I had a recent experience where I had a former student/post-doc with an SSN, who came back as a visitor and we needed to get him set up in Payroll as unpaid to be able to use our library. He was not able to get a replacement copy of his card, as he didn't have employment authorization, all that the Social Security Office would do is verify that he previously had a number. Luckily, his family was able to express mail his old card to us.
If the OP is coming on a K-1, since that status "has employment authorization" (you guys all know what I mean!), I think they should be able to just go in and request a replacement card. Notwithstanding the difficulty some people have had and posted about in the past!

Hi there. I am one of those stupid HR people who don't know what they are doing.
I process HR and payroll paperwork for a research department at a university, and have to verify employment for F-1 students, J-1 scholars and H1-b researchers. And I brought my husband over on a K-1 visa and we have adjusted status to conditional LPR (though he isn't currently employed).I have a couple of comments on the previous posts.
First - I think that, in the new M-274, when they refer to "An expired Permanent Resident Card (Form I-551) and Form I-797 “Notice of Action” from USCIS stating that the Permanent Resident Card has been extended for 1 year", they are not talking about the receipt notice, they are talking about the approval notice. See page 7 (page 9), just above "Table 1: Receipts": "A receipt indicating that an individual has applied for initial employment authorization or for an extension of expiring employment authorization is NOT acceptable proof of employment authorization on Form I-9."
Second, I am interpreting the statement about reverifying an expired Alien Registration Receipt/Permanent Resident card as the alien can't submit their expired card, they must have a new one. This is as opposed to an expired Employment Authorization Card, with an interim card or an approval notice. Or, they can use other documents listed on the back of the I-9.
I am attending a workshop soon in a couple of days, held by our international department, and will request clarification. Of course, they are going to be concentrating on implications for F-1, J-1/2 and H1b (and maybe a couple of O-visas!), but I can see if I can get more info. If folks can think of any questions, please post them here and I'll see what I can do.

Perhaps they sent it directly to your employer. I checked my files for the one time I requested a waiver for an employee who was changing from J-1 to H1b, but that file was archived already so I couldn't access it.

An H1b requires a bachelor's degree. Also "H-1B classification applies to persons in a specialty occupation which requires the theoretical and practical application of a body of highly specialized knowledge requiring completion of a specific course of higher education."
You have to be sponsored by an employer, you can't petition yourself.

I got the mail out of the box and saw an unexpected letter from Laguna Niguel and my heart skipped a beat. Bent the envelope and felt a card and I nearly fainted in the middle of the road
My wife's totally uncontactable until she finishes work because she's out of the office and the silly thing didn't take her cell so VJ, you're the first people I've told

F-1 visas are specific to a school. The B-2 visitor needs to be accepted by the school first, and they will initiate the change. See 2. OVERVIEW OF THE STEPS TO BECOME AN F OR M NONIMMIGRANT STUDENT:
2.2. From within the United States
The prospective nonimmigrant student must:
1. Be in the United States in a valid nonimmigrant status and eligible to change to F-1 or M-1 status (See USCIS website on who may change status).
2. Be accepted by an SEVP-certified school, receive a Form I-20, and pay the SEVIS I-901 fee, as in steps 1 to 3 above.
3. Use a Form I-539 to apply to USCIS for a change of status.
4. Receive approval from USCIS for the change of status.
5. Be prepared to depart the United States immediately if the change of status application is denied.
I hope this helps. It looks like there is an alphabetical list of approved schools on the site as well as a map to find one.

thanks for providing the links. I already been there so many times and have all the info stuff sent by them through mail.
I even talked to them on phone and they had a difficult time understanding my status. I am NOT an international student on F1 who needs I20 to study here.
What is my status here as far as study is concerned. Am I a permanent resident ? not right now but after 2 months when I get it, I would be right ?
Secondly. instate requires one year of stay - so even after being a permanent resident of PA I am still not qualified for the instate tuition benefits.
I dont drive right now so I have to wait for my wife to drive me there in the weekend
Most schools don't have many new students coming in with family-based immigration questions, they have mostly students seeking F- or J- visas, so they simply don't know (keeping in mind that the school sponsors the F- or J- holder).
New residents of PA have to reside for one year for in-state tuition, it's that way even if you are a citizen moving from another state. I know that there are documents one can use to request reclassification to in-state status, but it's not a certainty that they would grant it, and looking at the one for the University of Pittsburgh, it looks like you would have to already be registered and perhaps already paying out-of-state tuition.
It also probably varies by school, too.
Please note, I don't work in an academic department, so my familiarity with tuition issues is slight!

I'm sorry to hear that! But what kind of Highschool issue I-20 for F-1 visa? As far as I'm concerned, F-1 is for colleges and Universities, that might be why USCIS told you that she was out of status. I'm sorry that she was mislead like that. It is sad because she was just doing what she thought was right.
F-1 is not just for post-secondary education. Students - in Public Schools - Grades kindergarten through 12th grade

For what it's worth, here is a link to the Community College of Allegheny County's page on determining residency; and here is the same for the University of Pittsburgh.
It looks like you would need to reside in Pennsylvania one year before you could petition to be classified as a resident for tuition purposes for these schools. It *may* be that private schools or vocational schools have different requirements. If you have a school in mind, have a look on their tuition page, there will probably be a link to residency information.
(And the same goes for other states as well - the schools should have some sort of link for residency.)

Hello, everyone...I just thought that this thread would be pretty helpful for people who are going to contact their Senator or Congressman...if you don't mind to tell us about your experience in details...like who had to contact(you or the USC spouse),how(phone,email,fax,letter via mail) and what did you tell them..I can't think of anything else right now but I think that this would be a great help!!! We are about to contact ours(not sure senator or congressman) and need some help and recommendation..we have been waiting for my 10 yr green card for 13 months now(VSC) and my heart breaks every time I see people who applied months after us getting approved...thanks for sharing,I am sure a lot of us here will be grateful too

We are looking at a move back to the U.S. (all going well with the visa) around the end of this year. My husband (US citizen) just cannot stand it here anymore and wants to get home. Some days I'm excited about the move and other days, like today, I'm very nervous.
I worry that our standard of living will drop, that DH will have to take a pay cut to get work ... is there even any work out there? He's extremely qualified and has said that his line of work is growing at the minute (I.T/I.S. Security), but how do people out there find things? I know every sector is different and I may aswell be asking "How long is a piece of string?" but any thoughts?
Here is a suggestion, have him check for university and government CSIRTs (computer security incident response teams) in your area...

Has anyone been able to do a credit check on their spouse. I am wondering what the best way to do this is. Currently, my spouse only has a K1 visa and and I-94 (which expired last week). She does have a social security number from a few years back from a J-1 visa. Is this Social security number all I need? Thanks
Her social security number (and DOB etc) are all you really need - can request a free credit report from http://www.freecreditreport.com/ but I don't believe her credit 'score' is listed there.
Actually, I think the site we want to use is called AnnualCreditReport.com - the FTC says the other sites are not really free, but have hidden fees or require (paid) enrollment. See this press release.

I am a UK citizen who is employed at a US university. I was previously on an H1B visa (a few weeks ago). While on the H1B visa, both payroll and the University's International Office determined that I was eligible to claim a tax treaty exemption. I was exempt from Federal and State taxes from November 2007 up until a few weeks ago. This is because I recently got my Green Card (through marriage to a US citizen). I fully understand that the tax treaty exemption no longer applies to me and that I need to pay taxes. My question is do I have to start paying full taxes right away or can I wait until the beginning of the new tax year (next year)? In other words, will the taxes have to be deducted from my next pay check? I cannot afford this at the moment and if it is acceptable to pay the tax as a lump sum at the end of the tax year, I would prefer this option. Please advise. Thanks in advance.
Nobody actually pays income taxes until they file the annual return... all amounts withheld are put on "deposit" until you file... however, if you underpay your tax liability you could be subject to penalties....
Social security taxes on the other hand are not negotiable and must be paid concurrently....

Go to your payroll department, explain the situation and perhaps fill up a new w-4. If not enough money is withold from your paycheck there are hefty penalites... Google for 'penalty underwithholding'
Yes, your FIT will be deducted from your pay. You would need to submit a new W-4 to your payroll department. Here is a tip:

● when you decrease the number of allowances, the amount of FIT withheld is increased - your net pay is lower, but you may get a tax refund
Here is a link to the IRS Withholding Calculator, you can try different scenarios and then revise your W-4.
