  1. HI All-

I have not posted to this topic before but I got my approval...Petition was approved 02/12/10. Received text and email today from Vermont Service Center..At least the text alert does work!!! Quite schocked when I got the text and email this morning..

I did not expect to get approved so soon and was resigned to the fact that itwould probably take at least 4 months..

I am excited but not prepared..

Good luck to everyone and I hope everyone in December starts getting approved and November filers.

  3. Thanks Nik+Heather :)

Yes the Packet 3 for Albania specifies certified tax returns.

Well I guess I will stop eating for the next couple months

Anyone have any experience with the embassy in Tirana? would be appreciated

I think they want the certified from the IRS. You can call the IRS and they will send them to you......That is the only certified I know. And I think it would be for the last 3 years.....so 2009,2008 & 2007. There is no charge from t he IRS

  4. Sad to be posting here...

My husband was arrested today and has a charge of aggravated assault/felony.

(we got into a stupid argument).

    Police took his passport too.

He has no bond as of yet.

Any one know what could happen or if he could be deported? He just got into the U.S.

Why did the police take his passport? Is that legal to take his passport or did he just have it on him at the tim eof arrest?

  5. Let's not forget that Varee Bradford is not the only criminal here. In each of these cases, there was an American citizen who accepted money in return for fraudulently filing papers to bring a Thai national to the US as part of a sham marriage. They may have some level of defense because Ms. Bradford was their employer, so they can claim she put pressure on them, but they still accepted the money.

I've lived in California for nearly 30 years, and in that time I've been approached 3 times and offered in excess of $10K to marry a foreigner (Mexican girls on two occasions, and a Salvadoran girl on another). At the time these offers were made, my annual earnings were between 2 and 3 times that amount. My income was adequate to cover my expenses, and well above the poverty line, but I can tell you that $10K is a LOT of money when your annual income is that low. I said "no", but I can guarantee there are a lot of US citizens who would say "yes".

Yes I agree with you spicily with this economy some people need cash??

But for her she’s making big business from this and she’s wealthy .

I agree, what about the ones that accepted the cash from her..they are more at fault.....for accepting it. If they felt the pressure they could have found new jobs at other restaurants....Obviously it agreed with them too to take a lousy $10k, definately not worth going t hrough all this paperwork and to get involved with the government knowing it is fraud, not worth having on my record. But I am sure the ones that accepted the money will not get into any trouble..

Economy is no excuse to break the law or do things for money...........

  6. A spousal petition doesn't expire. . .that may be your only choice because police certificates, once obtained are only valid for 6 months. . .so even if you get it while you wait for the next k1 to process, it will expire and you'll have to get a new one starting a cycle. . .

He needs to figure out where the power is, supervisor, etc. . .and get that certificate. Is Kosovo one of those places where nothing gets done without a bribe?

actually its my first time ever i find someone have difficulty to isse a police certificate ..its even a silly reason BUT ACCEPTABLE to deny the Visa ....

i see u r a K1 Visa ..rather u want for USCIS till they Mail u about Intention to revoke and by that time u submit a valid police certificate to them so the case is re-affirmed

or u can withdraw the K1 and start ovr again BUT u still need to get a police certificate after all ..thts a requirement for all visas category to USA

    sorry about it

I don't see how it is acceptable to deny based on not having a document....and it is not a requirment for all visas or all countries...In Macedonia the rules were changed that the applicant only needs the Court certificate and not the police certificate........so based on that I don't think it is requirement..but yes the embassy can ask for whatever they want....

Police sertificates of everywhere your SO has lived since the age of 16 is very important and they can definitely deny you based on that. For the K1 visa to be issued at the embassy in any country, it is a BASIC requirement for which there is no way around it.

Well I never thought there was a way around it. If I thought there was I would not be sitting here right now writing of my problems of my petition being sent back or being apart from my fiance for so long......wow thanks for the telling me that it is required...I must have been in a fog....I never expected the embassy to give my fiance a visa without a police certificate...but I dont see why they cant keep the petition validated until he receives his certificate.....

  7. My fiancee and I had two interviews last year, we were denied during the 2nd. The consul told us that in the future we would receive a letter about our petition.

During April, I sent the uscis a letter stating that I wanted to cancel the petition so that I cold marry my fiancee on the 30th of may. We are now married.

We recieved two letter concerning our petition, the first reads:

THIS IS TO ADVISE YOU TJHAT WE HAVE RAFFIRMED OUR PREVIOUS DECISION ON THE ABOVE APPLICATION OR PETITION WHICH THE DEPARTMENT OF STATE HAD PREVIOUSLY RETURNED FOR REVIEW.WE HAVE FORWARDED THE CASE BACK TO THE DEPARMENT OF STATE FOR ACTION

    and the second reads:

the aboveetition has been approved and forwarded to the listed consulate.please contac theconsulate with any question about visa issuance , or if you would now like them to forward the petition to a different consulate.thepetitioner can also file form I-824 application for action on an approved application or petition, with this office torequest that we notifyanother consulate of the petitionapproval for visa prosessing purposes.this form is not a visa . when the person this petition is for enters the U.S. based on this visa, he or she will be admitted for ninety ( 90) days in order tomarry the ptitioner, and based on that marriage file for ajustment can be obtained at any local USCIS office or uscis for center. plase attach a copy of this notice to the adjustement application when younfile it. . ------------------------------------------------------------------------------------------------------------------------------------------------------------------if the petitioner and the fiance (e) DO NOT MARRY WITHIN THESE 90 DAYS,STATUS WILL EXPIRE,AND HE OR SHE WILL BE IN VIOLATION OF THE IMMIGRATION AND NATONALITY ACT IF HE OR SHE DOES NOT DEPART. AN EXTENCION CANOT BE GRANTED.IT IS REQUESTED THAT THE PETITIONER INFORMHIS OR HER LOCAL USCIS OFFICE IF HEVOR SHE DETERMINES THAT THE MARRIAGE WILL NOT TAKE PLACE WITHIN THE 90 DAY PERIOD.PLEASE ATTACH A COPY OF THIS NOTICE TO ANY CORRESPODENCE ABOUT THIS CASE.

Now my questions is if I will have trouble when I file for the k-3 petition, or if anything can be done with th k-1 petition?

I am not sure, I would think that the K1 is invalid now that you are married. Did you file the new petition? I would post this in the 221g / 601 forum. You might get better responses.

    That is strange timing.

Why did they deny you the first time?

  8. When petitions are reaffirmed, I wonder if they go through the nvc again, directly to consulate or which steps? Our case was approved and reaffirmed by uscis and sent back to consulate, but since we already have nvc case number... how does this process works. I know reaffirmations are not everyday things but anyones help would be great. I would call the consulate but they dont ever accept phone calls for visa information, but im sure we have to set up another interview. We have hope again. Thanks all .

Why did the consulate send back your petition? My fiance visa peition was returned by the cosulate also and there is not much information on what to expect.

You cant email the embassy? I am sure they would have to either send a letter to the beneficiary or call NVC, they should be able to tell you if your petition was sent back to the consulate.

I know I am sure it is a place where they want something or other but to be honest nothing has been said.. I don't know, there is a big thing going on htere where all this stuff was stolen from there evidence room..I guess drugs, guns and cash...but they don't understand how it all happened....and I dont think anyone has lost there jobs or have been suspended...So what does that tell you?

  11. Hi -

The US embassy in skopje, Macedonia finally sent back our petition to NVC for fiance not being able to obtain a police certificate.and that our approval had expired and they did not want to extend anymore...I called NVC and at first t hey told me the petition is in Skopje and I am like no they said they sent it back, then she said yes they had received it the day before and said it would go back to USCIS this week. Pretty much only gave canned responses....

Consulate emailed me and told me the petition was being returned because of lack of police certificate

Really not sure what to do? Should I just file a new petition at Vermont or wait to hear back from this one?

Should I be receiving something in the mail from NVC?

Did not think things could get much worse but they have..........

Any advice appreciated...When I first joined this site no one posted about returned petitions but lately it is becoming more common?

  12. Hi -

I finally received a response from the embassy. They wrote back saying the only reason they denied the petition was due to lack of the police certificate. They said we have to refile with the NVC?

Is this really a reason to have refile? Do you think this is worth pursuing or just give it up and refile? I am so confused.

The missing document is the police certificate. I don't think the police certificate has much worth to begin with. Also this is only because he is from Kosovo. If you read the reciprocity agreement for Macedonia itself they are no longer requiring a the police certificate due to a change in law. Fiance is able to receive the court certificate but not the police certificate.

    http://travel.state.gov/visa/frvi/reciproc...ocity_3612.html

I guess the embassies view is that everyone else got it why cant you? Well I am sorry that Playnice and I are the 1% of people that are having problems with obtaining.

Is this reason enough? I have contacted my Senator for this and they will inquire. I still have to tell them the new information I have received from the embassy. My fiance also called today and they told him there is nothing wrong with the petition nor the evidence just that it is expired due to lack of police certificate.

Do they have to close out petitions that are still open? Is there a problem with extending the petition. I am just trying to understand where they are coming from or what they are really up to?

I just hate having to refile since Vermont is so slow now. That would mean another 8 months of waiting.....

    Any advice would be great.

  13. Hi - I previously posted about the visa denying visa due to K1 expiration. I spoke with my fiance more about this today....He was more calm .

Anyway he said that the embassy did admit it was an error on there part and they are sorry??????? But they kept all the documents I sent my fiance..inlcuding evidence I sent for time after his last interview...

He asked why they arenot giving it back and they replied that they will keep it so they will have it when we refile? Does this make sense? Are those people nutty or do they know something I don't know?

  14. That is weird. Most embassies, as long as the petition is 'in progress' will extend the expiration date. Did you try to call them?

Mine didn't. They let it expire and sent it back too.

What do they get out of doing this? I have contacted my Senator and I sent a letter to the embassy by post. They replied to my email asking for an explanation. They just said.....I need to refile like they told me before.

I read your story.....sounds like mine......

  15. I have emails from them stating all the extentions and telling him to schedule another interview. They told him that they told me in emails and when I called to schedule the interview that the petition is expired and has been expired...They have never said such thing. They did not even look at the information that he brought with him.

Why would they schedule and interview or allow someone to schedule an interview with an expired petition or even allowe them in the embassy with an expired petition.

I already sent them an email this morning....I am going to send another one tonight and attach all the copies of the emails....Are they really that stupid and it gets me mad that they are saying they did all of these things.

The same embassy is pulling the same thing with Playnice.

    Any advice would be great......

  16. My fiance went to his orginal visa interview on March 4,2008. He was issued a 221g due to not having a Kosovo police certificate and they wanted more proof of relationship.

He still has not received the police certificate and I continually contacted the embassy for extentsions. This last time I contacted them they told me he needs to schedule an appointment and bring more proof of relationship and explain why he has not received the police certificate.

We called and he was scheduled for today. He was told the peition is denied due to expiration. I don't have more details yet from him just an email early this morning telling me this.....

I have emailed the embassy for an explanation and to ask them to review the petition and that I asked for an extenstion to the petition previously.

This whole thing has been a mess due to this police certificate. He can't force them to give it to him. We have called everyone in that goverment but they all say there is nothing they can do.....

What do I have to do now? What are my options at this point. Do I contact my senator or congressman?

    Thanks!!!!!!

  17. I'm getting ready to file my AOS PACKAGE but i have few questions about my taxes, why do they say on some of the taxes...COPY ONLY DO NOT FILE? Or should we just copy these and send them?

    Will it be a problem?

Did you file electronically? If you file electronically than you do not have to mail in your taxes. Do you have a confirmation letter from that the IRS accepted and your tax return? You should also have a confirmation letter.

  18. you've been waiting since March 4th for the police certificate?

Perhaps your Representatives can contact the Consulate on your behalf?

    Did you call DOS?

Do you know of any lawyers there that work with the Embassy?

Yes.....there was a change of issuance of the certificate....I have not contacted anyone on our end except the consulate. I don't think they can do anything since they have not done anything wrong. This all started with not having the UNMIK certificate. Than in waiting for that UNMIK was not offering them any longer. Than it went to the local police. Originally the Embassy did not want the local certificate since they had UNMIK there. Now that UNMIK is not offering the police certificate the loccal one is okay.

All the embassy says is that they have not seen this issue before. When there another person on this site with the same problem. Since there are like 5 people on here with SO from Kosova on here. I am assuming it is a problem. It is difficult since the people from Kosova have to interview in another country.

I don't think the US government is going to change there guidelines because the Kosovo police does not want to do there job.
