back from cambodia
got a letter from uscis on my k3 visa
they sent me a blue form and a letter asking for a copy of the original marriage liscense in kamai,
now i since i don't read kamei i had to find a cambodian go through all my paper work and try to find a copy
which i don't have,
somehow it has been lost i think it was the lady whow did the k3 visa for me
whow is now missing,
and m wife can not find a copy in her stuff in cambodia.
my lwyer that i had in the beginning whow did the originalmarriage visa, whow i fired senr me all my paperwork, which i'm guessing was everything i sent to the lady whow did the k3 visa i29f, and sent me back everything, i think,
so no copy anywhere of original kamei marrige visa,
my wifes father went to where we got the first marrige visa the original when we were married, the don't have copies. nut they will make me a new one, will this be suffecient.
will i have to let them know it is not an original or a copy of the origional it's a new one.
she wants me to send her a copy of the english translation of the marriage certificate so the can make it as the first.
i'm wondering should they date it, the same as the original, or have both dates the original and the date its being remade

i jsrt got back from a month trip to cambodia thought that i might be able to get some help at the embassy in cambodia, and i wanted to visit my wife, no help at embassy, but was great to see my wife.
before i left i got a letter on my i=130 petition for marriage, it stated they would have a answer for me within 60 days but have heard nothing on it as of yet, but yesterday i got a blue letter on my k1 visa asking for my original marriage liscense in kamei, to be sent to them, and heres the letter i sent o an attorney

i found a attorney by the name of marc ellis, and so far he has showed some interest in my case, he said he will look ay my paperwork interview my wife fora fee and then give me his evaluation
and we can go from there, wehave only emailed he said he might even meet my wife in seam reap this weekend for interview, so ithink he is based rightnow in vietnam, i'm nt sure, thats a guess,
but this is very hopefull for my wife and i.
the reason i was so gloom was the office manager for congressman jerry lewis here in redlands, whow handles imigration matters told me in no uncertain terms that when it goes to investigations like mine has that it can take yeats and nothing they can do or anyone else, and inher experience it wouldn't be aproved,
and i talked to another lawyer that would do a writ of mandamus, for 5000 retainer, and it could cot up to 10000 more with no guarantees
and now this ewlawyer marc ellis says definately not to do what holmes and tuttle suggested, tp withdraw both visas and start fresh with them, becouseitxould make her
enelligible to ever come to the usa ever again

i wonder why this has to be so hard,
everyone has said the difference in our ages most probably is one of the problems, don't seem right

yes i'm a us citizen
i justn spoke with a lawyer they told me to let them withdraw everything
and start from scratch they could guarantee me she would be here in 9 monthes
their fee refundable

the lady that does the imigration cases for congressman jerry lewis, whow i spoke with told me that when it takes this long to get aproved they never do
she basically told me to just forget it, that it was going to be denied had no sympathy and thought the process was just, do you think this is not true and it could still be aproved, and that this happens and people still get ok's
becouse i am going to keep fighting i'll go broke if i have to and sell everything
i made a committment to my wife and i am going to keep it.
this tough and its hard hetting real answewrs,

and , would like to know if anyone else has had to wait this long, and what would you think the maxim amount of time they would make someone wait, like this?
any one know of any good imigration lawyers thaty are familiar with the cambodian side would this help?
someone told me i should go back to cambodia and go to the embassy there or call there, but i think that would be a waste

i'm not rich and i don't want to fork ovwer a bunch of money to a attorney that can do nothing,
if my first attorney would of gone with the fiance route with the marriage in the first place this would have been already resolved, at least the fiance part, she might have already been here, but thats history, he lied and thats that

yes that is true but if our marriage visa has gone into investigations, which i'm told it has, then i would think the 2 would be klinked and thety would not aprove the 129 f either since i'm aleady in ivestiogations, but i don't know, thats what i'm trying to find out
they won't tell me anything
just that i should feel free to contact them if i don't hear anything within 6 monthes
i just can't believe i would be treated this way
it doesn't make any since to me

and i was told that you can do a i29f form by the ins when i went on a info pass meeting they said you aply for this and it should take at the max 8 monthes and when it is aproved she can come here and wait for the marriage visa to get aproved

when mycambodian friendi worked with if he new any nice cambodian girls that might like a us husband, he said he would check
and about 2 weeks later he brought me a pic of his neice whow was 22 at the time i was 53,
i liked her, and i said i'd like to talk tyo her meet her etc.
we text each other i sent emails and we talked on the phone, regularily she was taking english in school
aboutt 5 monthes later after my passport came i tok a trip to cambodia
, to get married we had already decided to take the plunge, i was therer 4 weeks and we had a traditional cambodian marriage
ever since then i talk to her on the phone 2 to 3 times a day
i haVE since went back to visit her once
i will go back again when she has her interview to do with her
i send her between 4 and 5 hundred dollars every month,
i feel so soory for my wife she has put her whole life on hold for this, she is a country girl
never been in anty trouble never had any boyfriends she works hard, now in her prime she has had to wait all this time
we ove each other and we are married in every since of the word.
i am not going to give up on her the must be something i can do
i have done a i 30 petition and
a i29f petition
i have talked to ins on the phone numerous times, and i have gone to my local off ice a hand full of times
no one will tell me anything, why would they treat a natural born us citizen like thi
my last wife was us born also,
i have never even been outside of the country before
except mexico

i have no fellanies
i haven't even had a ticket in a about 6 years
i pay all my taxes
this is such a bad situation, for everyone

on the same job 14 years
my wife is in cambodia her first marriage
i was married once before in 1979 divorced 10 years ago
i'm in redlands ca
my wife is in battabomng cambodia
her family is from the country
i met her through her uncle whow i work with
i have been to cambodia 2 times now
first time i went and got married
2nd time 6 monthes later to see my wife
i talk to her 2 or three times a day
every day
she speaks english pretty well
i had a traditional cambodian marriage
took 2 days

it never has asked for anything
they always tell me that the info on the website is wrong
yes they made a official inquiry
and my case has gone to investigations
they say that is all that they will tell them
and all they tell me is their dooing backround checks and if i don't hear anything from them within 6 monthes feel free to contact them again
the congrasssman lady said that these things can take years
and usually get denied, and you can't do anything till it is officially denied

its not really that complicated its been almost 2 years since i aplied for the marriage visa

they just tell me their still doing backround checks

the congressmans secretary told me alwyer could do nothing tell its denied, and she said it could be in investigations for years
but what i want to know is the k3 visa going to be held up too
she says it will,

neither 1 has been aproved or disaproved, but i'm told that the i29 f won't be aproved if my marriage visa is being in investigated

i had a lawyer, and he never said anything about a k3 visa, i only found out about the k3 visa after about a year when i called the ins to find out why my visa was taking so long, i called my lawyer and asked him to do a k3 visa which he acted like he new nothing about but siad he would do it he never did, and i didn;t kow it, so i fired him and did the k3 visa 2 monthes ago,
i have never been aproved or didproved for the marrige visa yet,
even though online it did say 2 differnt times it was ok'd
but come to find out through further investigation it was a mistyake, now they are saying they have sent my marige visa to be further investigated

after talking to congressman jerry lewis's secretary today, i'm loosing all hope, this has been a long drawn out affair, i got married on aproximately thanksgiving 2years ago in cambodia, i'm a us citizen 55 years old, twice online it has told me i have been aproved and twice they have told me theres a mistake, i did a k1 visa 2 monthes ago, and recently i have wemt to see congressman jerry lewis in redlands ca, and his imigration lady has informed me that my case has been sent to investigations , and that it could take years to finish , thats her experience and that rarely do they get aproved when they have taken this long,
i just don't know what to do at this point, i had a la lawyer and he jusrt robbed me and did nothing, all the uscis has done now is sent me a letter and sid that their investigating my case and if i don't hear from them in 6 ,monthes feel free to contact them, ,
what about my k1 visa will it get held up too becpuse of the investigation on my marriage visa, if so why did the ins tell me to do the k1 visa?
i hope some one can help or tell me where to go for answewrs thanks

K1 visa? Marriage visa? None of this makes sense. If you are married you are not eligible to apply for a K1 visa. That is for fiance(e)s only. What exactly did you apply for and when?

update just now about an hout ago received mail saying we were approved on the i130 petition
not quie sure what this means now
after 14 years on the job was fired 4 monthes ago becouse of going to cambodia yo many times and stayed too long rge last time
so im unemployed now collecting unemployment
so i dont know what comes next now
they say that the original sent to my original lawyer
have to call him tomorrow
and that they will be contacting my wife for further instructions
will i have to pay the existing rate for the visa or can i pay what it was when i filed
any way anyone know what i should expect now
