  1. There are 6 total in your household, correct? You, wife, parents, grandmother and brother. Since the I-864As don't have any lines for you (like I thought originally :wacko: ) to include the grandmother you do need to put her on your I-864 and the Line e is the only one that I can see that would be the appropriate one.

    The I-864A is the contract signed between you and the others in your household so they should see that the grandmother is a dependent on the parents' tax return to justify the entry there.

  2. I have all their W2s and 1099s, but I now remember I didn't sumbit my parents' 1099s from banks, and I believe this time I have to submit because on my parents' tax returns of 2006 showed about $1150 earned in interest.

    Okay, this time I won't include any assets.

    My whole family members don't keep paystubs, and my parents' bosses don't even give paystubs but a check only.

    However, this REF never mentions paystubs at all, it only mentions employment letter.

    However, those employment letters are printed by myself and let all employers signed. The reason why was that they were all small bussiness, so no business stationery. They asked me to make the letter and then they signed. Should I include a cover letter telling this?

    I've always heard that some sort of paystub is required but if you don't have any, you don't have any and will have to depend on the employer letters.

    I wouldn't include a letter explaining that you wrote it up and they signed it but it wouldn't be a bad idea for them to also state in that employer letter that they don't provide pay stubs just to cover your behind, in case it helps.

    I will talk to their employers this matter and see if they accept you suggested. Thanks a lot ! I will update this post as soon as I get responses from the employers.

    Line a 1 my wife

    Line b 1 myself

    Line c 0 even I am married now, but I still put 0 for this line becuase the form emphasizes DO NOT COUNT ANYONE TWICE

    Line d 0, no children yet

    Line e 1 in doubt ???

    Line f absolutely no one here

    Line g 3 my father, mother and brohter

    Ends up 6 people

    Line a is 1 (I am assuming this is your wife, from Line 10)

    Line b is 1 (yourself)

    Line c is 0 (your wife is already counted in Line a, I'm assuming; you don't count anyone twice)

    Line d is 0

    Line e is 0 (if this is your grandmother, she is not your dependent and should not appear on your I-864)

    Line f is 0

    Line g is 3 (as long as all 3 of the others in your house are submitting an I-864A with your I-864)

    Line h would be 5

    But my grandmother is a dependant on my parents joint tax return of 2006, but she doesn't live with us. as you said Pj, no need to include my grandmother as a member of my household? I heard that dependants on tax return should be counted in Household Size section of I864.

    ARGH! So sorry...I had to look at the I-864A again. I thought you filled out the same Lines on it as you do on the I-864 and that the grandmother would be included there. Yes, the grandmother should definitely be included and since you don't fill those same Lines out on the I-864A she would have to appear on your I-864. My apologies!

  6. Just be sure your co-sponsors do not also have 1099s and/or Schedules to include with their tax return copies; I'm assuming you have their W2s.

    If you are submitting new I-864/I-864As and your incomes meet the 125% poverty level then you don't have to include any assets (such as real estate). In order to do that successfully you should submit a recent appraisal as well as a statement from the mortgage company reflecting the outstanding balance and any liens against the property. If you don't have all that, it's best to just omit it.

    You mention employer letters but did you submit paystubs at all? These are needed as well; a sampling from the past 6 months in addition to the employer letters is beneficial.

  8. Attaced is the picture of part 5, household size, of I864. Please take a look and tell me if I did it correctly. My situation is that I have been living with my father, mother, and brother ,so here is 4 people. In addtion to that, my grandmother's name is on my parent's tax return, so add one more ending up 5 people. Lastly, of course, adding my little cutie wife, ending up 6 people in total in my family. But I am confusing on item e of part 5 of I864, since I don't have any other dependents rather than my wife.

    Plese look at the pic, and tell me. Thank you.

  9. That is what the form is called; there are different ones and it is called a Schedule (followed by a letter). Someone who owns their own business would fill out one, for instance.

    If you didn't fill any of these out then you don't need to include them, they are just the ones that are required if you send in your tax return copies. I don't know your situation so wanted to include them all.

    6, my wife's photos and posspart copies w/ I 94, front and back.

    7, employment letters

    8. A bank statement showing that the monthly payment for mortgage, becuase I included the value of my father's house on his I 864A.

    9. An assessment for the house issued by the state department, showing the value of that house.

    Besides adding the value of the house on my father's I 864A, my household income exceed the poverty line in my case.

    This time, can I just send the most recent tax return, which means 2006 only, and all I 864 forms but just excluding the value of house. That means I won't put my father's house on his I 864 A this time .Is that Okay?

    It seems that I didn't send in 1099s.

    I believe I don't have schdules.

  10. Did you send/are you sending the W-2s, 1099s and any Schedules that went with the tax returns? I don't see them listed and they are necessary if sending a copy of the tax returns.

    I did send all W2s w/ tax returns. Now it seems that I didn't send 1099s. Can I just send in all tax returns that I have right now( I have so many copies)?

    The notice gives a way from which tax transript can be otained from IRS. Is this suggestion only for whose who don't have copies on hand? I do have so many copies of tax returns.

    I would just send them what you have NOT already sent. I'd include a cover letter stating what was already sent, and what you are sending now is a supplement. I don't think sending them the same information over again will help, it appears they only want some things that you did NOT already send.

    I don't think there would be any great harm in sending duplicate information, but if you don't find the items you failed to send the first time and send those, then you might be looking at more delays.

  12. Hi you all, I got a Request for Initial Evidence I 485, today. After reading it very carefully, I learned that I have to submit all the Affidavit of Support forms again. Specifically, the 2006 tax return. But, I do remember I submitted all necessary forms.

    Attached is the letter, and I know it is long, but please read it and please please tell me exactly what I need to mail in again. Thank you very much.post-39326-1189568305_thumb.jpg

    My suggestion would be to read everything in that notice carefully. If you already submitted the I-864, and you kept a copy of what you sent, look it and the instructions for the I-846 very carefully and make sure you answered all the questions completely. It appears to me that either you did not send it in or sent it in incomplete or they would not be asking for the I-864.

    I got an RFE that only had the language about the taxes, (I had sent them 2003-2005 and a letter from my employer and for 2006 as I had not gotten taxes done yet). Since your notice mentions the I-864 AND the taxes, I would assume you need to send both.

    Yes, if you had a joint sponsor, then you need to send that as well. These RFE's are clearly "boiler plates" and are designed to cover various contingencies. You did not mention anything about a joint sponsor in your initial question so I was just assuming you didn't have one.
