  1. Can my spouse adjust astatus in the US wile awaiting NVC disition in forign country. Or can she finish the interveiw part wile she is here on visit. say she came over on the visa waiver program. please help

    Did you marry while she was here in the US? Do you currently have a petition being processed by the NVC? I assume you have USCIS approval since you said the NVC is processing? If this is the case then she will have to return to her country for the interview. If you were married abroad and she traveled her while you are married there is no way she can adjust status here, she will have to return for the interview, get her visa and then adjust status if it is the K3 you petitioned for. If it is the CR1 she will get her greencard after her interview and she returns to the US.

    After seeing your timeline, yes she has to return to here country for the interview, make sure she does not overstay her I-94.

    yes we married here ...can she still come visit..?

  2. I was wondering if anyone had any experience with this.

    Right now Wife's I-130 visa is still pending but I was thinking about applying for a spouse visa to live and work in Japan for a year or two until her visa is completed. Once she gets her visa we move back to America. I hear in Japan I could get a Spouse visa within a matter of months.

    Is that possible or does that just screw everything up because I need to show I can support her with my job?

    i dont have any info for you but my wife is also jappanese and have pondered moving there for a couple of years my self. Any info you can send my way would be great. thanx and good luck .ho na na

    i sent a money order but i sent away for the copy and same thing i cant read it i was blurry and unreadable

  4. Wow vbtbmrt, thats crazy that the USCIS site never updated you and you are in NVC right now. It could be a good thing for the rest of us though. Meaning that maybe oneday we'll just up and get an NOA2 like a week after our cashed check cause they are so backlogged with receipting.

    Another question to ask ourselves is this:

    If they are not sending our I-130's to the Chicago lockbox for data entry and they are holding these petitions are California and Vermont to processing just a receipt notice, how long will it take them to catch up?

    If Chicago is going to start processing receipt notices for applications received after December 3rd, why should these guys get their applications in the system before us? That is certainly not fair and I will really be pissed and mad at this.

    I have been waited since August 14 and if the Chicago Lockbox is going to be faster, then so be it. But I do not think it is wise nor fair to have applications just mailed in December put ahead of our receipt notices.

    I totally agree and would comment but the marshmellows one still has me chuckling here at 5:55am in the morning, omg too funny.....at least we can find a moment of sanity or humor in this gigantic mess. What I dont understand and maybe someone can answer for me since I do not see any law ( whatever they are now with USCIS) that states that getting your fiance here for a wedding late next year is more important to process than getting your spouse here. Dont take this wrong, but all we are LOOKING FOR IS A RECEIPT!!!!!!!!!!! :angry:

    My complaint today is going to be a follow up letter to my Congressman, and since I do not have a receipt number, I am just pointing out to him these issues, its like getting married to someone from afar is a huge slap in the face. Someone said to me recently, USA is anti immigration right now, except if its illegal. Somewhere in that sentence an oxymoron has been created but it goes along with Jumbo Shrimp, IT DOES EXIST.

    Again, use whatever resources you have to deal with this issue, if you are comfortable in waiting it out for a few more weeks, and try to enjoy the holidays without your mate, then do so. If you are so confused as most of us, then research or if you are super pissed off like a few of us, then do take matters into your own hands and fire off a letter to Senator, Congress person or even your local deli. I will tell you this........you do get alot of frustration out of the system by doing it.

    Again, none of us are of the same make up, and for that we are so unique......I will applaud each members action here as long as it helps them through this first god awful step.

O.K. guys....my morning has been on the phone so here is what I have found out.....First I did my obligitory call to USCIS customer service...I use that term lightly....and I told them that today I was at 170 days.....on December 1 I will be at 180 days and past there stated service dates of 6 months....she told me that on 181 days I can make a formal request for service.....I ask what recourse do I have as a customer who is getting bad service from this agency has....she said after they are 30 days past the 180 days making it 210 days I can put in a formal complaint which they have 60 days to respond....so I said o.k. and moved on......I called the lawyer we used and this is where I got the most information.....It took me a while but he finally came on the line to talk to me....He told me that his office had gotten at least 30 applications filed less then 45 days ago approved from Vermont....I am thinking that couple that we got from 2 weeks ago where from that group.....He said the immigration lawyers association is meeting with VSC head counsel today and hopeful will bring back some explanation of the violation of there own policies in processing these applications out of order...even if they are for training....He said that there were about 1000 pending application that are within 20 days will be outside of there service targets for K1's which then triggers some kind of internal review......He suggested that certified letters to the director of the service center from as many people as possible be sent diplomatically complaining about....1.length of time to process..2.priority of famly based application due to service to American citizens instead of work or study visas for non citizens...3. the apparent violations of there own policies of taking applications out of order to either decrease there wait time ratios or as they say training....He cautioned me to not be aggressive in the letters just ask for reason for these breaches of policy.......He also asked that we contact our Senators and Congressman and ask the same questions.......so I called both Senators offices and faxed inquiries to them and to my Congressman......I am telling you they all say the same thing about this agency......I am also composing a letter to Mr. Gonzalez and the ombudsman for USCIS.........Can you guys help.........I know some of you all are moved past my stage but this is not getting any better very quickly without pressure.......Lora

  8. It is very frustrating to deal with day in and day out. When you see other couples who are together it makes you even more sad. You just have to try and keep your head up no matter what. I will never take my husband for granted after he is finally here with me.

    yes i feel the same way i will never take my wife for granted either ......i can only imagin us getting stronger like we steped into the ring with a heavy weight and made it we are the new generation of imigrants...... the colombian japanese conection our family trees are growing and taking turns no one imagined not eaven me ...i love my life ...i could never take the ez way....i miss my wife

    It’s getting very annoying to wait until Friday when the USCIS update there processing time to find no change. It’s been 5 weeks since Vermont has made any progress in the I-130 form.

    I am becoming very impatient waiting for the I-130 Receipt, so my question is this:

    Does anyone knows what will happened if I send the I-129F form without waiting for the I-130 receipt and send the Postal delivery proof instead as proof of I130 submission ?

    Will this create any confusion or delay the process or just won’t heart to try?

    Thanks for any one who can help with this question and good luck for all VJ user waiting to join their lovers

  10. mailed my I 130 july 27 to VCS..then I called after 90 days they put a trace on it. I was tyold some one personaly would look for my case...greaaate so gave me a ref num and told me to wait a little more ....so i did two days later i called and a very honest phone person told me that they cant do the search with out then having have had imput my imfo and having had giving me a RECEIPT num.....so any advice please help :help::help:

    I had this happen to me in 2004. I contacted my local Congress office for the area I lived in and someone in her office was able to contact the service center and talk to someone. They found out my paperwork was just siting on someones desk and not taken to my case worker. Try doing the same trust me they will help you because they want your votes. I even got a call on Christmas Eve telling me what they found.

    If you have sent a money order, you could check to see if it has been cashed. You could call the customer service of the money order company and give the money order number they will be able to tell that. (hope you made copy of it)

    If you sent a personal check you could check it by checking your bank account. they usually say that in the back of check you could see your case number.

    In my case, I called them and gave my full name and alien number then they gave me the receipt number.

    since it's been 90 days now they should have cashed.

    no not cashed did the money order thing at the post office i call every day....

    I just got off the phone with USCIS customer service to report that I haven't yet recieved an NOA1 after 90 days and they gave me a referral number after taking some info about me and the fiance with instructions to call back after 30 more days if nothing changes. I just realized with horror that I gave them the wrong birth year for Pim (fiance) as one of the pieces of info they asked for. Will this cause any problems? I know I'm probably being paranoid, but I definetly don't want anything to hold up this process anymore than necessary as I'm sure everyone here understands.

    Can anyone soothe my worried soul?

    Also, can anyone tell me what this call will actually do for my case?

    hey im on the same boat but you should call and ask if they could do the SeaRch without a receipt num......i was told no so...i was told to wait a little more i sounds like the whole system is about 3-4 monthes behind...kinda sucks sorry.... :blink:

  13. I just looked today like I look everyday and I saw that both my K3 and K1 visas processing times have decreased in wait time by two weeks!

    Are they catching up from the rush of applications before the July fee increase? This is much better than looking every week and finding my processing time increasing! I know it's just two weeks but it's hope! Anyone else noticed the same decreasing?

    when you call on the 90th day and they ask you if you received your mail yet say yes and or they will make you wait one more date ... any late july early august filers have their cheks cashed ..?

    What Service center are you going through. Has your check at least been cancelled? 90 days of NO info is crazy. I just filed last week and I would hate to think I have to wait til mid January just to get some sort of info. I might just lose my mind then.

  16. USCIS VSC received our I-130 package on 08/03/2007. Nothing so far and as of yesterday and the new update on the receipt notices VSC is still stuck on 7/29. So, still no movement. 4th week in a row and I don't see them moving anytime soon. This is starting to become very frustrating.

    hey can you let me know when you get your Noa 1 cuz i havent recieved mine yet either and we filed around the same time ...olso do you know of any other people that are on the 3 month waiting for NOA 1 to come in
