    Try link below. For your particular situation, it is a F3 for which they are handling priority dates of Feb 2004. So more than 11 years wait.

  2. For over 21 unmarried son of citizen, it would be F1 family sponsored visa and there is a limited number of visa available every year. Based on the backlog of those already waiting, they are currently processing for Aug 2007 and assuming current pace, he will have to wait 7-8 years after initial processing through CSC.

    I must be missing something here. Where can I get the information you're referring to (for example August 2007)? Is it listed on a different page than this USCIS page for processing times?

    For what it's worth, my brother is married with children. I'm assuming that will take even longer?

  3. My father is in the process of filing for I-130 to petition for my brother (who is currently a citizen of Britain living in London). My father lives in Phoenix and from the application instructions, we would have to send it to the Phoenix Lockbox. The issue is, the processing time of this application is significantly different between the California Service Center (currently processing 2011 applications) and Texas Service Center (processing 6 months ago applications). Is there a way to ensure that this application is routed to the Texas Service Center? Or are we most likely stuck with the CSC?

  4. I read on the process of applying for a petition to bring my parents (I-130) but I had a question. If my brother is 13 and he's under the care of my parents that I'm petitioning for, do I have to apply for a petition to bring my brother on a different application? My concern is, the processing time of an I-130 for parents is significantly less than an I-130 for siblings.

    I'm a US Citizen by the way.

  5. Hey all,

    I applied for my mother's renewal of green card. She is out of town on a family matter and she won't be able to make the appointment. The problem is, I can't send the rescheduling letter (on the I-797C NOA) to the USCIS address in Phoenix (which is litterally minutes away from where I live) until Tuesday at 9:00 AM. The appointment is at 8:00 on Tuesday.

    What should I do? Should I just send the letter anyway and see what happens? Should I go to the appointment without my mother and see if I can postpone it in person?

    Please help.

  6. Yah I already tried the fee-waiver and applied to re-issue the Green Card and just like you said, because it wasn't returned to them, they assume it was lost/stolen and therefore I would have to pay for it.

    Is it too difficult for the USCIS to give the option of delivery with tracking? I mean what would stop this from happening again. This is a very good way for them to make $370 every time.

    Here is the ultimate question; why wouldn't I just get my wife's passport stamped every time we need to leave the country, or when the stamp expires? Is there a limit on how many you can get?

  7. I was informed by the USCIS that my wife's Green-Card was lost in the mail because I never received it and neither did they. It's completely frustrating to pay $370.00 now after I already paid almost $1000 for the adjustment of status application. Is there any way I can avoid paying this fee? :ranting:

    Also, how long can I wait before applying for the Green Card? In other words, if I go to the USCIS office and they stamp my wife's passport for a year (I'm not sure what that stamp is called but it's the one they usually do to prove that you're a permanent resident if the green card is lost of in process), can I wait a year before I apply for her Green Card?

  8. Hi All,

    Yesterday (10/20/2008) I received a notice from USCIS saying that my wife's green card was lost in the mail because I haven't received it yet and they haven't gotten it back. They asked me to submit an I-90 form. ARE YOU FREAKING KIDDING ME? This is starting to irritate me because I have been calling them for the last 2 months (I should have received the GC 2 months ago according to the approval notice I received back in August). Every time I call they say that the card hasn't been issued yet but they can't research it because I have to wait for a certain period of time. 2 months later somehow the card was magically issued and I have to pay another $300 to re-issue it because it was "Lost in the mail"?

    Has anyone been through this before?

  9. I got a Welcome Notice for my wife's AOS application. It said in it that we should recieve it in 3 weeks. It's been over a month. Is that normal? I know it's only a week later but from the process dates that I saw posted on this forum, it should have only taken 2-4 days after the welcome notice. Should I be worried? What should I do?

    According to the instruction of form I-485, I would have to send the package to :

    I want to send the EAD application together with I-485 but according to the instructions in form I-765, I have to send the EAD form to:

    USCIS

    California Service Center

    P.O. Box 10765

    Laguna Niguel, CA 92607-1076

    How can I include I-765 in the I-485 package if the addresses are different?

  11. I just checked on the Guides' page that the EAD might take up to 3 months to be issued. Seriously? Does that mean my wife, who entered the US vis a K-3 visa, cannot have a Social Security Number for the next 3-4 months (I included the time it takes to issue an SSN)????? Not having an SSN here is a huge problem. I can't even include my wife in my Insurance without an SSN. She can't go to school without an SSN. She can't apply for an ID/Driver's License without an SSN.

    Please tell me that above is incorrect :(

    You know I never noticed that. I just changed it in my profile to K-3 as it is the correct status.

    Anyway, I will gather all reciepts and then I will create my wife's timeline shortly.

    in your parents case I don't think there is any other way than getting a I-551 stamp at a local USCIS office for travel purposes. I am sure within the US an expired Greencard along with proof that your parents filed N-400 is enough to prove they are legal, but I wouldn't count on that for the POE. With proof of having filed N-400 the stamp should be issued without any problems.

    For the infopass appointment: I have a friend who had the same problem, couldn't schedule an infopass app., so she just packed her bag and drove to the local office without appointment at all. She did that twice (because they really messed up her EAD and AOS case) and both times they helped her out and were friendly, scheduled a real appointment for her just a few weeks later. That was Denver. I have heard some not-so-friendly-stories from other local USCIS offices though... I guess it all depends, unfortunately. I would drop by there, if it's not to far of a drive and just ask.

    I remember reading a law, if your parents have applied for naturalization more than six months prior to their cards expiration they do not need to apply to renew their Green Cards and will be issued a I-551 stamp at their local USCIS office immediately. If they applied less than six months before their GC's expiration they would have to file I-90 and pay the fee to renew their GC's, even if they have filed N-400.

    Oh boy ...

    You're right. I just read the passage about the 6 months law. That will be a problem (meaning they'll have to renew their green cards) beacuse they filed their N-400 5 months and 2 weeks before the green cards expired. Are they extremely strict when it comes to following this particular law? or is it pretty much dependent on the immigration officer you happen to talk to?

  14. Hey All,

    I'm having extreme difficulty scheduling an appointment with the local office via INFOPASS :angry: :angry: :angry: .

    My parents applied for citizenship (N-400) and now their green card is about to expire. I was told that I have to go to the local immigration office to get their passport stamped with a temporary extension so they can visit my brother in Canada and re-enter the US with no problems. Is there any other way of doing that without an appointment with the local office?

    BTW, I get "At this time, there are no information appointments available for the office in your area. Please try back again later." when I try to schedule an

    appointment using INFOPASS.

    The I-94 card that I have recieved is identical to the sample one provided here:

    In the front, (displayed in the sample), there's a "Departure Number with a 9 digits then 2 digits on the top left corner. In the back, (NOT displayed in the sample), they have a hand-written number (like this: A89XXXXXX). These are the only two numbers on the I-94 card. Which one do I use in the question that asks about I-94#, part #1 of the I-485 form?

    Also, it asks about US Social Security #. I don't have that yet. The whole purpose of me submitting the I-485 is, along with to get a green card, is to get a social security number. Do I leave it blank?

  16. O.K. these might be some very basic questions so bare with me you all.

    1) "Current USCIS Status" in Part #1: what do you put in that section if I entered using a K3 visa?

    2) Part 2: which check box do I tick if I entered using a K3 visa?

    3) I-94#: does this number start with an A?

    4) Do I need to submit medical records? The reason I'm confused is because it says "When required, submit medican examination report ...". This, to me, sounds like I submit the medical report when I'm asked to. In other words, I submit the AOS (I-485) then they determine whether I need to supply medical reports or not. Is that true?

  17. I applied for both I130 and I129F and my wife recieved her K-3 visa which she used to come here. After she got here, her I130 petition was approved.

    What do I do now?

    You file to adjust her status to permanent resident and for EAD if she wants to work before receiving the green card. See the AOS guide and AOS forum.

    Thanks for the quick reply. Does my wife need an EAD to get a social security number? She doesn't really need to work now, but she wants to go to school which requires an SSN.
