  1. thats odd, when my husband adjusted his status, on the form it indicated that they will

    forward his name to the selective service automatically. Are you positive, he isn't registered?

    Did you go to their website and he wasn't found in their database?

    If you go to page 5 of the AOS application, you will find that statement about them

    being authorized to submit your husband's name to the selective service.

    Yes, I did check their database, and he wasn't found in their database. So, I think I'll have to call them and ask for a letter or something.

  2. I have a question regarding Selective Services. My husband entered the United State at the age of 25 years and 6 months on a K3 visa. We filed for adjustment of status and he was given a permanent resident status at the interview 5 days before his 26th birthday. Now he has turned 27 years old and applied for financial aid. The financial aid asked him if he is registered for selective services and he is NOT registered. We didn't know if he was ever supposed to register for selective services or not. We didn't even know about this untill we filled out FAFSA. Also, Will he be denied for U.S. Citizenship because he didn't register when he was 25?

  3. The directions state to send the I-130 and wait for the NOA1 before sending in the I-129f. But many VJers sent both forms together to CSC successfully this summer. I have only read of one person getting there I-129f returned. Going through the Texas Service Center may or may not work, but if they only forward your I-130 you have not lost any time. It seems worth the chance for the amount of time saved if they accept them together.

    Thanks for the information. I also contacted my lawyer, he said to file them seperate too.

    I Need some help here. I heard that I could send both I-130 and I-129F together. And yes I want to choose a K-3 route so please don't tell me that CR-1/IR-1 is better visa. I've been getting different answers on where to file. I live in Texas. And It says to file I-130 to Texas Service Center. Now Can i send them both I-130 and -129F together to Texas Service Center or no? I called the USCIS office, but the person who i talked to didn't know much about it guess. I'm really frustrated all of my forms are done. And I don't know what to do. Please anyone tell me the correct information. Thanks.

  5. I was looking at the Poverty guidelines chart. And it has 100% and 125%, I don't understand which is used ??? anyone know it ?

    You need to use the 125% guidelines. 2007 Poverty Guidelines

    I'm sorry, I assumed you were to use the 125% guidelines...because MOST OF US do. But you need to use the 100% "For Sponsors on Active Duty in the U.S. Armed Forces who are petitioning for a spouse or child".

    Will it be almost the same for 2008?

My question is that if he applies for it and the immigration officer returns his application without processing it, and tells him that he is not eligible. Will he get his processing fee back or not ?

    Well, you said that it was returned by the immigration officer and told that they are not eligible, that automatically means it was processed, so no processing fees will be returned. The only way to get a full refund is for the applicant to withdraw the application PRIOR to any processing whatsoever.

  7. No, the only fee that is returned is the Right of Landing fee. All other fees are non refundable after the case has been processed.

    Yeah i understand it's after processing. but what if the application has not be processed and they just retrun your application ?

  10. When filing for a K-3 Petition. You send the I-130 first right ? do you have to specify in that form that you want to go on K-3 route. And when you receive the NOA for I-130 does it tell you to send the I-129F along with the NOA ?? How do you know you have to send the I-129F with it ?

  11. What is the difference between IR-1/CR-1 and a K-3 visa?

    For both of these do we fill out an I-130 form ??

    I am confused on whether I should apply for a K-3 or IR-1/CR-1 petition. I've also read that people who apply for a K-3 automatically applied for a IR-1/CR-1 and can choose IR-1/CR-1 if it's faster than the K-3. I'm not exactly getting what is meant by that.

    I've seen people filing I-130 and than they file I-29F for a K-3 visa petition. Will it be the same for me, because I've applied for an I-129F before for my husband when we weren't married, but he was denied the visa.

  12. Yeah I get that. But when filing a petition what else do you have to send in addition to the marriage certificate. That proves a mutual relationship?
    Pictures from wedding and copy of marriage cert are enough.

    This question comes up often for the I-130

    Your evidence is acceptable, they are not as critical of bona fide marriage until you file to lift conditions on a green card in the USA.

    I haven't seen any evidence that anything more than a marriage certificate is required when using the I-130 to petition for spouse to apply for a visa, in cases where the couple has never lived together in the same country. These cases do however, require more bona fide relationship proof at the time of the visa interview but usually it is in the form of evidence of visits and communication.

    Yes, I'm familiar with the new I-130 instructions. I'm also aware that the I-130 is multi-purpose form. The only optional documentation available to most couples who never lived together in the same country is affidavits. Just what would these affidavits swear to, that the people attended a ceremony and/or party. Newlyweds like these usually don't have evidence of bona fide ongoing relationship when they file their petitions. USCIS knows and accepts this.

    So, no other prove is required by USCIS just the marriage certificate and wedding pictures are fine. I got married 10 days before I got back to USA. But my husband and I used to see eachother everyday before getting married. So in this case there is no other prove requrired right ?

    Letters, emails, photos, cards, plane tickets, or basically anything to prove that your relationship is real.

    I just got married this summer and I want to apply for K3. My husband lives in Paksitan. And I am a US citizen.

    I don't know how long is the K3 process. The problem is I'm a student and I work part time and i don't make enough money to satisfy the affidavit of support requirement. I was thinking of making my parents as my Co-Sponser. Is that possible ? I am also thinking to apply next month, and i'm going to visit my husband again in summer. . I want to be able to go to the interview with my husband. My question is that will he get the interview date in summer if I apply next month ? Anyone who had applied for K3 please tell me your experience. Thanks
