We always sent more documents that was was required.

So my wife became an Official US Citizen Today.

It's now 8:35am and we're still waiting to be called. It's a packed room at the Office. It's like a party here.

My wife just got her interview letter in the mail today. Call me crazy, but the process seems slow. We expected an interview in Jan.

Can only assume that there's a backlog on interview applications.

Just leave it alone. The most important part is getting the green card.

Look at it this way. Everything is upside down from an Australian's point of view.

I am not sure about the USCIS Case Status not working properly, but my brother's AOS was working 100% and this was done last year in Sept to Nov of 2012.

I dont think the OP mentioned if they signed up for the case status updates. If you get denied by missing an RFE, you can make an argument that you never received the RFE and USCIS case status did not give you and update.

I know for a fact that Case Status also is used by our lawyer to track all the information. You can enter an unlimited amount of file numbers there.

If you think that you are delayed, you could always call USCIS to speak to a rep (they always answer and help with general questions about your application)

If a RFE was missed and you get denied... its going to cost 2x just to re-apply again.

The Immigration Officer opened the envelope while we were in QUE in the line. (I think he did that to save time because the QUE on LAX is very long sometimes.

There is no problem if the envelope is a little opened as long as you dont try to take anything out of it.

I should have taken photos of this, but I didn't get a chance to.

USEM in Manila should get an X-Large Envelope. LOL

You should be fine!

On a side note, a few things in that envelope will be given to you by the IO when you arrive. It was odd, but we received some files that were not even ours. I was quite amazed that something like that happend.

No need to panic. I was there before and it was exciting times because when your interview is over. You get your visa. Its a brave new world going to the US.

Right now we already have 2 kids. LOL. Time goes by fast.

From experience, we used sent in a ton of paperwork for the 1-129F and the yellow envelope did not even fully close when we received it. Don't ask me why. The papers were sticking out and they had to use extra tape to close all the file together. (you can even see what's inside the envelope from the corner)

So. when we arrive in LAX POE. We were in line with my fiance (I flew in with her together from Manila). We were in the US Resident / US Citizen line. The Immigration Office who was leading and telling you which lines to fall in line in opened the sealed yellow envelope before we were in the immigration window. I was in complete shock when I saw this because I didn't even get a chance to tell them to not open it.

Anyhow, when it was finally our turn to talk with immigration. I just handed the "OPENED ENVELOPE" and they didn't even ask any questions.

Lucky for you that they were ok. Usually when you do an interview, you will go under oath and if you got caught with a lie, then you'll be in bigger trouble.

I have been sending private messages with the original poster and I thought I should also post this here:

I was thinking about your case earlier today. Again, I do not visit this forum daily. But the reason I am logged in now is because to check if there is another update. Based on what you have said. Not receiving or missing an RFE was one probability of the denial as I mentioned in the post. (I guessed correctly, how about that)

Regarding your case... this maybe easy to counter if you have all your paper work. Right now you will need to prove that you did not receive the RFE. This happens but not very often. Do some research and find out ASAP.

Honestly, this could have been easily avoided if you have the USCIS Status online update. This is the link to the website.

What you should have done is registered and signed up for online and email updates. It updates you on your case and if you did get an RFE, it would have sent you a message. If you received that message and did not receive the RFE by mail.. then you would have called USCIS and asked what this was about and have fixed the problem early with an Infopass Appointment. (If you had a lawyer, they would have told you what to do in advance because they check these daily)

I have my wife's and my brother's profile and I checked this several times a week to see updates. Anyhow, whats done is done.

At this time you have 3 things going against you.

1. The denial letter.

2. Missing the RFE letter

3. Correcting the RFE

While updating the RFE is easy as 123... you will need to speak to USCIS on what had happend. They may or may not give you a hard time. (its a luck of the draw)

Even if this was just an updated ITR they are asking for, be prepared on what else they may ask you for an know how to answer them properly.

I do not have any experience with this matter and this is something that you need to pay very close attention to.

This might just be something easy to fix, but I would not take a chance because there is too much to lose. I would hire an attorney and stay on top of this situation.

(Although this does not happen very frequently. The AOS process is quite extensive with so many documents needed to be sent and filed. While most applications go smoothly, a few dont) Its always best if you are going to do it right the first time. I understand that most can do this by themselves, but some do overlook a few small things like an outdated ITR. A missing RFE letter. I cannot emphasize it enough that when you pass your AOS, you have to be very diligent with all the things that need to be in that packet. A lot of things can go wrong and you have to minimize those chances)

With this case, if you have to re-file again. I think you might have to pay for the whole application again. Not only did you lose time, but also lost $ in the process.

Uhm... That is correct.

If you have your period... you cannot go to get your medical exam because they will check your private parts.

Check for STDs... They will ask personal information. (Thats what my wife said)

This is very important.

Do not forget to send in the check.

Check the mailing address that it goes to the right place.

Make sure you photo copy everything.. I mean everything before you send it in. (Just in case you were to lose the pacakge)

Some people send their stuff w/o having a second master copy and all hell breaks lose when USCIS misplaces your packet.

If you can do Signature Confirmation or some type of Signature Required. Do it.

Self Employed.

I remember sending them Business ITR for 3 years. Personal ITR for 3 years.

Bank Statements, Business Cards with Business Letterhead stating my position and responsibilities.

W2's were also included.

What I tried to do extra things because its better to send more than not enough paperwork. I also sent copies of my check stub's

Business Lincense, Reseller's Permit with my name on there.

I recommended to the poster to hire a lawyer. I know we are all somewhat knowledgable with the AOS process (I had to do it twice) ... This is a special kind of situation where its like the point of no return. USCIS does make errors and there can be a posibility that this is in error, but I am not a risk taker when it comes to this situation.

My brother's AOS took nearly 20 years because it was a Mother to Son Petition and my brother aged out when I received my GC back in the 90s. So my brother's appliation status was bumped from 1 category to another. My brother is also has a learning disability and it was my mother who is the petitioner... (she has a 80's mentality and doesnt know how do these kind of paperwork herself) so we didn't take a chance.

Glad we hired lawyer.. even if we spent $2k for it... It was worth every penny to get that piece of paper. Interview came.. after the biometrics and we resheduled the intial interview then a letter comes in the mail immediately saying that he missed his interview. Denied for AOS.. EAD, AP is expired. HOLY Smokes! USCIS had problems internally and lawyer helped us and also assisted him at the interview.

Just my 2 cents.

Most of the things you worry about will never happen.

Its the things that you do not think about is what usually hits you.

The 90 days goes fast when you are finally in the US... My fiance (wife now) did it within 15 days.

If you look at my timeline you will see when we got married and applied for AOS.

We just did it in court with some a few family members..

Just try not to take too much time before you know it.. you're already at 60 days.

Its all too much work to miss not doing it within 90 days.

OK..OK... So I am a veteran at this and I just read this topic and I have a few suggestions. This is just my opinion so just take it for what its worth with a grain of salt.

Since you do not have the denial letter in your hands and you dont know why you were denied... you need to wait for the letter.

Or view what the possibilities are on why this has happend... here is a list of what I think happend.

1. I-485 file was done incorrectly (you should have received and RFE)

2. I-485 or something probably something got lost in the mail ( did you do delivery / signature confirmation when you filed? ) Did USCIS receive your packet correctly and cashed your payment?

Biometrics letter got lost...

3. USCIS Error (I have had experience in USCIS giving a denial letter for missing an interview... We actually rescheduled the interview and they did not get that letter, but we have

proof that we resheduled it the interview. The lawyer fixed this problem and we have all the documentation that we sheduled for another interview, but the denial letter

says we did not show up for the interview. (so yea) So after a few months of waiting... USCIS sorted it all out and found out it was their mistake.. resheduled an interview and got approved.

4. None of the Above.

So... I strongly suggest that you try to get yourself an immigration specialist / lawyer who can help you with this case when you receive the denial letter. This is actually very difficult to do on your own. These things do happen in error or some files do go missing or lost therefore you need to find a way to appeal the denial. Thats what lawyers do best.. they know and have experience with this.

When we take the responsibility to file on our own and follow all the guides and tips in this forum. its not always 100%. Last year, I helped my brother to file for his AOS.. I knew what the steps were of the AOS was, but the problem was.. I was not the petitioner. It was my mom who petitioned for my brother. The wait was almost 20 years to get to this point. Althought I knew all the steps of AOS because I did a K1-AOS .. filing with no issues. I was not the petitioner and if something goes wrong.. Id rather have a lawyer who will be there to help. Its worth all the $$ as long as you get your papers fixed.

Let us know when you receive the letter and what it says... also if you could.. please update your timeline so we can get an idea of what is going on.

Lastly, you need to make sure you have all your paperwork organized and complete.. just in case you need to show any info to USCIS.

Hope you also made a full copy of the AOS packet that you sent...

These are very good pointers.

The most important thing before the interview is to prepare and look over what you have. When the IO interviews you both, the IO will rather see that you have your documents all together.

Since you are doubting that you do not have enough evidence.. that worries me.

Okay you need to gather as many documents as you can for FINANCIAL records. We took albums, cards, affidavits, letters and load of other stuff with us to the interview and the officer told us that affidavits doesn't prove anything. He said he can walk outside and get affidavits from anyone. He said the only thing that matters is financial stuff. He said no one trusts anyone else with money so if you have join banks, bills, insurances that shows that u guys trust each other so u r married. He said cards and pics can be faked too. So try to list both of ur names on ur utility bills,if you call them they can add another name on the account. Cal your cable /internet company and have both ur names on it. also, try to keep good amount of money in ur bank accounts. I am not saying to borrow money to put in ur account but try not to make any big purchases. You want to show that u guys trust each other enough to keep lots of money in joint account.

This is my opinion, I might be wrong though but this is what I was told by the officer:

Order of importance:

house deeds/loans

Bank statements

credit card statements

apartment leases

car titles

utility bills

vacation bookings, boarding passes, tickets

affidavits

pictures

letters

some ideas on what you can include:

401K plan from work (list him as benificery)

life insurance

health insurance

Letters which has both of ur names (bills etc)

any events u went to together

internet bill

electric bill

apartment lease/ house deed/loan

joint accounts

make copies of ur licenses, it will show the common address
