/08 My wife dropped of the letters she had, all the photos and the signed/notarized letter from me that describes the relationship. They told her to come back 3/9/08. That is where we are at right now, waiting and hoping that when she does go back on 3/9 that they will finally issue the Visa. God I hope this long frustrating journey ends with Visa issuance...

    So what do you guys think of my case? Is it a good sign that they took her fingerprints? I mean, we are right there, we should be getting approved, they are holding it up for what reason I don't know why....

    Please advise.

  11. I am so frustrated!!! It has definitely added more time to our cases and the worst thing is that USCIS does not even admit it's happening. I called using the RFE trick and the rep told me I was still 6 weeks from being out of status but that my I-129 was still open and being processed.

    So what do you guys think I should do at this point? The CR-1 is getting complilcated since everytime my wife goes to the embassy and submits what they are asking for (proof of relationship etc), they ask for more stuff and tell her to come back in 3 weeks, so they are not issuing the Visa - but the K-3 is probably arrived there at the Embassy now, so will they go forward with that, will that cut our time shorter and improve my wife's chances of at least coming over here while they dilly-dally with her CR-1 Visa??

    Or would I have to call somewhere and actually cancel the K-3 application? In order to reduce confusion??

    Please advise.

  12. It has been posted many times, that USCIS has been administratively closing K-3 in favor of the Superior CR-1, they have been stating that CR-1 has been processing quickly lately and the need for K-3 is not an issue.

    CR-1 is the superior visa anyway, it results in a Green-card upon entry. K-3 requires AOS ($1010) additional USCIS processing, and is not work auth, so cannot get a JOB, SSN, or Driver's licenses until filing for and receiving EAD or Green-card, EAD takes 90 days or more to get.

    Hello all. I filed my I-130 back in May 2007, and the I-129F (for K-3) back in early July 2007. I got my I-130 approved on August 27, 2007, and just a week and a half ago I received a notice from USCIS that my I-129F (K-3) has been approved and will be forwarded to NVC for processing. So today (Feb 19) I got another notice (from NVC) stating that they will forward my petition for K-3 to the consulate, and within 1 week the foreign consulate will send my wife a packet explaining what documents they will be needing from her etc...

    Now what's interesting is that my wife has already had her interview over 2 weeks ago, and now we have 221(g) requesting more information (proof of relationship), so that CR-1 Visa app. is on hold pending them receiving more information/docs from us....

    So I am puzzled at this point - we are nearly at the end of the road (hopefully) and about to get the CR-1 Visa for my wife, and now this late in the game they are sending K-3 approval to Embassy for processing etc...do you guys in here think this will complicate my case, will the Embassy get confused and perhaps hold off issuing the Visa to my wife, when they see this K-3 paperwork arrive from the states??

    Anyway, I hope that this information perataining to my case is helpful and can shed some light on some of the questions in here, and I hope someone can also advise me as to the potential confusion/complications my case may see due to this dual CR-1/K-3 situation..

  13. My wife has been sent back and forth to the Embassy, and I am quite stressed and confused as to what's gonig on, so anyone on here who can offer some advice, I would really appreciate it.

    After the interview at the Syria Embassy my wife was given a letter that said the visa application was denied under INA 221(g) and that additional information was required before adjudicating the app.

    So what does this mean? What is INA 221(g)?? What does adjudication mean??

    It means what it says. They won't issue the visa until after they have the specific additional information they asked for on the 221g letter. When they get it, they'll "adjudicate" (consider and decide).

    Your next step is to get them exactly what they asked for and deliver it by the method they gave you for doing so.

    Good answer. 221(g) is not a denial. It means they want additional information before they can issue the visa. Just provide them what they ask for. Lot of people get 221(g).

    Thanks everyone - I hope that after submitting the docs they are asking for they can issue the visa to my wife, this sure has been one long stressful ride...They are basically asking for more proof of relationship, including a signed and notarized letter from me describing the relationship. I spoke directly with the consul at the embassy and got the details of why and what they wanted, so hopefully having that discussion with them that will help toward getting approval (crossing my fingers)....

    On another note, I just received a notice from USCIS that my K-3 has been approved and will be forwarded to the Embassy for processing (kinda late in the game now)...we are already almost at CR-1 Visa approval and now they send me K-3 saying that petition being forwarded to Embassy and within a week they will be sending my wife a packet stating what they want from her etc...

    Does anyone know how this will affect my current CR-1 Visa process? I really feel K-3 is late in game and won't do me any good now, and wondering how it will interfere with the current status of awaiting the CR-1 Visa - when embassy gets this, will they wonder and be confused, will it negatively impact our CR-1 Visa status currently??

    Please advise.

My wife had her interview at Embassy in Damascus 2 days ago....most everything went OK, they asked a whole host of questions, everything every little detail...in the end they were not satisfied with photos of us together and the letters that I sent her....they asked her to bring in proof that we were in contact - copies of phone bill. So they gave her this blue paper (or it may have been red, I don't remember), and told her to bring the phone bills the next day.

    I had to fax her my phone bills showing her phone number and that we communicated over the phone over the past 8 months. So she went back today AM and handed them in. The Embassy took them and gave her this yellow card and told her to come back in 2 weeks (Feb 19th). They also had her provide her fingerprints today also(all 10 fingers).

    Does anyone know what is going on, why it's taking so long, what are they looking for that is taking 2 weeks for her to go back there? Has anyone been through this? Could they be asking for anything else when she goes back do you think? I mean, I'm hoping once she goes back in on the 19th, they will take her passport and tell her to come back in 2 days (Thursday) for her Visa, but I really am not sure if that's what will happen, or they will make it more complicated...

    Thanks for any advice anyone on her can offer.

    I did not receive my visa the same day cause I had to provide some missing documents . Usualy the visas in Damascus are picked up on Thursdays at 12 noon .

For your interview, did they conduct it in English, is that a requirement, or is usually done in Arabic, cause if someone can't speak that well English, makes it more difficult....do they ask you any off-the-wall questions, or just the usual, i.e. how did you meet, where did you meet, etc....??

  19. My wife has an interview scheduled at Embassy in Syria early next month, for CR-1 Visa (I-130). My question is, during the interview, do they conduct it in English, or the native language? Cause my wife does not speak too much English, so I was wondering if anyone has any experience with this Embassy and if they do the interview in Arabic instead??

    Please advise if anyone here has any knowledge of this.

My wife has an interview scheduled in Embassy in Syria for early next month (I-130, CR-1 Visa), and I read through the interview paperwork that NVC sent me a few days ago - it says that if you are missing such-and-such, that you will be denied at your "initial interview" - what does this mean? Does it mean that this if for the initial interview, and there are more interviews to comen, and a long delay in getting the Visa approved and stamped on passport?? I don't get what they mean by that - I always thought that you go the interview, and if all is in order and nothing missing (as should be the case for us), and interview goes smoothly, then shouldn't they just approve the Visa? And perhaps issue the Visa at the same time? Does it not work like that?

    Please if someone can help here, I am confused about this and need some advise from those who may have been through similar experiences....

  21. When I received P4 from the embassy , there was a letter from the embassy and a list of physician . I called one of the physicians in the list and took an appointment .At the time of medical examination all i needed were my passport and the letter from the embassy .

    The doctor filed some forms on his computer while he was asking me some questions (about somking,drugs,operations.....etc ) . Then he printed the forms and placed them with the embassy letter in a sealed envelope.

    P.S : My case was generated and processed by the embassy in Damascus .

  22. Does anyone know how to find out if there is a fee associated with obtaining teh actual Visa pursuant to the interview?? Besides the Visa Fee that we pay to NVC ($380), is there realy an additional Visa Fee that still has to be paid by the Applicant at time of interveiw? Would't they disclose that this fee has to be paid, within the interview instuction letter they send out in the appointment packet? So if it's not in there, I woudl think that there is no fee to pay.

    This pertains to a CR-1 Visa. (I-130 Petition).

    Can someone please shed some light on this?

    We have our interview in Feb. I was wondering if somebody that has had a cr1 interview in Lima, Peru could help us get better prepared. What do you need to pay the application fee? How many fotos do you need. Any help would be greatly appreciated. Thanks.

    I always thought that the Visa application fee was already paid, when petitioner pays NVC the $385...isn't that what it's for, or does the interiewee still have to pay additional fees for the Visa???? I also need to know this cause my wife has an appt. on Feb. 3 for CR-1, so if she needs to take $$ with her for that...

    Iread 2 versions on this board. Someone said its $100 and someone also said its $131 and someone also says that Banco Continental takes the payments in also PERUVIAN SOLES

    Along with instructions for the interview, does is also state that you must bring along the $$ for the paymeent of the Visa?? Do they tell you how much? Cause for us, teh instuctions list what to bring with you to the interview (Med Exam, photograph, valid passport etc.), but does not say anything about bring $$ for any payments, so does that mean that they won't charge anything??....can anyone address this issue here?
