  1. The questions I have (for now) are, what are the requirements for the photographs that have to be attached to the G325A?

    I will need a co sponsor, can that person be a greencard holder and not a U.S citizen?

    Not totally sure but I imagine if that person is resident and working then yes.

    If you have an address in the states then you should have no problems. We had the same problem. We opened a new account and got a letter from our folks stating where we would be staying. Providing copies of recent tax returns and previous years returns helps a great deal as it proves you have abided by US law. The consular officer made a point of telling us that.

    And last of all, although it is some way off, can I request that my husband's medical and interview are on the same day and should I request this on the I130 when I send it or at a later date? As we live in Scotland, it is going to be really inconvenient for him to have to travel to London twice with work etc.

    You can ask! I know of cases where the medical was done after the appointment. Call the Knights Bridge doctors, see what they say. They are on the internet. I was worried about having to travel twice but it’s an easy journey and both the Docs and the Embassy are short walks from Bond street Underground.

  2. I attended the appointment June 5th 2008 with old style police certificate. No problems. If there is a problem then and you do not have all the required forms / proof at the interview then you will be given a blue form with all the required documents ticked. This form has the Embassy’s courier’s direct number to call once all forms are ready. They collect from your and then return your Visa to you, if granted. Costs £24. ( Watch it though as the courier tries to sell you the timed service at £45!) I had to provide proof of wifes domicile. They collected the proof and I had my visa in no less than 6 days.

  3. We have filed now using forms 1040 and 2555EZ. The statement from the consular officer asks for " Copies of form 1040 and all supporting schedules, IRS print outs are acceptable" I understand that I can get the IRS to fax them once the tax returns have been processed. I was hoping just copies of the forms would be accepted as I already have them. Who knows? I guess its best to send them the IRS printouts to be sure.

    If it’s not one thing it’s 10,000 others! LOL!!!!

    Oh and thanks, I changed the profile to show DCF.

    IRS printouts are also known as simple transcripts, IRS can fax them but I suspect only to US numbers.

    When we did out visa interview I used IRS transcripts with affidavit of support. Copies of the returns should be fine.

    NOTE IRS has the originals anyway, and all you do have are copies.

    My in-laws can post the transcripts over. The returns should be with the IRS on Friday. I suppose I shall have to wait for them to be processed. The letter does only ask for copies and then states printouts are acceptable. I’m tempted to send just the copies but is it worth the risk of creating further delays?? I’m supposed to call once I have the documents and the SMS courier will collect. I think I shall wait until I have transcripts…. Crumbs I can’t make my mind up!!

    I would use a copy of 2007 return, and transcripts from 2006, and 2005.

    I think you are right. They have asked for copies so that what I will send. I was unsure if they wanted copies from the IRS. Problems solved.

  5. File the returns late.

    US citizens may be exempt from paying tax on foreign income, however are NOT exempt from reporting this to IRS by filing a return every year.

    IRS can provide simple transcripts, this is what the counselor officer is asking for.

  6. So so close! I spoke with the Consulate officer in London and she advised that everything is in order and they are happy except for my wife’s domicile. The officer has asked for documents from the IRS . As my wife has been working in the UK we never thought she would have to file for 2007. Doh! We have now, and just in time as she gets to the 16th of June. The officer advised that IRS print outs are acceptable along with supporting schedules for 2006 and 2007. Now I assume that these are simply copies of the forms 1040 and 2555EZ along with copies of pay slips etc that we filed. Can anyone confirm???

    Some good news, our baby girl Olivia had her interview in London and she has now been issued her US passport!!!

    Just this damn Visa holding us back now!!!

  8. Ok, since this is all so complicated we decided to fill in ALL the forms.. My folks have filled in both I-864 and I-864 and I the I-864. Simple. As I am my husbands dependant in the Uk I not have to file a tax return. I have previous tax returns from previous years etc but none since being here in the UK. We have bank statements from my US account and other proof of US domicile. Im confident we will be ok.

  9. You don't have to return to the US - DCF is designed with cases like yours in mind. For domicile, he can open an account, pay his taxes, etc. You should be ok.

    remember you need to also file the I-864 even if you have a cosponsor.

    I have my I-864 ready and my parents who reside in Florida are sending over their I-864A forms with tax returns etc. Surely we only need prove my domicile?? I’m not sure what you mean by he can open an account, pay his taxes He lives and works in the UK and is English. Am I missing something? Do you mean when we return to the US?

    Are the parents members of your husband's household? Do they live in your husband's home? I-864A is only used by members of a sponsor's household. His parent needs to provide an I-864 as a Joint sponsor, NOT I-864A.

    Who May Be Considered a "Household Member" for Purposes of This Form?

    For purposes of this form, a "household member" is:

    • A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult

      child, parent, or sibling;

    • A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;
    • The intending immigrant, in certain circumstances. (See "How Can the Intending Immigrant Be Considered a Household Member"?)

    Ok , I think I have confused you. It’s my parent’s household. This is my main residence in the US. This is where we will both be living when we return.( We have been given a plot of land to develop but it still belongs to my folks on paper at present)

    Does that make better sense?

  11. However, it is not absolutely necessary for the petitioner to return to the U.S. (I didn't - we were living in Canada). You just need to prove that - you intend to reestablish domicile no later than the intending immigrant.

    Well returning is not really and option anyhow. We had a baby here in the UK. As we have a place to live in Florida then I read that it is infact proof of established domicile. So from what I understand then I need to sponser my UK husband on form i-864 and my folks are secondary sponsers and use form I-864A.

    This is so complicated!!!!

    All seems to be running smoothly but we have some queries over the I-864. I live with my UK husband in the UK and he currently supports our family. Obviously neither of us have jobs in the US to go to so my folks back home in Florida have filled in the I-864 with their 2007 tax returns, agreeing to support us. Their income far exceeds the requirement.

    Is this acceptable as I cannot see an alternative?

    Does anyone have any experience at filing the I-130 at the London office?? We posted ours on the 5th October 07. They have taken the payment but that’s it. From what I understand they send you acknowledgment of the date filed?? Any ideas?
