  1. How frustrating for you! Regarding tuition fees, I have looked into this for Nevada as I will be facing the same situation. They will allow me to have the resident rate based on my husband living in NV for over 20 years but I will have to show proof of HIS residence along with the marriage licence. I think they want a joint tax return also. I would try again and see if you can speak to someone else about this. Good luck.

    Thanks for the information.

Has anyone from Texas had any issues like this?

  2. Hello everyone,

My wife and I went last friday to my local Department of Public Safety in Garland, TX (suburb of Dallas) to test for her instruction permit. They turned her away and told her she is unable to test because her EAD is valid for less than one year. She was issued the EAD on 6.12.08 and it expires on 6.11.09 (364 days). Has anyone in Texas encountered this before? The requirements for a driver's license in Texas are outlined here: http://www.txdps.state.tx.us/administratio...equirements.htm

"Unexpired Dept. of Homeland Security (DHS) or US Bureau of Citizenship and Immigration Services document issued for a period of at least one year and must be valid for no less than six (6) months from the date presented to the department with a completed application."

If this is correct, it really sucks because this means she will not be able to obtain an instruction permit/license until she is issued her permanent residence card, which could take God knows how long.... I applied April 7th and the case hasn't been touched since 6.20.08.

On a related note, I also recently tried to get her enrolled in credit classes at a Dallas County Community College District college. The college staff told her and I that she will have to pay nonresident tuition fees because she has not lived in Texas for a period of one year. I thought that, because she is married to me (and living with me) and since I have lived in Texas all my life, she assumes my residency status for tuition purposes. See the Determination of Resident Status section at the following link: http://www.thecb.state.tx.us/Rules/tac3.cf...mp;Subchapter=X

"(B) The following non-U. S. citizens may establish a domicile in this state for the purposes of subsection (a)(2) or (3) of this section:

    (3) an eligible nonimmigrant that holds one of the types of visas listed in Chart I and incorporated into this subchapter for all purposes; (K-1 visa is listed on the Chart)

    (d) A domicile in Texas is presumed if, at least 12 months prior to the census date of the semester in which he or she is to enroll, the person owns real property in Texas, owns a business in Texas, or is married to a person who has established a domicile in Texas. Gainful employment other than work-study and other such student employment can also be a basis for establishing a domicile. "

My interpreation of section (d) above is that because she is married to me and because I have established a domicile in Texas, she should be considered a resident of Texas and should pay the tuition rates of a resident of Texas.

Any insight or advice would be greatly appreciated!!

  3. Hello all,

I have a question about the fees that are required before the K-1 interview takes place. As far as I can tell, since my fiancee is classified as a K-1 nonimmigrant, she will only pay $131 for the processing of the DS-156K application and $85 for the biometrics. Will she also have to pay processing and security fees for form DS-230?? She did provide a completed DS-230 (part I) in the packet 3 she returned to the consulate, but in the packet 4 paperwork she received back, there is no mention of a fee requirement for the DS-230, only the $131 for the DS-156K. I also have not received any indication of a DS-230 fee requirement directly from the NVC. She is a national of Laos.

Also, I know that a medical examination is required, but are vaccinations also required before the interview, or can they be put off until after she arrives in America? According to the U.S. Department of State's website, vaccinations are optional.

    Any clarification is greatly appreciated!!

    Does anyone know..?

  6. Hi Zee,

How did you find out the typical wait time for your embassy? Is there a website I can check out?

    Thanks!

I found out from looking at timelines for the embassy here and I also called the embassy.

I suggest just doing a quick timeline search for your embassy for an idea of how long the wait is :)

I'd like to do a timeline search but there's nothing for the one in Vientiane, Laos. I guess I'll just have to call the embassy directly.

  7. I just got off the phone with NVC. They received our case yesterday!!!!!!

    CONGRATULATIONS!!!!!!

I HOPE MINE WILL COME SOON

    Great news! Congrats, Aaron!!

I received e-mail confirmation that my petition was approved on the 11th of October, and received the paper NOA2 on the 15th. I have been calling NVC and using the automated system to check if they have received my petition. Everytime I try to talk to an operator it says that all operators are busy and then returns me to the main menu. I noticed that the automated system does suggest calling back after 6PM EST to speak with an operator, which I have yet to do. Do you have to call back after 6PM to speak to a living, breathing person?

  8. Maybe if we are lucky, USCIS will start sending petitions to NVC in a timely manner. Doesn't hurt to dream

Ever feel like May filers are getting SCREWED???? All the petitions before us were approved in less time. All the petitions before us got to the NVC in less time. Tomorrow I'm at 35 days and still waiting to be sent to the NVC. That's FIVE weeks. And the time seems to be increasing. I called CSC again today. She was actually pretty helpful and sympathetic even. Doesn't make any difference though. They STILL haven't sent my petition yet. It's sitting in a freaking warehouse because their data processing contractor is LAME. She said it's typically been taking 4-5 weeks....but obviously it's taking longer :(. And she said it could take another 2-3 weeks at the NVC. Christmas with my fiance might take a miracle...

Sorry to rant like this, but I think I'm at my wits end :help:

If anyone has any luck with a senator or congressperson, let us know! I haven't heard from my senator yet, but I might try another government official and see if I get anywhere.

My soon-to-be in-law has experience with the fiance visa process and he says that the only way that you can get anything productive out of your congressman is by seeing him or her in person and requesting that they call the immigration services directly. He told me that calling them or by faxing/mailing a letter to them typically does not yield timely results.

  9. It took about 2 weeks give or take for CSC to get the petition over to NVC but once it was there it took 2 days for them to get it processed and shipped off to the embassy.

I don't like to say 'be patient' because after what all of us have been through with this whole BEING patient thingy it's hard to keep hearing it so I will say this instead, IT WILL HAPPEN! :)

In the meantime start looking into what you need for Packet 3 so you can have that all ready to go, wish I had. We've had Packet 3 for awhile and have come across all kinds of red tape trying to get certain forms and such. So save yourself some grief now and get the necessary paperwork ready to go!

    Ever Hopeful,

    Annette

Is 2 weeks the norm for the time it takes for the approved petition to get from the USCIS service center to the NVC? Also, can you use the automated NVC phone system to accurately check the status of your case, or is it better to speak with someone in person? I have been checking the system by following the automated prompts, but would like reassurance that the voice system has the most up-to-date information about my case.

  10. Thanks for you kind words. Now that I think back about my phone call I think the person on the end of the line was screwed up on their estimate. The 6 months is their time frame to approve K1 petitions, not the time period to send them to NVC. Second, the lady mentioned the delays in sending people receipts as if this actually applied to me and my current status. I kept reiterating to her that I was approved and I was not one of the people calling waiting to be approved by them. Oh well.

Part of my job is customer service, and if I came close to treating a customer like I was treated today then I wouldn't have a job.

WHERE DO THEY FIND THESE PEOPLE!!!!?????

Dude.. I'll fly down there and hand deliver my packet to NVC.

    Hi Aaron,

I called the NVC today as well. They said they don't have a record of receiving our petition, yet. I just said thanks and hung up. The lady who took my call didn't sound too pleased so I didn't even bother asking any further questions.

You and I have the same NOA2 date so I guess we're back to the waiting game....again... :(

Keep us updated if you hear anything.

    ~Erin

I can hardly wait to get my NOA2 (I am at day 145), so I can get back in line and wait for my petition to get to NVC. How insane is this process!!!!!!!!

I sent my petition to the TSC on the 20th of May and got approved 144 days from filing, so your approval must be right around the corner. :) Hang in there.. :D

  11. Well, after more than four long, arduous months of waiting, I received this message today from USCIS:

    "Application Type: I129F , PETITION FOR FIANCE(E)

    Current Status: Approval notice sent.

On October 11, 2007, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service."

I feel as if a 10-ton stone has been lifted off of my body!! This is so awesome!!! Thanks to all for the support through this process, and I wish all of those that have yet to be approved a speedy approval and completion of this process!

    :dance::dance::dance::)

  12. WOOHOO!!! Finally! Got a touch today that was not in response to a phone call from the day prior.

I sure hope I get an approval soon and not an RFE. :crosses fingers: :D

hello,we will be planing to call friday morning..i would like to ask what no. to dial if we call using RFE tricks...THANK YOU SO MUCH

The number to call is (800)375- 5283. Press 1 to continue in English, 2 to skip the prompt, 2, 4. Then I believe the automated system asks for your receipt number. Put that in, then confrim it, and then you should be transferred to the service center that is processing your petition. In my experience, the representative then asks you to confirm your receipt number. The two times that I called, I told the representative that I had been having some issues with returned mail at my address, and would like to confirm that no RFE or other information has been sent to my address. Both times, I was told that my case is still being processed.

On another note.. for those approved today -- did you guys get your NOA2 via e-mail first or snail mail? Also, did you receive any touches beforehand?

  13. Oh my gosh----I GOT A TOUCH TODAY-----FINALLY----I DID CALL CSC YESTERDAY, SO IT'S PROBABLY FROM THAT, MAAAAAYYYYYBEEEEE, JUST MAAAAAAYYYYYBEEE WE WILL HAVE AN APPROVAL SOON!!!!! The ever patient Alane and Ramzis

I don't at all mean to burst your bubble, but every time I have called I have gotten a touch on the following day. For example, I called yesterday around 3:30PM Pacific time and got a touch at around 11:30AM Pacific today. Either way, I hope you and I both (and everyone else that has been waiting far too long but has not yet heard ANYTHING) get approved soon!! Patience is a virtue, as it's said..

  14. I GOT A TOUCH TODAY!!!!! FIRST ONE EVER!!

:innocent: Sorry for my previous post USCIS officer, just frustraed :innocent:

Please, please, please, please send me an approval today! That 12 pack offer still stands!!!

    Bundy

    Wow!!!! I smell approval!!!

    Yours is at Cali right?

Yeah -- congrats!! I would like to know as well.. did you case get transferred to CSC, or is it still at the TSC? I sent mine to the TSC originally, and USCIS forwarded it to the CSC.
