  1. I have a while before i have to file to lift conditions but was curious about the poverty guidelines. What if when we file it doesn't meet the guideline, do you get denied? Can you combine 2 incomes to it to make it work? I would've thought with the recession that they would've frozen the guideline.

  2. So yaaay he got his passport and ssn so phew but now my other question is how does he get his birth abroad for the future? Do we still have to do an interview and all that and go back to canada or will they just send it? I've tried calling but you don't get through.

    One other thing - when the U.S. citizen writes out the affidavit "showing all periods and places of residence or physical presence in the United States and abroad before your (childs) birth"

    They will probably ask for proof of this, so you will want to have copies of the U.S. Citizens stamps in his/her passport (like the entry to Canada for instance) - they may ask for his/her school records - just basic proof to say hey, I did live in the States on the dates I have claimed.

  4. You most definately do not need to go back to Canada to get documentation of your child's U.S. citizenship.

    Without knowing when your child was born and assuming you have lived in the States for several years and you are sure you child has a claim to citizenship - what you can do now is either apply for a passport for him/her - or for a certificate of citizenship.

    Persons not currently residing in Canada who require proof of American citizenship have two options: link

    - They may apply for American passports from within the United States by presenting documentary evidence of their claim to U.S. citizenship as stated on the back of the DS/DSP-11 (Application for Passport) form. The cost is US$82 if the child is under age 16, or US$97 if the child is 16 or older, or

    - They may apply to the nearest office of the Bureau of Citizenship and Immigration Services for a Certificate of Citizenship.

    He's 2 years old. When i called the passport office they told me he needs his SSN and i don't have one for him since I don't have his birth abroad papers since I couldn't get him a SSN without it. Such a vicious circle let me tell you lol. I will try that route and thanks again :)

    Wow, I don't know who you talked to but they are wrong. I got my U.S. passport and I did not have a social security number yet. In fact, when I applied for my passport they gave me the application for the SSN as well (which I got later).

    From the passport information page:

    Foreign Birth Documents + Parent(s) Citizenship Evidence

    If you claim citizenship through birth abroad to U.S. citizen parent(s), but cannot submit a Consular Report of Birth Abroad or Certification of Birth, you must submit all of the following:

    Your foreign birth certificate

    Evidence of citizenship of your U.S. citizen parent

    Parents' marriage certificate

    An affidavit of your U.S. citizen parent showing all periods and places of residence or physical presence in the United States and abroad before your birth

  6. Was wanting to ask a few questions and what I saw around the site didn't really answer anything so hoping someone might have some insight :)

    We are in the states now 1 of us is a US citizen and the other now is canadian but a resident now. Our son was born in vancouver but we never did the birth abroad, stupid I know. Anyway I wanted to know if there was a way here in the states to either be able to get his birth abroad or do something else to his actual papers avoiding going back to canada to do it. Also if we have to go back to canada can we do his birth abraod papers in Montreal or Ottawa even? Any help or suggestion will be appreciated and thanks :)

    Who did you apply with RCMP or local police?

    Where are you located?

    Did you get the fingerprint version or the non-fingerprint version?

    Ummm the finger prints were taken in the states, they were the ink ones and they were sent to the rcmp. He passed his biometrics and everything but was arrested but it was dismissed but we didn't know we had to say that so to make a long story short went to the interview and got "approved" but won't get the stamp till we get that letter. Just thought that it's been a long time to wait.

    No that sounds absolutely normal, may even be a couple more months to wait.

    Ooooo I hope not, we have to bring the documents in at the end of january.

    They do have an email address on their website, so you can write to them and inquire as to when they might be sending them out.

    When you go for your biometrics they don't ask you anything. They take your photo(sometimes) and fingerprints and they will let USCIS known the results.

    Oh ok, i thought there might have been a form to fill up. Do you know if that arrest will affect anything or will it not even show up since it was said to be expunged. he said he had received a letter that stated that all those years ago.

  11. Hi everyone, I'm in need of a bit of help so here it goes lol.

    My husband is going for his biometrics next week and doesn't have a record but was arrested about 14 years ago and had fingerprints and photo taken. THe case got thrown out and it was said that they expunged everything. He also worked in a bank for a few years after that incident and when asked if he had a criminal record or been arested he said no and there was no issue. NOW my question is do they ask these kinds of questions and what do you answer. Does he have to say yes to being arrested even if the record is expunged? Is that going to cause problems if he does say yes? it was for assault when someone did an illegal uturn and he's from canada.

    Any help would be appreciated, thanks

  12. Well I had to redo my tests and that worries me, since there is no way in hell that something could be wrong with me it was freaking me out. I thought by law they had to let you know if there is something wrong with you. My TB test and varicella test were fine but the other 2 were pending. I had a baby almost 2 years ago and got all the test done when i was 7.5 months preggos and there was no problem then. No myself or hubby haven't done anything either. I know my tests from canada are 2 years old but should i call them anyway to see if they can send it to me? I'm freaked out to be honest.

    And jasman0717 I did search and found nothing pertaining to my question. I thought this site was supposed to help people and answer questions, what's the point then of having these forums if questions can't be answered hmmm

    Anyways... I have an appointment on Monday so i guess i'll be freaking till then

  13. I know, the probelm is that not everyones situation is the same, there are similar aspects to it but never quite right there. Plus the forms are confusing, I mean just for my son it was so easy and if i would've followed all the forms and stuff it would've been wrong. So for myself I need to file

    I-130

    I-485

    I-864

    G-325

    Correct?

    and optional

    I-765

    I-131 if i want to spend that extra money.

    Now do I declare money that I get in the forms? Will it help with the poverty line limits or not? Hubby makes more than that but I just want to clarify if I have to add it.
