Yesterday we got our NOA dated 5/23/11 (added below).
If I understand the letter correctly, we can travel internationally (just with hubby's conditional perm resident card/passport and this NOA letter) while they continue the process of ROC, correct?? Do most ROC cases need interviews as well as the biometrics apts? Just wondering what to expect.California Service Center (14 applicants)

Hi suzannyo, when is the sent date? (Not delivered date) You need that date for the list
Sent date was 5/19/2011. Still haven't received any mail back, but per the USPS website, it was received on 5/21/11. Can someone add us to the list, pretty please?

We sent ours in last week and have confirmation that it was received on Saturday, 5/21/11. Hoping we sail through!

I translated the documents myself and then just paid for a seal/letter of authentic translation to be placed on the documents (they inspected the original docs and made sure the translation was true). I did this through the official government translation office in my hubby's country. In my case b/c it was only a few 1 page docs they did it all in less time than it took me to go to the bank to pay for their services (<1 hr.).
When I've applied for visas for myself to other countries, I've also done my own translations (w/o any kind of certification) and never had a problem. But, I'd ask around for advice from people who've applied for the same visa using docs from the same country you are, just to be safe.

Hi, the way I understand it certified translations can only be done by by a certified (sworn) translator who passed an exam and is registered to do this job and has his licence. The translation of my birth certificate includes each word that appears on an original document ( even stuff like ' illegible signature' and explanation what a round seal says). Down the page there is information about the translator: his address, licence no, fee, stamp, signature, and his statement that the translation is in accordance with he original document. This is the way I did it and no REF. Good luck! -

We had a similar situation. Hubby entered on a tourist visa, we married in Nov. Our plan was for him to go home in Jan and then to start the K-3 process, but immigration folks when he entered the US told us we'd be better off applying for AOS with him still in the US. So, we asked around, found a lawyer, and we finally sent our packet in in March (tourist visa was good until May). We had our residency interview in June. Just before hubby's visa expired, I called our lawyer to confirm that we didn't need to do anything to adjust/extend his visa while we waited for the residency interview. Lawyer said that because hubby had entered legally and because we'd filed the AOS paperwork before his visa expired, we were fine. Hubby's residency was approved in June and his residency card just arrived today.
I'm no immigration lawyer, but I think you should be fine. Best of luck to you!!

helloMy i-94 expires before the biometrics appointment date, I was told that I need not file an extension as a tourist (I came in as a tourist in january and we got married in Feb) since me and my husband already filed AOS and I-130. I am concerned with my status, Dont I really need to file for an extension as a tourist? I called the USCIS support center and was told that its my discretion to file extension or not. Help please.

I just tried logging on to the USCIS webpage for the first time and see that it says a new card was ordered today. Does that mean that we were approved?

The officer looked at our originals, verified the information on our application, flipped through our supporting documents and pictures, and asked us a couple basic questions about how we met. She did NOT take hubby's I-94. She said she wanted to review the file a little more and would be sending us out a letter either today or tomorrow. I'm freaking out because she didn't give us her decision then and there. Should I be worried? Has anyone else had the same thing happen?

Well, first of all, I want to say thanks to this forum. I got a lot of resources and advices here that are very valuable. Me and my hubby have just been to the AOS interview this morning. We got there on time, went through security, waited a little bit in the waiting room, and then a guy came out and showed us in his office. He seems nice, but pretty stern. He seems to be in a hurry too.At first he sworn us in, and asked for our ids. Then he asked how long we've been married, what my hubby's address, what my hubby does for a living, and what I do. He seems to be a little bit confused about who is the petitioner (my hubby) and who is the beneficiary (me). We told him who is who. He also asked me why I have an American name. I told him because I got adopted a few years earlier, and so I changed my name to that of my adopted parents. He then asked me my biological parents' name.
He asked for my passport, so I showed it to him. That's my new passport, so it didn't have my visa in it, my expired one does. So he asked for the expired passport. I gave that to him also so he could look at it. He took my I-94.
Then he asked to see our joint bank account and insurance. I gave him both of the originals and told him he can keep it because we have copies at our place but not with us.
After that he said the interview is now completed, and he told us to go home and wait 2-3 days for the letter of decision. The whole interview lasted for about 5 minutes. It was over before I can even realize it's over. But why didn't he tell me what his decision was right there and then? Is there something in our packet that is not right? The only thing he asked concerning our relationship is how long have we been married. And I still have my employment card. He didn't take it or ask for it. Is that good or bad?

I thought most places that you want to get your marriage lisence TO marry required an id card from the U,S and a possible social security. I know in my state you have to have a US id card to show
Why do this?? Honestly you will be waiting LONGER marrying on the b-2 visa for the k3 visa...I have heard many people waiting longer then the normal wait period of the fiance visa!
so why not go with the fiance visa and do it the legal way so you wont have so much red tape.
Kai and I thought about doing that but after reading the horror stories we said NOPE..we love each other and this short period of time is NOTHING compare to all the red tape we would have to go through!
There are some States that require an SSN for a marriage license but even those have provisions for marrying a foreigner. Just because the SSN is asked for doesn't mean it's required. Most have some fine print elsewhere explaining what to do if the applicant has never had an SSN.
Are you sure you "thought about doing that"? I mean the "going home" after the marriage part, you know the part that makes it legal? There's no extra red tape except, in this case, to actually obtain the B2 visa (far from a sure thing) but in your case there's the VWP.
These people aren't shortening their visa process, just hastening their marriage so a very sick father of the bride will still be alive to walk her down the aisle. If successful, they'll still be separated for most of the visa process, like many of the rest of us.
Pushbrk, thanks for understanding the real reason why we're trying to expedite the process - my dad. I really appreciate your comments and suggestions, which were much kinder than several others who replied. And, you're right, we don't know that we'll be able to get the B-2 visa, but we're going to try for that first as its seemingly our best option at this point. Either way, we'll still be waiting like everyone else for either the K-1 or the K-3 when the time comes. Thanks again!

So, does anyone know anyone who has actually done this? Marrying and then the non-US citizen returning home and applying for the K-3? Does anyone have a suggestion of a good immigration lawyer for a consultation in the Chicago area?
If we were just trying to get married and have him here, we'd be trying to avoid grey areas and apply for the K-1 like everyone else, but the fact of the matter is that we're trying to find a way to do this while my dad is still alive...it means a lot to both of us that he be there to walk me down the aisle, and he probably won't make it much past Christmas. Then when we have to apply for the K-3, I'm planning on staying here as long as my dad is alive and then hoping to go down to Honduras so we can be together while we wait for it to come through.
I know everyone wants to get married asap and wishes the immigration system weren't so broken. We're just looking to see if there is a legal way to do this (ie- the B-2) that won't get us blacklisted for the time when we do want a K-3.

Ok, I know that everyone has asked about marrying on the tourist visa and then adjusting status (both staying in the US).
My question is slightly different because my Honduran fiance and I would like to apply for the B-2 visa so he could come here to get married, but then return to Honduras until we can file and get the K-3 visa for him to return. I know that sounds like a pain and more work than necessary, but we're trying to find a way to get married while my dad is still here (he's suffering with terminal cancer), and both of us are still studying in our respective countries.
I spoke to a woman who works for a US state rep who said that that wouldn't be illegal, because a) we aren't trying to defraud the gov't , b ) he'd only be in the US while his visa was good, and c) he would be returning back to his country for us to pursue the K-3 process legally.
I'm hesitant to do that though b/c of all the emphatic replies here that it it illegal, will end up drowning us in paperwork and red tape, etc. Mostly, I'm hesitant b/c we want to do things the right way so that he'll have the best possible chance of immigrating when the time is right.
Its so hard to figure out what our best option is given the complexities of our situation, especially because we don't know how long my dad will be with us. Any help is greatly appreciated.

Hi there! I'm new here and my Honduran fiance and I are at the beginning stages of the visa process. I was reading through the list of documents we'll need to gather and had a question.
My fiance doesn't have an original birth certificate and when he went to the registry place in his home town, all they could provide him with was a hand-written "copy" as they have no computer there. Its on official stationary with an official seal. Has anyone else had to use one like that? Will this hand-written copy be acceptable for the visa process?
