  1. When you say you will move back "for a while", do you have any idea how long for? If you are staying out for longer than a year, you will need to request a re-entry permit. These are usually granted, but after 2 years you may need to move back if you do not want to loose your green card. Another option would be to let the green card go and then re-apply with DCF when you are ready to move back; it's an easy and quick process (see my timeline).

    Awhile could be anything!As long as it takes.It definitely could be a few years though.

    Did you have a greencard before? and then moved back here and re-applied with DCF?

    So what happens if I come back to visit family here once a year.Do I enter as a tourist?

  2. I have a 10 year greencard that is valid until Dec 2017 .

    Anyway due to a number of reasons,(family illness abroad and lack of work here in the US) me and my US citizen wife and child are thinking of moving back to Ireland for awhile.

    We are going to rent out our house here in the States in the meantime as we intend to return when the time is right.

    What exactly is the procedure to do this and not lose my Greencard?

    What's funny is, if you would have sent your I751 correctly some time in January you probably would still be stuck at TSC... now you already got approved with the CSC transfer.

    Yeah I know! As it turns out I'm lucky I was late...

    Update:

    I got my green card in the mail today (12/20/2007 )and my "Welcome to The United States" Letter..

    I am so relieved that this process is over..

    As it turned out,it only took from 09/29/2007 to 12/20/2007 !! 81 days start to finish..

    I am still counting my blessings.

    Once again thank you to everyone for your time and good advice..

  4. Hi, for those of you who have already been through that stage of the Removal of Conditions process, how long of a gap did you have between the date you received your NOA1 and biometrics appointment letter? We got our NOA1 on 10/27 and have not heard anything since.

    I've spoken to two friends (both VSC, both in Newark NJ district office area) who went through the same process recently and got both letters within a week or less of each other.

    I received the biometrics letter 3 days after the NOA1..

    Im getting really worried here..

    My package was received on 09/29/07 by TSC,but the check still hasnt been cashed ,as of today 10/19/07..

    Is this normal for TSC?

    On a positive note ,I just found out that my wife is pregnant.We're stoked.

    Its a pity I didnt have that info when I submitted my 1-751 though...

    Congratulations to the parents-to-be!

    As for the NOA1/check cashing: looking at the forum it appears that it can take anywhere from 1-2 months for the check to cash and NOA1 to arrive. I think some of the added wait time for recent TSC filers is that the file has to be processed through TSC mail room, transfer to CSC (there probably gets to another mailroom)..... So nothing to worry about at this moment.

    Ok, Phew! I'll relax a bit for now...

    If there is I cant find it.

    Im guessing:

    NOA1= "Notice of action 1 " right?

    And I assume CSC is "California Service Center"..

    So are all the Texas files getting transferred to California lately?

  7. I'd certainly send it out BEFORE October 1. Otherwise your explanation with the date confusion wouldn't hold, as you would have obviously not even made your "assumed" deadline.

    Im working on it right now and hope to get it out tomorrow.

    I have every intention of meeting my assumed deadline.

    To the OP:

    Not that lying is advised in general, but definitely do not lie to the state! Get those forms filled out and in the mail YESTERDAY. You may want to include an explanatory note directly before the I-751 in the packet apologizing, and explaining the circumstances. Don't delay any longer by wondering what you should do and such.

    It wouldn't hurt to call a couple of immigration lawyers and explain the situation and get a quote as to how much it would cost for their assistance. However the more that you know (hey, you should know a lot now that you have access to information here @ VJ!), the easier it will be to explain your situation to a lawyer and probably the lesser fee they will charge you because you aren't coming to them saying "help I'm totally screwed with some immigration problems!" (read: debacle), rather you are saying "Help, I was a bit foolish and mixed up the date in filing my I-751 petition. I submitted it on X date with all of the requisite supporting documentation and an explanatory note describing and apologizing for the mix-up. Is there anything else that I can do that will help me remain on the path to LPR status?" (read:a simple question).

  8. Many have success if the reasons for late filing are reasonable to USCIS. If you don't have money for a lawyer, how about sending that I-751 in post haste, with a well worded explanation for its tardy submission, and engaging an attorney if something should go awry?

    Thats exactly what Im considering doing.

    Any suggestions as to What I should use for my excuse for being late?

    The truth ? ?(That I sometimes forget the format in which we write the date over here!)

    I dont think they will consider this a reasonable excuse for being late.

    But I would prefer to be honest than make up some crappy story..

    Any Suggestions?

    The truth is always advised. Explain that you confused the date, due to the customary practice of featuring date and month sequence differently in your country.

    :thumbs: That make very good sense, this will be understood. Jan 10 in the USA is 1/10 but in many countries like Europe, and I Know China 1/10 = October 1

    One penalty you are paying is USCIS raised the fee this past July, if you had filed at the correct time you would have paid considerably less.

    I just noticed that..They really jacked the fees up alot didnt they.

  11. I would involve a immigration lawyer at this point, and file the I-751, USCIS has been known to accept late filings, but they can also start deportation proceedings, this is why you may want to have a lawyer handy.

    I just found your forum today.It is a wealth of information.

    Lets hope someone has some advice and can help me out.

    Here's my situation.

    I am married happily to a US Citizen this past 3 years.All is going well but...

    My conditional Green Card expired on 01/10/07 !!

    And I just discovered this today.

    The last time I looked at it (permanent resident card),was sometime last year and for some reason

    I made a mental note that I needed to renew it in september 2007.

    I realize now that I looked at the date 1/10/2007 and was thinking "euro format" at the time(that happens alot!)

    and thought that the card expired October 1st 2007..

    I am kicking myself for bring so stupid.

    What do I do?

    Is there any hope for me,as Im sure stupidity is not much of an excuse for being late?
