  1. My wife's interview is on March 19, 2013. Do I need to file 2012 taxes and bring my returns and new AOS to the interview? Will the CO ask for them or can I wait until I go back to the US to file taxes? The AOS I planned to bring has my returns from only 2011 which is slightly above the threshold and my home as an additional asset.

    Not sure about your case....however my parents in-law is scheduled for the interview on March 11, and it is required the most recent Federal Income Tax Return even though our income last year was over the poverty guidelines.

  2. Was he a US citizen when the children were born? If so then he shouldn't petition for them because they have a claim to US citizenship. He should help them file their claim by proving parentage, and they'll get a US passport. In addition to being a US citizen when the children were born, he must also have lived in the US for a total of not less than 5 years, and at least 2 years since he was 14 years old.

    If he wasn't a US citizen at the time the children were born, then he needs to file an I-130 for each child.

    If the 18 year old is unmarried then he/she is eligible for an IR2 visa. If married then he/she is eligible for a family 3rd preference visa.

    If the 21 year old is unmarried then he/she is eligible for a family 1st preference visa. If married then he/she is eligible for a family 3rd preference visa.

    He will do the Oath Ceremony tomorrow morning, so he will become a USC tomorrow. They're both unmarried. Daughter is 18, and Son is over 21.

    Second question, I'd like to ask. He is now divorced and has 2 child. So if he petition for his children in Vietnam, for the Affidavit sponsor, is that count 4 ppl? he is currently paying child support every month.

  3. Just want to get your input/experiences. My brother has 2 children with his ex-girlfriend before he left Vietnam, one is 18 and other is over 21 years old now. I am trying to help him petition for his children come to the US. He is USC.

    1. Can he petition for his children? If yes, is that I-130 form? if NOT...what I should do.

  5. A friend of mine had the same like your situation but he found out before he filed K-1, his baby was born in the US. He is a member of VJ, search for Bill name. I'm not sure if you need to notify the USCIS right after you receive the NOA1. Good luck and Congrats

    August -2006: Filed K-1

    January - 2007: Requested close the K-1 at U.S Consulate due to our relationship didn’t work out

    September – 2007: Filed second K-1, of course not the same person.

    I frontloaded the letter that I requested to close my first K-1 and also the letter from U.S Consulate confirmed me that the case was closed per petitioner requested. During an interviewed, the CO questioned my wife if she was aware of I had previous fiancé, and she said yes. The next question was…did you know why their relationship was end up? and the answered was match with the letter that I wrote before…Anyway, she still received 2 blue slips, but it was not about the previous fiancé, it’s about timeline and birth certificate.

    My questions if she said I work from Nov 2005 to now, my concern is if the CO look at my tax return on 05-07 intel wasn't on it, only Kelly Services is. Will this raise red flag to them? This was what the CO ask my wife on her first interview.

    She have on Feb 2008.

    CO: Where do your husband work?

    My wife: He work for Intel

    CO: How long have he work for Intel?

    My wife: two years, but ther was a short time he got layoff.

    CO: Why he got layoff?

    My wife: Because the company was down.

    CO: Why the company was down?

    My wife: Because there is no production.

    After that, the CO said on the white slip that my wife dont know about my work. I dont understand what went wrong there. Unless the CO look at my tax and don't see Intel on it. That's is what I think but not sure.

    What do you guy think??

    This is what I understand...

    Nov - 2005 to Jan - 2007: Worked as a contractor for Intel company

    Feb – 2007 to June - 2007: Got hired as a fulltime employee for Intel Co

    July – 2007 to July – 2008: Layoff

    August – 2008 to Present: Intel Co rehired you back.

    Question:

    -From July -2007 to July 2008, did you start to work somewhere else? I assume you are not.

    And here is my opinion,

    **Base on the employment verification letter

    A. August 2008 to Present: Work for Intel Co

    B. July – 2007 to July 2008: Layoff

    C. Feb – 2007 to June – 2007: Worked for Intel

    I assume that CO will ask the same questions again…here is what I will response

    CO: Where does your husband work?

    My wife: He is currently work for Intel

    CO: How long has he work for Intel?

    My wife: Since August 2008 to Present…To me, you don’t have to say that you were layoff in a short period time, because the CO didn’t ask for it. Just straight answer to the question

    CO: Where did he work before?

    My wife: Same company but work as a contractor.

  9. OK OK.. I got this figure out. What my brother finance was saying was that she will turn 18 in Nov. 2010...She told me that Vietnam laws say that she is of legal age to get marry, anytime in 2010. I thought it was ridculous so...I called the Vietnam Embassy in Washington DC today...and they confirmed it. The lady I spoke too said as long as she was born in 1992 ( regardless of month and day) she was consider legal to get married. As crazy and odd as it sounds...its true. I had to ask twice..just to make sure.

    Ask your brother's fiance, go to "Uy Ban Nhan Dan Phuong" where she lives to confirm if this is true before moving forward to the next step. My cousin got married at the age 17 and 9 months but she was unable to register the marriage's license, they told her must wait until her birth day.... Female is must 18, and Male is must 20 years old in order to register's marriage's license...she just got married last year. So be careful then.

    I got a wierd question for you guys...So my brother recently got engage to this girl in Vn. They are planning a wedding this summer. She is twenty years old, however her birth certifcate say she will be 18 in Nov this year. ...so she is technically under 18..

    She said her mom for..whatever reason changed her birthcerifcate to make her younger..( i have no idea why?")

    They said they went to ask..someone.. (I have no idea who)...but they were told that as long as she was technically turing 18 this year...it will be ok. Aparently, the go by Year...not month and day..?

    I have a wierd feeling about this...what do you guys think?

    Your brother MUST wait until she turns 18 years old base on the Birth Certificate, otherwise, he will getting a big trouble with a Vietnam’s law. If I was your brother, I will NOT take this risk.

  11. hi i been at this forums looking at the guides for a few day already and learn sfrom it but i have one questions since i know applying for a K1 in vietnam is alots harder then most of the country out there what other forms or documents do i need to fill in before sending in my i-129F package to the ucis here in the states so far i have

    1.I-129F

    2.Cover letters and supplement letters for question 18 explain how we meets

    2.2 passport style photos

    3.picture of our dates and engagement ceremony and boarding pass of all my trips and paypals invoice of the payment i made to the phone card company that i purchase from them, email betweens us, my citizenship certificate

    is there any other forms i need to file before sending in my packages?

    because i heard from other that i also need her birth certificate and also send in the I-134 Affidavit of Support form along with the packages instead of waiting for the I-129F to be approved first is that true?

    also this is for K1 visa sorry forgot to mentions its

    I front-loaded my wife copy Birth certificate & my BC. At the interview, the CO asked our parents Birth certificate because we're having the same last name, so, if you & your fiancee having the same last name, be prepared Birth certificates for both side.

    About I-134, you will do it later at US Consulate. Hope it helps.

  12. Bernie, check to see if she needs more before she can adjust status... Thuy had the initial and had to go back last month for another vaccination and they said she has one more to do in Sept. which that one willbe done here if HCMC gets the file processed...

    Each person is different but it is common for them to require 2 or 3 rounds... usually when pink is quick the remaining 1 or 2 are done in the US...

    And always remember that the vaccinations, if done in VN, must be done in HCMC... no way around it...

    you're right, my wife had a second rounds in the U.S before i filed the AOS(she had the first round in VN)...I couldn't remember the form.

  13. I have a few suggestions for people going through HCMC with multiple high end gifts or things for resale. I just went through and had to “pay tax” because I brought to many “expensive” gifts. What caught their eyes were not the 20 boxes of Jello cheese cakes, or the 20 containers of sugar free drink mixes, it was two cell phone boxes (apple iphone). So for those of you going through with expensive gifts, I would recommend that if you have multiple cell phones keep them on your body, they don’t get scanned that way, and if you have new boxes put them in different bags, this way unless they are paying attention they will only think one cell phone in one bag, or if you have them on you then they will not scan them at all. I would also recommend that you have two $50 bills with you. I made the mistake of only having one $10 bill and quite a few $100 bills. Good luck for all of you that go through HCMC airport, hope this will help you save some money or save all of it by sliding under the radar unnoticed. Jerome

    I usually pay them "coffee money" and they then let me go. I last time brought 10 wines and gave them "30 bucks".When I first went back to Vietnam in 1999, I was little anxious, but not anymore.:-).

    Correct me if I'm wrong...base on your posted, I assume that you're Vietnamese. Here is my thoughts, and experiences.

    - Your income will help you a bit at the interview

    - Did you say that you've been to Vietnam several times? How many trips did you meet her in person?

    - Since you and fiancee chit/chat on the Yahoo messenger, have you/she send any cards on Christmas, birthday? <== CO may asks fiancce this.

    - having an interview before Dam-Hoi, this will hurt you a lots since you're Vietnamese. So far, I was only see 1 or 2 cases in this forum got the visa approved without Dam-Hoi. If its me, I'm not going to take this risk.

    ***At my case: We had a Dam-Hoi/Dam-Cuoi "all in one" 10 days before my wife had her interview, but I still recieved 2 blue slips.

  15. Thanks Jim, I know I will be wanting to get one once I am there. With Binh teaching, I will want to get out of the apartment and do some walking and getting used to where things are, especially before she turns me loose on a motor bike. We still have heated discussions on this subject, but I am finially winning her over to my side. Binh wants me to rent one first, and I just want to buy a new one instead, I feel why waste money on rent when you know you are going to buy one eventually. 7 more hours before my plane leaves wooo hooo!

    I agree with you to buy one if you're going to stay there for a while, just don't waste money for rent. About the GPS, better buy it in Vietnam not from US. Good luck and enjoy your trip.

  16. A HIV test does not bother me at all, it would only tell me what I already know that I do not have it. Needles and everything like that does not scare or bother me as well. I just really wanted to make sure I have what I need from the USA before I come. I have a certified birth certificate, certified divorce decree, and also a certified note stating there were no records in the last 2 years of any marriage, so I think I have everything and am ready to go. Right now I am counting down the days, only 16 days left and a few hours......

    It is not going to hurt you, put the dated she was born 'til' present... I did exactly with my fiancee. About the pictures, I was only frontloaded 8 pictures. BUT I recommend you frontload the picutures as much as you can, liked other members said, make 2 copies, 1 keep for yourself/fiancee, other send to USCIS.

  18. As fas as I understand from Vietnam Embassy, HIV test is not require anymore based on the their docs and also in Vietnam.

    My friend got married in Vietnam 2007, all the papework he got done in Vietnam since he stayed 2 months. And there is NO HIV test required at all. I haven't checked with him if his wife was required for HIV test.

  19. I got all the paperwork yesterday, on the websites they say they also want from the state you are living in a authenticated statement that says there is no marriage's in the past two years. In Indiana they have no way to do this accept to go to every county in the entire state and have them check. So what I did was I had the woman at the Clerks office int he county where I live give me one and in it she stated "a search for the whold of Indiana at this time is unavailable" Will this be acceptable?     Just want give you a heads up on this, every single paper that you got from U.S, it must be certified by Vietnam Embassy, this is a long way to go…. I’m not sure if “So Tu Phap Tp.HCM” (I assume that you are getting marriage in Saigon) will accept the papers without Vietnam embassy certified. But if the papers from U.S Consulate in Saigon, it will acceptable. It happened to my friend.

    Since you’re going to stay in Vietnam more than 3 months, if I am you, I will do this…

    1. Make a phone call to US Consulate in Saigon, I’ll ask if they can provide me the Divorce decree and Certificate of No Marriage Record, and what is the waiting time for me to receive it, costs.

    2. I will ask my wife make a trip to “So Tu Phap TpHCM” and ask them if they’re going to accept the papers from US without Vietnam Embassy certified.

    You need clarification two things above, and make your own decision. I just want to help you out a bit before you go.

    In order to get marriage in Vietnam, these papers will be needed

    1.Application for Marriage Registration

    2. Affidavit of Single Status (both version, Vietnamese, English)

    3.Certificate of No Marriage Record (if married, Divorce decree requires)

    4.Certficate of Good Mental health

    5.Biographic Information Sheet

    6.Copies of Passport.

    And it MUST

    A. Public Notary

    B. County Clerk Certified

    C. Secretary State Certified

    ** Since you’re going to do all the paperwork in Vietnam, you will then need the number 2 & 3.

    If the County Clerk found NO record, you’re done.

  20. Yes, it is somewhat confusing. The USCIS service centers have one set of recommendations, which you pointed out. The National Benefits Center, which receives petitions through the Chicago Lockbox, has a completely different set of recommendations:

    Since an I-130 petition for immediate relative is sent to the USCIS-NBC's Chicago Lockbox, it's probably better to follow their recommendations.

    I didn't file I-130, but i did filed AOS and used ACCO fastener...and they still accepted, LOL.

  21. never leave anything blank.. either respond NA or none dependant upon the wording of the question...

    Scott, you are right, but I couldn't remember the instructions guide , i believe in some forms you must put NONE instead of N/A, i haven't got a chance re-look at it.
