    They were asked to send travel history from last 5 years. this was provided as per the instructions 1) responded via email with attachments and explanation 2) sent the same via courier to the embassy. 

    We've been waiting patiently since then...I've sent an email to the embassy couple of weeks back asking the reason for returning the passports and what we can do to get back on track but no response from ISB embassy yet. Please advise

    My wife and I had applied for her parents visa CR1 category (I think). Their interview was September 2017 and since then the cases have been under AP. Couple of weeks back they received a text from Amex in Lahore to collect their passports as those have been returned from the US embassy in Islamabad. Apparently the visa has been refused. Following message shows for one case status shows as "Expiring Soon":

     

    "Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf canceled, if you do not apply for your immigrant visa within one year of being advised to do so.
    You were advised of this requirement over 1 year ago, but we have not received a response from you since then. As a result, your application for a visa has been canceled and any petition approved on your behalf has also been canceled.
    Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.

    I have not been able to figure out the reason. Any suggestions?

    My wife became USC last year and now we want to sponsor her mother. Question is, I live in Europe where I have taken employment and my wife resides with me. Can my wife fill-in I-30 for her mother while the sponsor (my wife) is outside U.S. We pay our portion of Federal income tax for the Foreign earned income exclusion. I've been researching around and so far haven't come across anything that says USC must applying for relative must be present in U.S when applying. Anything you share is appreciated. Thanks!

  4. It wouldn't make any difference anyway for New York voters, the state legislature fixes the electoral districts so that incumbents always win, and New York always votes Democrat in the Presidential and Senate races. Why would he waste political capital getting more NYers to vote for him?

    It sure would.. since the orders are NOT going to be for any specific state but for all of 'em. this would include right-wing or the red states where he needs the support :bonk:

    I'm hopeful that this journey will end before the elections in November but not sure if any orders from Obama were issued to get the pending cases expedited or at least to be processed without longer delays :innocent:

  6. My wife's case is also In NYC. Had FPs on June 22 and in line shows from June 26 but now interview letter yet :( pls update our record. I guess its time to give them a call...

    by the way, can someone who already has received int letter tell whether their online status with USCIS has updated to reflect the same? if not, I'd be worried about letter being lost :(

    I'm filling out N 400 for my wife and stuck on couple of questions. Quick background, I'm a USC and work for IPO and was relocated to European office last year in September. My wife was visiting me for 179 days before going back to apply for US Naturalization. We qualified for 319(b) as well but my employer won't issue me a letter stating that I'll be employed for next 20 months since I'm offered short-term contract which gets renewed every 6 months.

    Now that my wife is back the US and residing with my parents which is the same address that we have on our 2011 tax returns, here are the questions:

    1- Part 8 - B - 5 : Do we put USC spouse's current address oversees or the US address?

    2- Part 10 - C (Continuous Residence: - 13 : Have you ever called yourself a "nonresident" on a Federal, State or local tax return? - We filed joint tax return and for state taxes, we had to use the form for nonresident or part-year resident because we did not live in New York state for the entire tax period. I was relocated in September and my PR wife visited me for almost 6 months stating November. Technically our filing status was "part-year resident", any suggestions?

    I'm kind of worried that my wife's case might be rejected or be complicated :(

  8. You didn't apply for a re-entry permit for her? If your wife is on your government orders I don't think you have to worry, its when she's not on your orders problems could arise, but I could be wrong.You work for the UN, do you have a government ID, if so if there is a military base around may be you could call them and see if they could do your fingerprints.

    I was able to get in touch with embassy and they said they will facilitate the fingerprints but they don't have the FD-258 form that's what is listed on the requirements. Again this will take my wife beyond the 6 months mark. We are not on government orders but treated as staff of international public organization which gets us to qualify for expedited naturalization. Now, what are the risks of applying after 6 or 7 months are completed?

    Fingerprints are done ahead of interview for the FBI check. If you work for the UN, you should be able to go to the US Embassy and get the fingerprints done there.

    That's what I'm trying to find out whether the embassy would do the fingerprints..so far I noticed I have to book an appointment and the earliest one would be in mid May. What about the 6 months mark on my wife's travel outside the US, do you suppose that's low/medium/high risk of getting the application rejected? Can we just do the fingerprints by sticking with the appointment next month and apply then?

    I think there's also a process of requesting extension to the limit of stay while abroad and not sure if that can be done from overseas and if that would be worth it?

  10. Not true, I did my fingerprints overseas and we're not military.

    OP are you in Spain working for a US Organization, whose head office is based in the States. When is her 6 months up?

    I think with a little more detail about your situation you will get better answers.

    Yes I qualify as I work for the UN. My wife's 6 months out side the US complete on 29th of April. Only thing unclear before we send the application is the fingerprints. If these can be done in the US just before the interview date, that would be fantastic.

    I'm residing in Spain and my wife currently on 10 year green card also joined me here. We meet the requirements for my wife to be able to apply for the Naturalization. In about a week, she would have marked the 6 months of absence from the US (for first time). In order to buy us more time, I could have traveled her to the US but that's not feasible in the near future. My question is about fingerprints, I have been trying to find out if US embassy would facilitate that but so for now response from them yet. Do the actual fingerprints HAVE to be sent along with the application or can I send the fingerprints later once I hear back from embassy? I'm just worried that the eligibility might get invalidated if we send the application after her 6 months of being outside the US.

    Any assistance would be much appreciated.

    I was relocated by my company late last year to Europe. My wife and daughter also traveled with me. My wife is on 10 yr GC and is eligible to apply for citizenship since she's had the GC for over 3 years. Question is: Can my wife apply for citizenship while abroad? I contacted a nearby US consulate and they refereed my to the USCIS website to contact them. Now there's no phone numbers or email listed on the site where I can ask this question.

    A separate question is: If my wife remains in EU while on GC, would she have to complete some sort of process so she can stay with me in EU for few years? Also, for how long can a GC holder stay outside the US without any permissions?
