  1. A colleague of mine is a Italian citizen which received a company sponsored O1 visa as an exceptional talent in his field (engineering).

He is already in the US since March 2015 and he is eligible for Green Card immediately.

However, he would like to bring in the US his fiancee, who is a Russian national studying and living in Germany.

    Marriage is the plan.

Not sure which way it is feasible, in particular marry as an O1 or marry as a GC holder.

    Any help is appreciated.

    Thanks

PS: not sure if this topic should be in this forum or in the family based visas. I put it here because O1 is a work visa. Thanks

  2. My company, even though is a 12 bilion Fortune 200, has a very incompetent hr department when it comes to hiring foreign people.

In my team we need to hire an engineer and we found a very skilled Italian phd who is currently doing research as post-doc at an american unicersity on a J1 visa.

How is the situation with the H1 quota? Did they already run out?

If so, is there another way to hire quickly a highly educated and skilled foreigner worker already in the us on a J1 visa?

    Thanks

  3. I filed for US citizenship on February 2011, having been married with a US citizen and lived in the US for 3 yrs (we live in the US since Nov 2007).

After few weeks I received the notice for biometrics and I went and did them.

Again after few weeks my online application status changed to "Testing and Interview", application was transferred to a local office (Chicago).

After this I haven't heard anything for months (processing times are advertised as 5 months).

Last week I called the 1-888 USCIS number and opened an inquiry for my case status, since it is way beyond the normal processing times.

Yesterday I received a letter from USCIS saying that my case was administratively closed on 07/22/2011. I can write to the USCIS office to ask them to reopen it.

    What does that mean?

I haven't received any communication from USCIS. Am I missing something? Did I do something wrong?

Do you suggest me to try to hire an attorney or just try to keep going by myself?

    Any suggestion is appreciated, thanks!

  4. Yes, I did include affidavits of people we know.

    Regarding utility bills:

some accounts are registered in the name of my wife (gas & electricity), some in my name (TV,...).

We do not get bills with both our names on (if I had known......), but I can show that bills from both accounts (mine and hers) are sent at the same address.

Can this be considered as an evidence?

What about my question 2) above about the bank account?

    Thanks

  5. I filed my I-751 in September 2009. Yesterday I received a letter from USCIS requesting more documentation to prove our relationship.

    My situation is the following:

    - We do not have children yet

    - Me and my wife we rent and we do not own a house (we did not want to buy a house with the market that keeps crashing.....)

    - We own 2 vehicles and we have no mortgages or joint properties

    - We kept our separate bank accounts

The only documents we could provide are the apartment lease, the common health insurance and vehicles insurance, my 401k and life insurance where she is the beneficiary, plus sworn statements from different people.

    I have two questions:

    1) Is this enough? Can you suggest me any other documents that I can provide and that I did not think about?

    2) I can go to the bank and change my bank account to a joint account between me and her. If I do it now is it a good move? Or it can be intended as a bad move (since maybe they just look for our history in the past 2 years)?

Thanks a lot for your help.

  6. Sonia,

we are in a similar situation. My wife (USC) stayed 1 year illegally in Italy and gave english lesson, paid under the table.

We are not going to count this income. We still have to write the letter, but we will write that she was visiting me in Italy and she did not work.

My suggestion is to try to get the sponsorship using assets, considering the strenght of Euro compared to US$ it should not be difficult.

Otherwise go for the joint sponsor (one of your parents or relatives, or also a friend....)

  7. Thank you!

Now things are getting more clear.........

My only doubt, at the moment, is about my US wife incomes (point 22 and 23 of I-864).

We live in Italy, so these incomes will be lost as soon as we move to the US. So should she put 0 (zero) incomes, or she can put her italian incomes?

In case she can put Italian incomes, should they be the ones of the last entirely past year (2006), or should they be the incomes of the last actual year (from Sept 10 2006 to Sept 10 2007)?

Incomes should be considered pre-tax or after tax?

    Thank you again!

  8. Thank you very much whattodo! (nice nickname, why changing it?)

As far as I understand, the only way to understand if a house is a good assets, is to call them.

Regarding the number to call (the one at which they answer only during certain times......), are you talking about the normal landline number or the 899 number (the one which cosst 2 euros / min)?

Regarding the sponsorship problem, we can also be sponsored by my wife's father. He is a veterinary and he owns a clinic, so he has the requirements to support us. However, at this point I do not really know if the household changes. In other words, if we could sponsor ourselves the household number would be 2 (me and my wife). If my wife's father is going to be our joint sponsor, do we have to join his household? In fact he already has a family with 5 members, does it means that me my wife have to join his household (that would be 7)?

In this case the poverty line would change drammatically......

I know these questions seem really complicated, but the form is not really clear for these points.......

Regarding the time-line. Do you mean 4 months from the I-130 acceptance or the I-130 submission? I submitted the I-130 in Jul 2007 and it was accepted in Aug 2007....

    Thank you!!!!!!!

  9. Dear bbwings3,

it is so nice to hear there are other people sharing the same adventure and feelings.

I am an italian citizen, married to a US wife. We live in Parma. We applied for DCF because I had an important job offer form Chicago (amazing city...) but H1B were expired.

I am in a difficult situation because the company is pushing to have me as soon as possible, but I do not know exactly when the process will be over.

We applied the I-130 petition on Jul 25th and it was approved on Aug. 20th. Then it was sent to Naples, but, since then, I haven't heard anything. I tried to call them, email them, but there is no way to get in touch with anybody that can be helpful.

Since some documents can need months to be prepared, I must know asap what will be future steps.

Is this packet 3 something they are going to send us with all the required instructions? How long did you receive it, after your petiton was approved?

Did the US consulate send it to you? Is it possible to find somewhere a copy of this packet 3?

Did you figure out if a job offer can be attached and somehow included in the I-864

If you have any other question, please let me know. I hope we can share our knowledge and help each other.

    Thanks and good luck!

  10. Dear whattodo,

I am more or less in the same conditions you are. I am italian and my wife is a USC. We are living in Italy.

My I-130 was approved m/l in 1 month and I think your cover letter and your supporting documentation is more than OK.

I did not even send a cover letter, we just signed the documents cehcklist.

Please check my last post, maybe you can help me with some answers.....

Good luck and keep in touch!

  11. Hello all!

I am an italian citizen, my wife is a US citizen. We are currently living in Italy and we plan to move back to the US where I had an important job offer form a company in Chicago.

We already applied for an immigrant visa. Our I-130 petition was approved by Rome on Aug 20, 2007 and sent to Naples Consulate.

I tried several times to contact Naples but I was not able to speak with anybody! I would like to receive information about the next steps. In fact the company in Chicago needs to know when I will be available for moving and start working!

In particular I have some questions:

    1) After the I-130 petition, which is exactly the list of documents that we should start preparing for the next interview in Naples?

    2) Is the I-864 one of the required documents? If yes, I need some important answers (consider that we are both living and working in Italy and any incomes and asset we have is from Italy).

    - I-864 Part 6 - point 23:

Is this the income my wife (the petitioner) had since Jan 1st 2007 until nowadays?

Is this the pre-tax or after tax income?

Can this Italian income be counted, even if, moving to the US, she will lose this Italian job and the related income?

    - I-864 Part 7 - assets:

We should consider only the assets that we own in the US, or can we consider also the assets we own in Italy?

I (the beneficiary of the petition) own a house in Italy. Can I count this as an asset?

    3) Will all the medical examinations be performed in Naples by US-consulate authorized doctors? Or should I do them with my italian doctors and then provide certificates and documents?

    4) Considering our petition has been approved on August 20th, when we should expect to be contacted?

    5) Is there a way to have an expedite process (e.g. paying larger fees.....)?

I hope someone can give me some answers! I reaaly need asap to contact the company in Chicago......
