    I just read that you were in a very similar situation than I am.

     

    My wife (U.S. citizen) and I (German citizen) live in Germany and my wife works for her U.S.-based employer remotely. We haven't started the green card process yet. We are about to send in the I-130 package.

     

    We were thinking of doing DCF at the Frankfurt consulate to speed up the green card process. We would ask my wife's employer to draft a letter stating that she needs to come back to U.S. within the next couple of months.

     

    What proof was necessary in your case to get approved for DCF? Did the USCIS actually contact the employer to confirm?

     

    I would really appreciate any info you have!

      Thank you so much for your input on this! My wife has emailed the Consulate in Frankfurt explaining our situation and received a reply yesterday. In our case, they requested proof in form of a letter from my wife's employer. We will provide a letter, we will see what they say.

      Thats great to hear! 


      Would you be able to give me a rough understanding of what your wife put into the email to the Frankfurt consulate requesting DCF?

       

      My wife was going to write that her employer would like to have her work from within the U.S. because the time difference makes the collaboration difficult, it would be easier for her to talk to clients in the U.S., and that her employer wants her back within the next few months.

      Thank you so much for the response! It is really difficult to find someone in a similar situation.

      That sounds really good! We will try to do the same and explain everything in an email without any employer proof.

       

      Had the U.S.-citizen spouse in your case a residency permit (Aufenthaltstitel) by the time requesting DCF?

      My wife is still in the 90 day visa free status. We are barely applying for a residency permit in Germany.
