that is just crazy ..you have never tried to call them or what ?there must be something wrong with that case otherwise you should get something bad or good long time ..how can you wait 1 year to search that ??

I had Noa1 last year (June 2007) Until now, We don't hear anything yet from USCIS. Anybody had the same problem with me?

My questions are:

1.) What are we going to do?

You should contact USCIS, as you are, I belive, outside the USCIS processing times window and an inquiry should be initiated as to why you've not heard anything in so long.

2.)Any number or person to be contact?

The 1-800 number listed on your paper NOA is the number to call

3.)We tried RFE trikcs couple of times, but it didn't work.

What exactly do you mean by "it did not work," what were you told when you spoke with someone? If you are in some sort of 'background check' scenario, then the delay in your case is plausible....so it is important to know what you've been told. When was the last time you called?

4.)Is it OK to file K3 and disregard K1?

You cannot file for a K3 unless you've married since you filed for the K1. If you have married since you filed your K1 petition, then you are no longer eligible for a fiancee visa and you must withdraw that petition before you file for a spousal petition (whether it is the IR-1/CR-1 or the K3). Without marriage, however you are not eligible for the spousal visas....only the K1 fiancee visa.

Either way I would get a definitve status update on this petition before thinking of any 'plan B' scenarios.

For RFE- I mean we don't get exact informations. Whenever we call they always told us they will going to inform whenever they give decisions thru mail.

hello guys! i just had my interview last tuesday, sept. 4. i was lucky i was interviewed by a very nice consul (male, white in his late 50s). after the interview, before i could asked if i am approved or not..it was the consul who said to me that i was approved and congratulated me.

i was very happy but i was a little worried because of some negligence done by filipino personnel there on my interview processing. i hope there will be no problem in the issuance of my visa. my experienced was really different from the others i read in the forum. i dont know if somebody had experienced it before.

anyway, i will post here my experience this week. i want to make it detailed for the others to have a clear picture on whats gonna happened inside the USEM.

i would like to say thanks to all the people here who never get tired of helping us. thank you very much guys. your sharings and advices are priceless.

now, im in the waiting process...for my visa. i hope and pray i will have it next week.

Don't take these numbers too much to heart. As Annette said, she was in the 100's when she was approved. I have a very strong feeling that many people haven't bothered to update their timelines. I find it difficult to believe (other than Cara and maybe a few other unfortunate couples) that there are so many from Jan-March that haven't been approved yet. I've been watching the people that have been approved lately and for the most part, their dates are pretty close together. So, I think that's a better indicator of when you might be approved. Plus, there are a lot of us whose NOA1 dates are much later than the sent date, due to all the data entry problems they were having. In "theory" they are supposed to be approving based on received date and not notice date. At least I am praying this to be true! Just keep believing your turn is coming soon!

I overnighted mine via USPS express mail last Wednesday, 5/9 to the VSC. However, I think I will be up for a RFE, as I put N/A instead of None for the spouse names question. Maybe I will get lucky and slide through. Haven't received my green USPS return receipt yet either, but I did get confirmation of delivery to INS, signed by P. Novak (VSC director?) on last Thursday, 5/10.

I think Marin and Jon 6/4/07 were approved around June. Some of his posts are mentioning biometrics interviews.
