Yep took 3 days to make up her mind she wanted a Divorce trust me I am confused too.... but I also think she was in the start of another relationship... but not 100%.
She got Full custody with me having Visitation Rights...... She has full custody because how can I even think about having my baby without Money, Job, place to stay etc..... I was in a corner and she knew it..... it's a shame it ended this way but I just got to look forward and think about my little girl.
Isn't there a 60 day mandatory separation period in Kansas between filing the petition and getting divorced? I just have a feeling we're not hearing the whole story. The only way your ex got a divorce in 3 days flat was to file for an emergency divorce.
Who is the "friend" that you moved to Chicago with? A girlfriend perhaps?
Having a child doesn't imply you have a bona fide marriage, it implies you had sex at least once
You've moved 12 hours away from your child... what does your visitation schedule look like? I think those are things they will look at if you go in for an interview.
(PS... It's quicker to fly from the UK to Kansas then it is to drive from Chicago to Kansas!)
I'm sorry, I was thinking Kansas instead of Kentucky, either way, there is a 60 day separation period in Kentucky too... I still don't understand how your wife was able to get divorced in 3 days..
I hope your situation works out... but if it's your case to say that you want to be there for your baby... I don't see how moving 6 hours away helps her

I didn't send any cards because I don't view them as strong evidence either... Perhaps you'll be better off focusing on sending utility bills/insurance information etc in both names coming to the same address over the course of your marriage.

I will make this fast. i married an illegal, he was abusive and mean forcing me to file his greencard or he'd leave, we talked it out i got pregnant he went to the interview. there i found out he that previously filed 2 times and failed for a greencard through lulac and something else. the interviewer didnt immediately give him his conditional greencard, we waited and finally he received it 4 months ago. here is my nightmare, he has thrown me out of my own apartment with my 2 month old child, so i now live with my parents and haas told me he only married me for his greencard and that he's going to find a woman he loves. he has all the immigration documents and never let me see it. i dont have the case number, or his a number. i am in a nightmare, my heart is broken , i had a child with a monster that used and abused me. i have recently closed our joint account, and currently canceling my lease. Monday i go down to my local nyc ins office. Any advice? do i have a chance to withdraw anything or remove his greencard. i will not be used in this way. Please someone tell me there is still hope in him losing his conditional greencard. Also he has refused to give me my marriage certificate or my child's birth certificate. this is too much, i am on antidepressants to get me through.
Oh god, what a mess. You should file for your divorce immediately. You can get your marriage certificate and your child's birth certificate from the city's they were originally issued. (it may cost a few dollars... to get my son's birth certificate was $8 in the town he was born)
You should make an info pass appointment to explain your situation. I'm not sure the green card will be revoked (or if it can be?)
Since he was living here illegally in the first place, he will probably go back to living here illegally.
You need to move forward and do what is best for yourself and your child.

Come on now people - this is supposed to be a place where we update folks on the statuses of our cases and ask questions about things we don't understand. Don't hate because ours got approved - we can't predict why or how these things happen. I feel the frustration for all of those who have been waiting - we all know that pain. Please make this a place where everyone can share their joys, frustrations and anything else that comes to their mind.
I agree. I saw people who applied after me get approved before me, so I understand the frustration. But since this is out of our control, let's be happy for the people who have been approved and support the people who have not.
Hating on each other will not change what is happening at USCIS today.

Thank you for the replies. He is not willing to go to counselling and I feel that I've done everything I can do to save the relationship. I know that you can file if you are divorced, however, where I live the quickest you can get divorced is 90 days and that is if it is uncontested. If we do get divorced, things will definately be contested. There is a lot of bitterness on his part. My 90 days to file for removal of conditions starts on March 22nd, so I really have very little time.
I'm hoping that when I meet with the attorney on Thursday, he will give me some more concrete answers. I really don't know what to do now, I don't want to have to give up everything I've built here over the last 3 years, but at the same time, I know I can't stay in the relationship as it is, it is literally making me physically ill with the stress and not knowing what I'm going home to everyday.
I wonder what would happen if I can somehow persuade him to sign the form and file together, and we seperate before the petition is approved. Nebraska service center is only processing July 2006 at the moment.

If your husband does not want to sign the form jointly, you have no choice but to file alone.
In order to do this you need to get divorced and include the divorce decree in your application.
You do not have to be abused to file alone. The only burden of proof for removing conditions is to prove your marriage was bona-fide.
It seems to me your only choice is to get divorced, file alone and prove to them your marriage was legitamate.
PS, talk to a family divorce attorney too... as long as your divorce is uncontested, you could be divorced within 3 weeks in some counties.

Go through the phone prompts as though you don't have a case number, because you DON'T have a case number... if you read the NOA (yes, I'm repeating myself....
) you will notice that is a receipt number...... not a case number. Your case number will be on the ASC appointment notice.

"Upon receipt of your ASC appointment notice, you can find the status of your case on-line........."

i am in need of all the documents i have sent to the INS with my 2 yr card and present pending i-751 application, due to myself and my wife getting divorced and she throw ALL my documents and copies away.. how easy is it to get documenst back?
