    I don't want to get your hopes up but I personally recieved a phone call from USCIS...well actually my new officer. I had been stuck for 2 years and she wanted to personally call me to tell me I had been approved. I was lucky enough that they called me back and I was able to take the call the 2nd time. It was the best birthday present I ever got. If you have any questions PM me...Btw where in Australia are you from...I am a Sydney girl.

    I would suggest if you can do all the stuff ahead of time with a local doctor and get copies of all the papers for proof of what you did perhaps the USCIS doctor may not charge you so much. I did everything before going to the USCIS doctor and instead of costing me $500.00 it only cost me $100.00 but this was several years ago. Good luck with you immigration journey.

  3. The photocopy should be able to provide enough evidence, in addition to your SS card, for you to submit with your I-9. Unless you get a TNC back you should be ok so long as you present the original GC once you receive a replacement.

    Suggestion: request a replacement card today. You must carry it with you at all times, by law.

    I am hoping that it appears shortly. I do understand to carry it at all times. I was carrying it in my checkbook that is misplaced in my house. I just have the copy as a back up in case I have any problems. Thank you for your response :)

  4. Hi everyone,

    I noticed that I have a green card error for the Country of Birth. Now I read that it takes about 6 months to get a replacement card and my unexpected overseas trip is going to be late December and early January. So it looks like I apply for a replacement card, I'll have to send back my original green card. And of course I need my green card to get back into the country after my trip. So what are my choices?

    1. Apply for the replacement AFTER my trip but have the WRONG country on my green card in the meantime. In this case, am I going to be able to get back into the US if the wrong country is on my green card?

    2. Apply for the replacement NOW but run the risk of not having the replacement green card by the time my trip is here? In this case, do they substitute it with something else so I can get back into the country?

    When I had my greencard replaced I made an appointment to see my local office and explained my situation to them. They procedded to direct me to the local post office and asked me to get proof of sending it in and then I could come back to their office for a stamp in my passport. With the stamp it will work out. Mine actually came back in 8 days but I think that was out of the ordinary. Good luck and safe travels.

    I know my situation is different to yours as I came in on a B2 visa.....However I was out of status for 10yrs due to a number of reasons which I don't think I need to disclosure in a public forum. my thoughts to you is ASAP file your papers.....It will be a huge relief when you do.....Even if it means your pending it is much better then been out of status.     We filed our AOS package on May 28 and just received our NOAs for AOS and EAD dated June 5. We are going to be going out of town for a few weeks. Is it possible to reschedule the Biometrics if the date will be while we are gone or will this complicate matters???? Thanks!

    You can attempt to reschedule your appointment or depending on your local support center you could possibly do a walk in. Personally though it is best to keep the appointment they set if they don't allow the walk in

  7. We just got a I-797C, Notice of Action today indicating that we have an appointment next week to have biometrics taken otherwise our I485 Application will be "considered abandoned." The thing is, we had our interview back in January 2009 and have already gotten a conditional Green Card.

    I am not sure why you would have another biometrics appointment but I would either call the 1800 even though they aren't very accurate or if it is not to much of an inconvience make an infopass appointment and discuss with them about your letter.

    I received my interview Letter, I have couple our question, I hope somebody could answers this, this are the questions below.

    1. In the interview letter it said "Request for Applicant to appear for Initial Interview" what is Initial? do I need to appear for the second and third interview?

    2. we are married in May 5th 2007 and we crossed the may 5th 2009 and it will be more than two years marriage, At the time of interview we married more than 2 years, will I get 2 years or 10 years green card?

    3. In case if it is approved do we need to remind and request the interview people about the 10 years green card so that they may think about it ?

    4. when I receive the green card how I can differentiate between Conditional green card and permanent green card?

    5. what are the question they ask at the time of Interview and share your interview experiences?

    Hi Ravi,

    1. The intial interview is "USUALLY" your only interview but sometime but very rarely they require another interview. It's just USCIS wording don't take it to heart.

    2. Since you have been married longer then 2yrs at the time of approval you will recieve a 10yr greencard.

    3. You shouldn't have to remind them they know you are married longer then 2yrs so you will get a 10yr greencard. There is nothing for them to think about.

    4. Your greencard should arrive with a 10yr expiration date on it if it expires in 2yrs then you will have to get it fixed.

    5. Every interview is different from the next so even though I was asked where did I meet my husband, you might be asked when did you meet your spouse. Most the time they are just basic questions that you SHOULD know the answers to unless they are not sure if your marriage is legit. Just remember to tell the truth and you will be fine.

  9. Hello, I've been a member for 2 years now, this is my first post. My fiancee arrived on a K-1 Visa (through the I-601 waiver process) 'almost' 3 months ago and we've been married for a couple of weeks now. My income more than meets the requirement, however at the moment I do not have the $1,010 necessary for the AOS filing (due to several large one time incurred expenses). My assumption from other posts is that we should be fine with a late filing (about 1 or 2 months late), however I am curious whether my wife can travel with me via air within the US if she is out of status? Any assistance would be appreciated. FYI, I purchased the flight one month ago, before the latest financial expense, when I thought we would be able to scrap by and meet the filing deadline.

    If you wife has a valid ID she "should" be able to travel. I never had a problem travelling while I was out of status but I had a valid dl so I was fine.

    My case is different to your wife but I did my medical to AOS in 2006 and had my interview in May 2006 and at the time of interview I was approved but pending due to FBI NameCheck. I had been previously told from USCIS that since my medical was in 2006 if I had to wait past a year I would have to redo my medical. Jan 30 2008 was approved without having to do another medical. I hope this helps you out. BTW I am in Pueblo so Howdy Neighbour.

    They took my I-94 too but from what i hear that's just what they do.

    At my AOS interview my I-94 replacement card was taken but it wasnt like it would have done me any good as it been expired 10yrs at the time of interview. Oh and I wasn't approved till 2yrs later.

  12. Hi everyone. I am new to this forum and I am so glad I found it:)) I have a question I am hoping someone can help me with. My husband and I are trying to send off the I-751 application but we are not sure what to send along with the application? We had an interview 2 years ago and we submitted proof of our marriage at the interview and birth cert of our daughter born in the marriage. I am so confused on what to send with this application. I read where is says you have to send affidavits saying we have a legal marriage, and then I read you have to send in a fingerprint folder ( not even sure where to get one of those). We dont have the affidavits but we do have our tax returns, photos of our marriage and the birth of our baby girl. We have a few bills together in our name as well. Do I have to send the affidavits with the application? It wouldn't be a problem getting them but we only have 6 weeks let to file before his greencard expires. We had to wait on tax money to come in to be able to afford the $545 and thus now we have only 6 weeks to file this. His greencard doesn't expires until Sept 15th but I want to get this done as quick as possible. Could someone tell me exactly what I need to put in the mail along with the application? Also, it says to send $545 for the I-751. Is this the only form we fill out because on the INS website it says there are 2 forms but I'm not sure that the other form would be?     I can suggest things but I can't say things for sure(as every case is different) With your application you could send in the affidavits from friends saying your marriage is legitmate. Also send in a copy of your tax returns showing that you filed them married and jointly. Also show them bills that you have in both of your names that come to the same address. You also could show them copys of bank statements in both your names. The photos together (especially with the baby)is always good. Include a copy of any children's birth certificates. Maybe you took a trip together and you have intinerary or hotel reciepts. As for the fingerprint folder I have never heard of such a thing so I am not sure where you heard that. Included in the fee is a fee covering the biometrics for your husband. Overall you need to send in stuff that is jointly prooving you guys are still married. If they feel they need any more information from you they will send you a RFE(request further evidence) and they could also choose to interview your husband. Include form I-751 along with your application. You diefently need to get a move on as it will complicate things if you wait till the date after his greencard expires.

    Try not to stress out about it.

  13. Hello everyone here..i just read on the uscis site today about the new requirements for vaccination. I was surprised that additional vaccines are included now, but whats bad about is i am still looking for civil surgeon near where we live to complete my vaccination. i only need 1 vaccine to complete my vaccination record..my question is, IS THERE ANYONE OUT THERE WHO completed the vaccination record and had gone TB TESTING? any reply is highly appreciated..thank you ALL! ...couldn't get earlier appointment(MY APPOINTMENT DATE ON THE 18th of august):( SAD hate needle!!waaaaaa!!!

    You could always go to your own doctor and get him/her to give you the shot so you can it sooner then 18th or even a local health department and then take it with you your record on the 18th

  14. We just filed an AP application because we've been waiting for an AOS interview for a long time without any notice. But a few days later we received an interview invitation. So is there a way to cancel the AP application? They haven't charged our bank account for the check yet.. also, if they do charge it, is there a way to cancel the charges?

    You shouldn't have had to pay anything anyway as there is no fee for the AP after you filed the AOS if you sent the AOS receipt notice with the AP application.

    If you applied before July 30, 2007 then I'm wrong.

    We did file before July 30.

    You wont be able to cancel your application for AP but either way you haven't had your interview yet and you don't know if your approved so you still may need you AP.

  15. To all those who already went to AOS application...

    My fiance and I got married last July 09 '08,and they gave us a copy of our certificate of marriage,handwritten in a pink form after the ceremony (the original marriage certificate will be sent by us through mail but it will take 30 days to receive it) My question is, Is it okay if i will sent a copy of marriage certificate in a pink form as one of the requirement for AOS application???

    About the Social Security Number, we just filed last July 22 '08 and it will take 2 weeks to receive it, is it okay if i don't have an SSN during AOS application???

    I'm afraid to encounter problems with these... thank you sooo much in advance to those who will help me with this dilemma.

    Your marriage certificate is probably just a cremorative type not the official one so you wont be able to use it, you will have to wait till u get the certified certificate.

    Your social security # is not a big issue some people don't even social security #'s until after the adjust their status.

  16. My advise to you is not get hung up on possibility of deniel , instead be sure you have everything organised and together.

    be prepared be honest and do everything exactly as required there should not be any problems. Be proactive with your case, do not treat it as a casual process, after all this may be the most important event in you & your spouses life, treat as such.

    It’s not like I think I would get denied (I hope not!!! although the whole process is going pretty slowly for me now…) or have a reason for it, I just never see any cases like that on VJ and wanted to know if that really happens and what are the reasons. Thanks for your reply!

    My friend got denied cause she didnt show up for her appointment but they had a legitmate reason for why they didnt so they were allowed to motion a re-open of the case but that doesnt mean it always happens.
