  1. Just wondering... are you applying for a K1 or a K3/CR1?

    Your timeline show for K-1 but you're saying "husband"... :unsure:

    I am filing the I130. The lawyer that I hired, filed the I 129F. He was supposed to file the I130 before the I129F but he didnt so my case was denied

    Then it is not correct for your profile to indicate K1. Since you're starting over again, may I suggest that as soon as you correct your profile, you begin with the "Guides".

  2. Well everyone.... Im not really new to this forum, I started a long time ago but I didnt do the research and left it up to the lawyer :blush:. The lawyer filed an I129F without filing an I130 first along with my papers she sent our marriage certificate and wedding pics. So I started to panic when I hadnt heard anything from immigration. I talked to my dear friend Tiffany who got me to start a membership on VisaJourney. Tiffany filed her papers without a lawyer and helped me to see I can do this without a lawyer. :dance: THank You Tiffany!! So I started my journeyand awaiting my NOA. :whistle:

    I excited to start posting my dates on here. :star:

    I do have a small question though.... When they denied my I129F shouldnt they have sent back the money I sent to file? :unsure:

  3. Ok so I went to see the lawyer to get my money back. Lawyer is ther but wont even look up and acknowledge, I am in the office. :whistle: First thing the assistant said is, "I was just going to leave" I snapped back that she knew I was comming from work and I was going to try to make it by 2:30 but considering I got off at 2:00... I might be a little late. I arrived 2:48, she took me into her office and sje was nervous, I stayed calm, she explains that she is giving me the money for the time they spent on my papers but not for the papers. :angry: I said "No, U will give me the translated documents." She says "Oh, U want those?" OMG I thought :blink:. I said of course I do... I paid for them. She did give them to me but they were just translated, no notary on them or anything. I asked what the... and she said "Oh u want them notarized?" I said "you think?" She said "I dont understand Ginger, U said ur friends told u the papers were wrong and then u said immigration told u the papers were wrong... are u sure they even kno what they are talking about,,,, ur friends?"

    That was the moment I had to keep from lossing it, I snapped. I told her, Both had told me, she had done it wrong and I have a form given to me from immigration (which I forgot to take with me cuz I went straight from work) stating she should have filed the I130 before the I129. My kids had gone with me cuz I had to get them from school early, so I lowered my voice when the office got quiet. She said she dont understand why I dont just wait until the denial paper comes in the mail cuz maybe it is just a request for more information. Immigration told me it was a denial, not a request for information. :angry: She said well I really would like to see the paper when it comes if you can fax it to me please. Cuz something about how they have been doing this for 6 years and this is how she always files. I told her I will fax her over the information only for the porpose of her learning how to file the right way so she dont screw anyone else the way she did me. Then I left check and translated/ notarized documents in hand.

    O and on my way out I picked up a newspaper.... The one I got from my class that had the Law Office advertsed in it. I plan to write call and inform the paper of how this Law Office does business.

  4. I am going tommorrow and I fear I will not be able to keep my cool. Question though??? Can I get all the papers that they have.... I mean my whole file? I dont think they will let it go. But I want it! :angry:

Their fees only... I am so mad. I will go pick up money from her on Friday. She isnt even the lawyer she is his assistant. The lawyer wont even talk to me he had her handle everything. I am looking up where to report him now. I picked up an I130 form and an 129f form. Now I am back where I started and I have to figure out how to file these forms. This time I think after I have everything filled out... b4 I mail them I will take it to the immigration office b4 it goes in the mail.

    MY BEST ADVISE TO YOU IS:

    KILL THE LAWYER, AND ALSO HIS STUPID ASSISTANT, KILL THEM BOTH!!!

    DO IT!!!!!!

    THEN CLAIM INSANITY, HOW COULD A JUDGE POSSIBLY SAY GUILTY!

  5. no no u have it wrong.

    I was talking about immigration checking my papers b4 I mail them, not the lawyer. Is that called and infopass appointment? I dont kno? I dont even trust the lawyer to tie my shoes. Lesson learned (the hard way).

    When I spoke with them today they told me to make an appointment to bring in my papers before i mail them and they will check to be sure it is complete

    Why would you trust a lawyer who can't even mail the right application in, nor will refund you what you are due - to double check your new packet?!?!?

  6. I contacted the State Bar, they are mailing me the complaint packet yesterday. :thumbs: I go Friday to pick up a check from the lawyer. I made her give me a time and day. She told me how she was going to be there just for me :blink: cuz she had to be somewhere ... and about how she has to get her child and all this. :angry: I told her ya I understand ... remember I have 5 kids and the drive is at least 40 minutes from my home. She shut up very quickly. I told her the damage caused to my family in unforgivable. She proceeded to tell me how her brother's wife was pregnant and was deported at 6 months, and how do I think that young woman felt.... can u believe this? I said oh really and why. She said cuz immigration is crazy sometimes and something about non payment, she dont kno why they do what they do. She was talking so fast ans went straight into ..... OK Ginger just come in and we will refund ur money.

    Ok so when they send back my papers .... it should have all that translated paperwork and all of that stuff right? I was thinking so and the biographic form too. U will help me? Cuz I dont want to mess it up .... he is comming home... dangit!

    God bless you sweetie...If you tell the lawyer that you have contacted the AZ state board, etc etc and are filing complaints against them--be ugly--hell, what do you have to lose with the lawyer now??? The people here will help you with everything and you let me know...we can have the papers filled out in a day...just go ahead and tell your husband to go print out the biographic forms and sign them...he needs to get them to you asap....may cost a little bit, but it will save you a little time...also, make sure you have everything from your husband, marriage certificates (in english)...birth certificate (english translated)....just talk to me...and i will give you a list of everything...

    oh and guys...yes, she WAS married when she went to the lawyer and told him that she was married...she had no idea of anything else other than what the lawyer was telling her.

  7. No I was married b4 I went to see the lawyer. In October we will have been married a year.

    Yes, report this to the State Bar association.

    Especially inform then the attorney himself refused to speak to you and that his 'assistant' appears to be the only person who handled your file.

    UNLESS (and you have not answered this question) you were engaged when the petition was first filed and have since married. If that's what happened, your lawyer filed for you correctly.

  8. O I plan on it... By the way I already got that form with all that information today at the immigration office. She gave me a printed out form. I also called the az state bar to make a coplaint they will call me back

    Even talking to her after she still is saying she did it the right way... even with me demanding her to tell me how she will compensate if I am told she didnt file the papers right. She still insists she did it right. I have never done this b4 and I didnt research I just went to a lawyer. My mistake ...LESSON LEARNED

    Of course she won't admit they were wrong! LOL

    i went to a lwyers office and told them i wanted to bring my husband home. They explained to me the process. I paid them. I took them 4 months to finally send out my papers. I had to call and ask if they recieved the reciept for my papers at least 50 times.... finally after a huge fight with the lawyer the papers were sent. 2 weeks later I recieved NOA1 for I129f petition for fiance.

    I just got off the phone with the lawyer she said I didnt need the I130 .... this is not true ...is it?

    K-1 (aka Fiance(e) visa (ie.. NOT married) requires I-129F

    K-3 (aka Spouse visa) requires I-130 petition first AND THEN an I-129F petition

    They ought to refund you the I 129f fee, too! After all, it was wasted because they filed the wrong damn form, hence the denial. I would definitely be filing a complaint too.

    Also, the fees have gone up since you filed originally - you better check out this thread too.

    Its $355 now for the I 130 (and no fee for a K3 related I 129f).

    What immigration office are you going to take the completed form to? I don't believe local USCIS offices will help you with filling out forms, but I may be wrong.

    You have not answered one question.... did you file a petition for your fiance or husband?

    That is NOT true. The I 129f ON ITS OWN is a fiance/e petition. Since you are already married, its no wonder it was denied.

    I'd dump the loser lawyer, and either get another one who knows what they're doing, or read up on SPOUSAL visas and do it yourself.

    Oh and get a refund from the loser lawyer while you're at it, and also send her the freaking link to our guide here.

  12. I have been calling him like mad and they dont answer my calls ... but i just called from another phone and his secretary answered and said he wasnt in I told him they need to call me back and that it was urgent. No call yet... I keep calling but they wont answer

    and now I have to wait longer to see my husband. :angry:

    You filed a K1 for your HUSBAND? Perhaps that's why you were denied (if that is really the case).

    Exactly, K1 visas are for fiancées, not spouses. What has your lawyer said? If it was his error, can't he pay for the new petition you have to send out?

  13. Well I just came back from the immigration office and she didnt know specifics she said denied

    Help!! I just found out last Friday that my paperwork might have been filed wrong.

    I came on here got advise.... made an appointment to talk to someone with immigration to see if the papers were filed wrong... Just got home.

    Found out they denied it just today!!! :angry: Isnt that GREAT!! I have to wait for the papers to come in the mail telling me why.... which NOW I already kno why!!!!! My lawyer, who was supposed to handle EVERYTHING for me, didnt send the papers the right way... and now I have to wait longer to see my husband. :angry:

    Lawyer took my money and took me real good! :angry: Im falling apart her. Im trying not to but I am a mess. :crying:

    So I guess I just wait MORE, for my reason the papers were denied, and file again... Oh and to top it all the fees have gone up. so now I have to pay a whole lot more too.

    Can you give more specific information? Did the consulate/USCIS or whichever DENIED your petition or did you get a Request for Further Evidence?

    Hi, I"m back safe from Jordan. Been home a little over two weeks. I wasn't able to get married there. The churchs there definately doesn't like the idea of internet relationships. We decided to do the K-1 visa. I mailed it from Jordan when I was there to avoid the fee hike..lol. They cashed my check today...yay!!!! It was so hard for me to come home. To be honest...it was my kids that made it possible to get on the plane. I'm finally getting back to a more normal routine. I promise I will come here and participate more. Thanks to everyone who gave me help. I really appreciate it. Now is the hard part.....waiting.

    I just found about this website from a friend of mine and I wish I would have known sooner... I feel so lost in all the information. I went to a lawyer cuz I thought It would be a faster process then me taking a chance to do it on my own and mess things up really bad. When I went to see the lawyer they made it sound so simple. Its a long story... one that had me at the lawyers asking for my money back, to which in turn they assured me my papers would finally get sent off 4 months later. I thought the lawyer route would be the fastest and easiest route to travel. It has not been at all.

    I have the reciept number... they gave my adress as the return adress. I kept going to USCIS page and putting in my reciept number just to read the same messege day after day week after week month after month.

    What does it say when you check your status online???

    Husband? K3? Why does your timeline say K1?.

  18. Spoke to a human... they said I am still within prossesing dates. Told me to wait until October.... Then I asked what if the lawyer didnt send the proper paperwork. She said if there was something wrong with it they would have sent the whole packet back... in most cases. LOL... in most cases.     Get your receipt number from the attorney. He or she should have that if indeed they filed for you. If they can't produce, ask for doumentation on when it was sent (exactly_ like the registered mail receipt). Then I think your only recourse is to contact your State Bar and file a complaint. They might be able to pressure him to pay back the retainer.

    There seem to be a number of Immigration Attorneys out there that are really untrustworthy, and do very poor work. Petitions are easy for them, they don;t make as much money and in many cases I think they prefer deportation issues which give them the court time and more $$. I will say there are many GOOD Attorneys out there as well, you just have to shop around. This process, provided you have no complicated issues, can be done by the petitioner. It only takes time and paitence on your part to make it through it, and sometimes that in and of itself can be a challenge.
