  1. Had our AOS interview today and my hubby was granted the 2 year card! Yaaaay! :dance:

    Our appointment was for 8:00 am, we arrived at 7:30 am and were out of the building at 8:05 am!! She looked through our wedding album, but didn't take any of the copies of pictures we brought. She asked a few questions, asked for some joint account or ownership proof and kept some copies of those. That was it!

    She said his card could take up to 2 months to receive, but that we could receive it as early as 2 weeks.

    How long did it take to receive yours?

    One question I didn't think of until after we left: she said that there will be no notification of when we need to apply to renew for the 10 year card, that we have to pay attention to the date and do it before the 2 years are up. I didn't think until after to ask her: how do we do that? Do we call, write, fill out a form...what?

  2. :help: Here's our status: Hubby came over from England in June on Fiance Visa, we got married June 30th. Turned in all of paperwork for AOS in July, got SS card, had Biometrics appointment, recently received Work Authorization card. Now we are waiting for our interview in March. Finally on the Homestretch! We are excited, as he would love to return to England to visit his kids & mum after the interview if approved.

    He went to get his passport to apply for a driver's license yesterday, and .... can't find it!! We have turned the house upside down looking, but it is nowhere to be found. He has always been so careful with it, so this is confusing to us. Of course, we've had it in and out so many times, making copies of it, taking it to appts, etc., that in a way, it's no wonder! Regardless, the fact is, we cannot find it.

    We need some advice on the best course to take. Do we need to apply with an English Embassy to get a new one? If so, how might this affect the process of his residency now? How quickly could we get it, does anyone know?

    Do we need the passport for the interview? I'm assuming we do (need to check the instruction email to see) but will a copy suffice? (We have several copies!) If we do not, should we tell them it is lost, or would that just complicate matters? *sigh*

    If we do manage to get a new one in time for the interview (we have about 50 days), how will that affect his status, as the old passport number is all over his current paperwork? In other words, will they require us to 'start over'???

    AAARGH!!!

  3. My husband just had his biometrics appointment and now we're playing the waiting game. Today we received a 'Request for Initial Evidence (I-485)'

    This is what it says is needed:

    " F. (x) (25) The petitioner or joint sponsor's income as reported on the federal tax return submitted with Form I-864 Affidavit of Support does not meet or exceed 125% (100% if military) of the poverty line. The petitioner's or joint sponsor's current income as reported on Form I-864 or Form I-864EZ Affidavit of Supoprt is sufficient but no evidence has been submitted as proof of the current income. Submit evidence of the sponsor's current income. Evidence includes a letter of employment from current employers and should show dates of employment, the nature of the job(s), wages or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. The sponsor should also include pay stubs for the most recent 6 months. "

    I DID submit proof of current income. ?? My employee letter didn't include all of that information; it was on company letterhead stating my employment since the date I started, but didn't include hours, future advancement, etc. (How were we supposed to know they wanted all of that info on there?) So, I will be getting a new one & sending that in.

    Should we use a co-sponsor? I have one who has filled out all the paperwork, but we didn't submit it, as we realized we didn't need it. My income from last years tax return was not enough, but my income this year IS enough. I submitted pay stubs to show current income.

    *sigh*

    Any advice is much appreciated. Thanks so much.

  4. Nebraska does not do AOS for family based filers, you mail petition to Chicago, and it gets sent to MSC the national benifits center where they decide to either send it to your local filed office or CSC.

    Thanks for the links...I finally figured out what 'touched' means! :dance:

    We sent our file to Nebraska, because that's where the forms said to. It wasn't until we got on here after the fact that we learned it should have gone to Chicago. I called and was told it would either be forwarded to Chicago or sent back to us. I'm assuming it was forwarded, because our check was cashed, we received a NOA and we now have a biometrics appt.

    So, does the fact that one or all of these things have happened mean that it has been sent to whatever service center is handling it?

    Does "local filed office" mean the service center we are assigned to locally?

  5. Just curious any experiences w/ the Nebraska Service Center. Are they running slow, extremely slow, average....? We are August filers and have a biometrics appt. coming up October 5th. Just curious what kind of time-line we're looking at. I realize from reading here that it can vary greatly, but thought I'd ask for Nebraska experiences.

    Also: :help: We're new to this and I don't understand all the terminology. In looking over everyone's time-lines, I noticed many times you put 'Touched' on a certain date. Can anyone explain what that means?

  6. We mailed our AOS apps August 4. We actually mailed to Nebraska (mistake) and have been waiting to see if they would be forwarded to Chicago.

    Just today - September 14 - our check was cashed!

    I know no one can say for sure, but does this imply that our apps were forwarded to Chicago?

    Also, what does this mean in the whole time-line? Should we expect an NOA or Biometrics appointment soon or could we still be in the 'semi-truck full' of apps waiting to be processed? :huh:

  7. He WILL have a break in authorization from the day the I-94 expires until you receive the EAD approval from your filed I-765.

    Ooops...does this answer my previous question? We have to wait to receive EAD approval to work after I-94 expires even if he is 'AOS pending' status?

    Yes it does... between those periods he will lack the authorization to work...

    There would be some people here that would suggest it is much more an employer problem than an employee problem so unless the employer raises the issue......

    What if it's his own business (a service?)

  8. Well after the I-94 expires, since you already sent your AOS application you will be of 'AOS pending' status.

    Did you file for EAD (work permit) along with your AOS? If not you might need to if you want him to be able to work.

    I will check this evening to make sure we filed for EAD along with our AOS. If we did, does that mean he will be ok to work with his SS# since he will be 'AOS pending' status?

    I'm so thankful you all exist!! We have being going through the Fiance Visa process for over a year now and it can be so frustrating! :wacko: It's nice to read others' experiences and know we're not alone. Please excuse me if I don't use all the correct terms; I'm not fluent in them yet, as this is my first post. :blush:

    Here's our current situation: We are awaiting NOA on our AOS, which was mailed August 4th. (Tracked and confirmed received.) We mailed it to our Service Center (Nebraska), as that is the address the form told us to mail it to. It wasn't until I found this forum a few weeks ago that we realized we should have mailed it to the Chicago Lockbox. :o Wish we'd found you all BEFORE we mailed off our apps and $1,000 check! :( We realize that this will cause even more of a delay for us, so we are just waiting. (I was finally able to speak to a human when I called USCIS and they said either the apps will be forwarded to Chicago or sent back to us and we will have to send to Chicago.) Either way, we realize we're in for a wait. He is already able to work, as he received a work authorization stamp upon entering and now has a SS card.

    Here's our question: While we are waiting for our NOA, what happens if his current Visa expires? He came in on a Fiance Visa on June 27th (we were married on June 30th (L) ) and we understood his time limit to get his AOS expired in November...is that correct? We are wondering what happens if we are still awaiting NOA or approval status when his visa expires. Or since we have submitted the forms is he ok? (Assuming they at least get to Chicago and we get an NOA before long.) Is there a form we need to fill out as his expiration date gets close if we haven't received a NOA? I read the USCIS press release on this forum about the high volume of applicants. Did I understand it correctly that your status is fine while you are waiting for notification from them?

    His visa expired the day it was used because it is a one entry visa... the question really is what happens when the I-94 expires (should be something like Sep 22th)... Since you met the 90 marriage requirement and have filed AOS then his status is pending adjustment to permanent resident... In addition, his work authorization ceases the day the I-94 expires.... until you receive EAD aproval.

    Wow! So....what DOES happen when the I-94 expires??

    I'm trying to remember re: the EAD approval....... He applied for his SS card based on the Work Authorization Stamp, so his SS card has some sort of notation on it (can't remember what it says exactly, have to look later...) *sigh* Now we need to figure out if he can still work!
