Hello everyone,
Can you share a story when you use your F1 OPT income to meet the requirements for I-864 and was approved (No RFE from the USCIS) and your greencard was approved? But if you did get a RFE for I-864 & couldnt find a joint sponsor, what did you do?

Current income is what your expected income is, not from the tax return. So 55k is the one for you. For your income to be accepted, you will also need a statement from your employer mentioning your employment with at least the current annual income will continue after you get the GC.
Sorry i made a typo. I meant the letter says "Her annual income is 50k..." (Not 55k). So i should use that gross income (50k) before any taxes/ deductions? After taxes & deductions it will be 45k

Hey all,
I'm a F-1 student currently on OPT with OPT extension still pending. I got married to a US citizen back in May and have been gathering documents myself for the AOS application. I stumble upon Form I-864 and have questions:
- My spouse doesn't earn enough so I (the intending immigrant & spouse) will also use my income. On Form I-864 Pg.4 (Part 6 Item 10) it says "current income" so does that mean my current gross income (50k) or my adjusted gross income (45k)?
- My employer gave me an Employment Verification Letter and in that letter it says "Her annual salary is 55k..." Is it going to confuse USCIS if I end up putting the AGI of 45k in Form I-864 Pg. 6 (Part 6 Item 10)?

Correct ! It's marriage-based AOS and yes I'm married to a US citizen but his income is not enough so I'm trying to add my income too (since i've been working with my OPT EAD)
