  2. Hey everyone, this may be a little confusing, but my wife is currently in the process of adjusting from her B2 status based on marriage. I'm a US citizen. My father has been an LPR with Mexican citizenship all my life, and my parents never got me dual citizenship. Now I'm exploring the process of obtaining Mexican citizenship which seems incredibly simple and straightforward as I am the child of a Mexican. My question is can I pursue this at the same time my wife and I are awaiting her EAD and our interview? I would continue living in the USA and have no plans to reside in Mexico. I would love to become a dual citizen and the only thing that is stopping me is our current situation and the fear that this might complicate anything for my wife and I. Let me know your thoughts. Thanks  so much.

    I entered on B2 as well as a Canadian citizen and made sure that B2 is on my I-94 as the most recent entry before adjusting status. You need to confirm with a lawyer (or someone knowledgeable here) to confirm if you will have a problem adjusting status if your September entry does not record a non-immigrant visa as the application asks for the most recent entry. Did you say you entered in September and what does it say in your I-94?

    My I 94 is not on the DHS website. I guess it hasn’t been updated? I emailed them about it, awaiting a response. On my last visit, they again (like this visit) stamped my passport saying “b2 status until *date*”. I found my previous i94 from my last visit as well and it says B2. I’m certain I’m in B2 status. Just waiting on DHS to update my i94.

    To add to this, I checked for my most recent i94 online, and my most recent entry is not there. My previous entry from July is recorded as my most recent. Not September. Is this normal?

This might be a dumb question, but am I here under B2 status? The only reason I'm asking is because someone on a reddit immigration forum asked why would come to the USA on a B2 as a Canadian. When it asks which visa I'm adjusting from, do I put down B2? Also, what do I do for the I-94, is there a copy of one I have to request? Or as a Canadian is there not one? Any info helps! Thanks!

    I'm assuming you are accused of committing an offence under section 58(1) of the Quarantine Act. The bottom line here is that the maximum possible penalty for such an offence is 6 months of imprisonment, and even if you received that maximum sentence, it would not be considered severe enough to bar you from the United States, as long as you don't commit any other crimes. See INA 212(a)(2)(A)(ii)(II).

     

    Still, your case should be handled by an experienced lawyer, because they will need to know what documents to submit in order to establish the fact that you are not inadmissible to the United States. If you mess up the documents, it doesn't mean you will get banned from the United States, but it can result in the denial of your application and you may be forced to renew the application in immigration court, which will be expensive and take a very long time to resolve.

    Thank you, I got some clarification again from the courts. They told me that it’s in the same category as a traffic ticket? This is so confusing. Anyways. They also told me it probably wouldn’t see trial until almost 2023, maybe later. It’s a ticket under the contraventions act, and is not anything criminal. So I don’t see how it could affect anything but again you never know. I’ll make a consultation with a lawyer regarding this. 

  7. I got a covid violation ticket in Canada back in May for returning from visiting my then boyfriend (now fiancé) and not getting a Covid test beforehand. It was accidental and since it’s $3500 I’m disputing it with the courts. It’s not a criminal matter and is classified as a ticket. They are allowing me to do trial over zoom but haven’t set a date yet. I am wondering if this will affect my immigration as we are now beginning the process to adjust status. This is very scary for me and the anxiety over this ticket has been keeping me up, I can’t find anything on the matter online since these tickets are new and a grey legal area. Anyone know if this will be an issue or not? 

  8. Hi, I’m currently on a B2 visa from Canada, and my boyfriend proposed to me. We are looking to get married in the next couple of weeks. I have been here almost 3 months and was admitted for 6. I have contacted an experienced lawyer who agreed to take on our AOS application for about $7000 (including USCIS fees). My fiancé’s income is low, so we’re not sure it’s worth it for us. I am terrified of doing something wrong and getting denied. I have no criminal record. I am currently disputing a covid fine in Canada but that’s it. The courts have said I can dispute my fine over the phone when a trial date is set, but again this isn’t a criminal matter so I don’t think it can hinder my ability to adjust status. Anyways, I am curious as to what anyone who may have knowledge on any of this thinks. I am very new to this forum, and don’t know much about immigration, so any information is valuable! Thank you
