Thanks Paul, so I figure the husband from which she is divorced (which by the way is now a US Citizen married to someone else) must be listed too? Is there a part on the form then where one indicates who one is claiming? thanks for your time

I'm a US citizen and I'm applying for my older sister, just her, not her adult children (she is divorced). When the form asks for information on her husband or children do I need to complete that information even though I'm not claiming them? thanks

I plan on petitioning my brother, he has a wife and a son. Do I prepare just one I-130 for him or do I prepare three documents, one for him, one for his wife and one for his child?...Form I-130, which I started to fill out requests information on his spouse and children so it suggests one form for the whole family.

If I were to fill out one form for each, Form I-130 doesn't provide for the child, since the boxes to check are: Spouse, Parent, Brother/Sister, Child. Nephew fits none of those categories, please help.

Asking this question on behalf of a friend: .....I am filing for removal of conditions and getting a divorce from my husband as well... my application was rejected because I did not include a copy of my husband's naturalization certificate. Our divorce is contentious and he will refuse to provide me with a copy of it. What is the way out of this situation?

My wife, who is applying for naturalization as spouse of a US Citizen is being requested to bring "proof of marital union" I'm a bit confused by this since a couple of lines above she's asked to bring our marriage certificate....shouldn't this be proof...obviously it isn't so what is the evidence of "marital union"?

Likewise what constitutes "proof of residence"?

If you have your oath prior to your travel plans, you can take your reservations and go to your local passport agency - they can produce the passport same day for you at not extra charge. but the requirement is you need to be traveling within 2 weeks and not longer.

travel.state.gov and check the nearest center to you...

The other option - is to reschedule your oath, which is fine, and there shouldn't be any issues with USCIS.

Thanks for the replies, it ocurred to me to search the subject in VJ archives and it popped up, the problem is the advice goes in opposite directions, from "no problem at all" to "don't even think about postponing". I would like to hear from someone who has actually gone through a postponement. My cruise while a pleasure cruise is to celebrate our five year anniversary so it's not necessarily trivial from that respect.

We are wringing our hands with this situation, we bought a Caribbean cruise for Dec 31st through Jan 7. My wife recently had her fingerpints, she was advised today that her interview letter is on the way, if all of this leads to the oath being this year we won't be able to get a passport in time and we'll lose our cruise, we've asked the cruise company and the insurance doesn't cover our situation; the only thing that occurs to me is that at the time of the interview we can ask the officer to schedule her oath for mid to late-January. Does anyone know if this is possible or acceptable?

We filed with the Phoenix lock box Sept 3, got a NOA Sept 6 and the check was cashed Sept 9 but ever since then nothing, we've called USCIS and have been told to wait until Oct 8th...are others seeing a similar situation, not sure what's taking so long in scheduling the fingerprints...

Any idea what might be occurring? we filed on 09/03, got our notification dated 09/06/11, the check was cashed but we have not received a notification for biometrics yet. We called and were told to wait until 10/06 but I see other people getting their bios scheduled, any comments from anyone?

When the N-400 form asks for "Immigration Status of Prior Spouse" under section "G" is that their current immigration status or the status at the time of marriage; e.g. a former spouse was on a visitor's visa when I married her; today she is a US Citizen, which one should I include?

You don't need to include the future trip, however, during the interview, the IO will ask you about the trips you have made in the past (in the event you made any after filing) and you can mention that last trip so he or she can ammend your N-400.

And oh, I put cover letter on mine, to make it more formal, I guess.

I did not include a cover letter this time. Although it never hurts.

Can't remember if I did with the three AOS applications...

No, you can't include a future trip in the application. You will be requested to bring your travel documents to the interview, and all the changes that occurred between filing and interview should be explained/proved then. If it is a short trip and it's been over 3 years since you became a LPR by the time of the Oath, it will not affect your application.

Hi, we intend to file on September 2nd but plan to travel out of the country on September 3rd, should I include that trip even though it's in the future?

Also, when I've sent documents in the past (for say Adjustment of Status) I've included a cover letter listing all the documents I'm attaching; in reading the instructions I don't see the suggestion for a cover letter. Please let me know if you are a previous filer if you've included one.
