  1. I agree, for my generation it is pretty common to have an open relationship(actually I even believe that swinging has been around for decades) ... I think the embassy should go used situations like this. Thanks for everyones advise, I will work on getting the BC corrected.

    should i go ahead and continue the visa now? or wait for the BC corrections first?

  2. Yes, like i said, i do understand that it looks really bad. Can the embassy deny her a visa on these grounds? or will they just make things harder? We have been married 2 and a half years, half of that time i have been living here in the Philippines with my family,I have been paying for everything, we have been living together, I have countless photos of us raising both kids together I don't really see how they could deny us just because one of our kids is not my own. It was a one night stand with a guy she doesn't know. It was a mistake and we have moved past it.

    No offense but i didn't post on this forum to get anyone opinion about my relationship or my wife, I just want sound legal advise, so if you don't have that then please don't post. thanks.

    can they deny the visa because my wife was not faithful?

    also, someone mentioned it is a problem that my name is on the birth certificate, I don't understand why this would be a problem, but can anyone confirm this?

    This will be a very hard sell at the interview stage because the only acceptable

    explaination that would present her as guiltless would be one of rape, not a nice

    topic to dwell on to say the least.

    If it was the OP's biological twin, that's still a near-miss on the DNA match.

    The OP may be older than his intended bride, but the CO may look at his age

    (24) and opine that he is too young and naive to get mixed up in a marriage

    such as this. He certainly is of an age where a "time out" may very well be in order.

    The OP thinks "I'm in love." The CO thinks "con game victim."

    Hello, i have been in the process of petitioning for my wife to come to the US with a IR1 visa. I was just about to submit the affidavit of support and wait for the interview when I learned she was pregnant, so i put the visa on hold. We have a son and he is 3 months old.

    We are now wanting to resume or visa work. obviously our son was not listed on the original 1-130 petition, so how do I petition for him? and what would be the quickest way to bring him along? should i continue with the affidavit of support and interview? or wait?

    Before anyone suggests to simply get my son a passport, that wont be possible as I learned recently that he is not my biological son. Should I be honest about him not being my biological son? My name is on the birth certificate, is there a way they would know if i petitioned for him as my biological son?

    i would really appreciate some help here. thanks

  5. Hi everyone, i am a little confused about something and i need some help.

    I am Petition for my wife, I do not have enough income to qualify so i have a joint sponser. My household size would be 3 because me and my wife also have a child who hopefully will be getting her passport soon. My question is this: will my Joint sponser need to list my daughter on the affidavit of support? if so where? and if she is not listed is this going to be a problem for me?

  6. Hi everyone, i will be using a Joint sponsor at the Manila embassy because my income for the last few years is way to low to qualify... I am not required to file a tax return because of my low income. so would it be better for me to either file with my low income? or to just show evidence that i do not have to file for taxes because of my low income?, if so what evidence should i show?

    Also am i and my joint sponser required to show 3 years of tax returns? or 1?

    Being that i have a joint sponsor and i'm filing for an IR visa, do you think my low income will be a problem?

Hello everyone, this might be a dumb question but here goes, I mailed my I-130 over a month ago and still no word :angry: anyway in the cover letter i wrote that the petition is for a K3 visa, but now we are wanted to go the IR visa route what do i do? is it as simple as not filing the I-129f after NOA1? or is there something else i have to do? will the I-130 be processed as a IR visa petition?

    This is in reply to your inquiry regarding co-sponsorships in K3

    nonimmigrant visa cases.

    Petitioners in K nonimmigrant visa cases are generally expected to

    establish the adequacy of their own financial resources to ensure that

    an alien, after admission into the United States, will not become

    primarily dependent on the U.S. Government for subsistence. While our

    immigration law does not disallow using a joint sponsor when the

    petitioner cannot meet the minimum income requirement, co-sponsorships

    in nonimmigrant visa cases are not legally bound to address the

    financial needs of the applicant. The simple submission of Form I-134

    by a co-sponsor is, therefore, not always sufficiently credible to

    overcome the public charge provisions of Section 212(a)(4) of the INA.

    In assessing the credibility of co-sponsorships, we look at the totality

    of circumstances.

    so does that mean that i can use a "joint sponser" but not a "co sponser" for a K3?

    I have a joint sponsor as my income is far below what is should be. I am wondering what exactly she will need to do? what paperwork will she need to have ready? also what does it mean for her legally? will she be forced to give me money if i where to ask it of her? if something happened to me would she be responsible?

    My wife is from the Philippines and i am trying to bring her here. I was living with her there for the past year or so and we have a little daughter as well (6 months) I don't have a job here and i never worked in the states, neither have a filled for taxes. Is that going to be a problem?

    Here are my questions...

    1. Do i need a income tax return? (my sister is going to be my joint sponser)

    2. even with a joint sponser is my lack of income going to be a problem?

    3. My wife lived in Amman Jordan for 2 years after she was 16. does she need a police clearance thing for there as well? if so how do we go about getting this? If we don't have any police clearance from Jordan will this be a problem?
