I'm curious when did you start applying I-130? Just this year or last year?? And what exactly was stated on your NOA2 via email?

Hi good morning! I'm a new member in this forum, but I have been reading your case for a while. Congratulations!!!
I have a question, I'm a LPR and I petitioned my wife from the Philippines I-130. First I received the NOA1, that was really quick, Then yesterday I received an email saying that they sent me a letter notifying that they already approved the petition. I belive this will be the NOA2. What would be the next step for me? How will the AOS and DS3032 be generated? Please also keep in mind that im not a US citizen but only a Greencard.
If anyone can enlighten me. please reply asap. Thank you much in advance!

Based on other members' timelines, about 4-6 months.
hi all!I filed it as a US citizen, but NVC has put me in Greeen card category. Anyway, does anyone know how long it takes NVC to upgrade I-130. They recived my mail yesterday. Thanks!!!!

So it's 8 days for you after you request for an upgrade? How come in your timeline you indicated only 5 days (4/17 to 4/22) when you got your DS3032 and I-864 generated? I requested mine last week (call, mail and email), it's been a week now and I still haven't received any news.

When I upgraded my son's approved I-130 when I became a USC, I had to email the request giving the case number and my details and his details and attach a scanned copy of my Certificate.
I got an email back 8 days later telling me they had upgraded his catagory. My son recieved a letter in the mail about 4 days after that telling him the same thing.

I mailed, emailed and called them up to upgrade my petition, so far it's been a week already and still nothing, how long does it usually take for them to generate or do the first step in upgrading? I noticed most members here only took a week or less of waiting for their DS3032, AOS to be generated.. *sigh*
i called ,faxed,and sent overnight mail with my certficate-which ever worked was less than week-did you recieve mail that your case has been upgraded? -

hi....thanks for the info, just to make it clear...in which office we will gonna call to upgrade I-130 filed by an LPR and now USC? we will call california service center? do you know the number to call? and for email, can i know the add? .. and also after upgrading it, how they will let us know it is already upgraded...is it in uscis online site? or they will also send us a mail...thank you soo much....just got confused in this coz of different things people said..i know you really knew it coz as what ive seen in ur timeline ur already done....congratz btw... and thank u again...hope i can hear any infor regarding this one...

hello... happy to know we have the same situation here, so that we can share our journey in this visa thing..our case is still in the USCIS, we are waiting for the approval of it: this is how it goes ...My husband filed I-130 to me last June 2008 when he was still an LPR, he got his US citizenship last Feb. 26, 09..day after that my husband went to the local immigration office in CA to upgrade our case, the lady who entertained him fax the request to the USCIS..( Feb. 27 ).. we still did not hear anything about it, we are waiting for its approval from d USCIS and our NOA2... in fact my husband also send another fax last mnth to the USCIS in case the first one doesnt work.. just to make sure.. we are waiting now for any response..., how about you? ive read from some post that usually it takes 2 months for it to be approved, but some are 1 month half, some are more depend on d case...but USCIS processing time is 6 months...
Did you call the 1800 beside faxing the letter.

Ok, Thank you all for taking the time to reply. It really helps. Actually I was about to do exactly what Aimee and Albert did but wasn't so sure so I need some affirmation. It worked for Aimee and Albert so I surmise it will work for me and my wife too to use this process (unless others may have a surer option):
I-130 - Maiden name
DS-3032 - Maiden name
DS-230 - MaRRied name, since there's a box that gives us a space to annotate my wife's maiden name (ie "Other names used").
Passport - MaRRied name.

RE: DS-3032, you said it was preprinted out for you by NVC already, that means NVC will be the one to provide us the form, no need for us to print a blank one online?

Hope somebody here could enlighten me out on this. When I was still a permanent resident, I got married and immediately petitioned my wife (I-130) and wrote in the application form her maiden name instead of her married name. My understanding that time when I was filling up the I-130 application form was I had to follow what is written in our marriage certificate so that USCIS could match the name of my wife in the application form from the marriage certificate.
Now my concern is, whenever I will upgrade my wife's case from I-130 to IR1 soon, will it be a cause for concern if what appears in her record was her maiden name instead of her married name? She'll be issued a lawful permanent visa entry with a maiden name printed on it but her passport and related documents such as police clearance etc. show her married name already and perhaps immigration officials may question why those don't match.
In connection, as we prepare to upgrade my spousal petition after I take oath, shall we write her Married name in forms DS-3032 (Choice of Agent) and DS-230 (Application for Immigrant Visa and alien registration) or write her Maiden name as what was printed in I-797 (USCIS Notice of Action 2)? But then again, like what I said this is the dilemma, that if I follow what was printed in I-797 and write her Maiden name on prerequisite forms such as DS3032 and DS230, her documents such as passport, police certificates etc are all written with her Married name.
Is there someone here who had the same experience? What transpired in your case? What are the things to do? Or it's not a concern at all since I had the marriage certificate to prove anyway? Thanks.

Thank you! You made our day. Hope you are right. As we prepare to upgrade my spousal petition after I take oath, I have a feeling of uncertainty as to whether we shall write her Married name in forms DS-3032 (Choice of Agent) and DS-230 (Application for Immigrant Visa and alien registration) or write her Maiden name as what was printed in USCIS record in her I-797 (USCIS Notice of Action 2). Like what I previously said, this is the dilemma too, that if I follow what was printed in I-797 and write her Maiden name on prerequisite forms such as DS3032 and DS230, her documents such as passport, police certificates etc are all written with her Married name, so that by the time of her interview, she may be questioned why the DS3032, DS230, passport etc don't match with one another unless the officers are bright enough to understand the obvious instead of looking for loopholes.
When we submitted our I-130 I signed my married name. Somewhere down the road all our documentation was switched to my maiden name, even though I continued to submit documentation in my married name. It all went fine and there is no concerns (even my interview letter was in my maiden name and my passport in my married name). I think you are ok!Good luck

My wife got a letter from NVC stating they have received paperwork from USCIS from I-130 petition, it also indicate a NVC case number. Do we have to do something or just wait?

Just to give you a boost. Friend of mine just got her USC in 1 1/2 months from applying! Might have been faster because she has been here 7 years.
wow that's way too fast, the quickest one i've heard so far, some 5, 6 and 8 months time... but 1.5 month? their processing system is perplexing.

What route did you take? did you go for K3?
With an I-130 already approved, K3 is no longer an option. An I-129F for spouse can only be filed when the I-130 is still pending. You are on the IR1 visa path.

I'm sorry for the delay, the answers are yes,yes, and yes. We are in Florida with the family gathering to celebrate my father's 90th birthday. Yesterday he drove to the airport to pick-up my sister. I rode along with him, he is driving better than 5 years ago. good luck for quick citizenship, Mike & Yizhen

Hello dcjsjd, you will not be able to file the I-129F for the K-3 until you are a US Citizen, so it would then have to be approved, your wife will be here before then. When you get the natualization certificate, you can upgrade you I-130 for the spouse of a PR, to an I-130 for the spouse of a US Citizen, no more waiting, then your petition will be processed at the same speed as the other US Citizen I-130's approved at that time. So all i need to do is once I become citizen just call NVC to upgrade then they'll just mail me instructions on how to process IR1/CR1(I-130 of US Citizen upgrade)? My wife's I-130 was approved by USCIS and is currently at NVC. So once I got my naturalization certificate, I'll call NVC? or call USCIS? or both? to upgrade. Any forms to download and fees to pay aside from mailing them the cover letter, naturalization certificate and NOA? or once the 3 requirements are mailed, we'll just have to wait?

For upgrading you can call USCIS and tell them that you are a citizen.Also mail them a copy of ur naturalization certificate with a cover letter requesting to upgrade ,also include a copy of your NOA1.I upgraded mine on 24th oct and I had filed I-130 in March,2006.... still no approval
.Since you had applied last month so i think it is still gonna take a while to get approved so you might want to go for K visa.Check the pros and cons in guide section.you don't need another I-130.

Since your case is already approved you will only call NVC.I didnt apply for K3 yet I am just waiting for approval so I can go fo IR1/CR1 directly.There is no additional form or fee for upgarding.I upgraded mine @VSC but I suggest you to call NVC once to confirm their requirments for upgrading,According to my understanding, you wont be eligible for K3 as you dont have a pending petition any more,as it is already approved.

Since her petition has already been approved by NVC, right after your oath you can call NVC that you recently became a US Citizen and that you would like to upgrade your spouse petition. Then you will need to send them a letter to request upgrade with the copy your naturalization certificate and NO2. You can either email, fax or mail it (but i suggest to do all).
This is way quicker than anything else, specially that her petition has already been approved. Once they received your request they will send you a confirmation then they will start sending you Choice of agent, AOS fees and etc.

. But nevertheless, I see what you mean, thanks. So while the I-130 is pending in NVC, I have to complete my naturalization.. after oath, call NVC to upgrade.. Send them letter of request, naturalization certi and NOA2 (this is the NOA that indicates that USCIS approved the I-130 and being sent over to NVC?). So this is the quickest way huh, this is the same as IR1/CR1 right? and once they got the request they will send me requirements i need to procure. Ok got it, thanks a lot. And by the way, do you know any resources on how-to/what to include in the letter of request?

Does your I-130 petition for your wife approve already?
If not, after you receive the certificate of naturalization, which means you becoming US citizen, you can send cover letter asking the I-130 case upgrade from F2A to IR1/CR1 along with the copy of your certificate of naturalization.
If your I-130 is approved before that time, ans forwarded to National Visa Center, you can send same thing to NVC.

Wow, your I-130 waiting period was quick, though i heard or read somewhere that USCIS' processing system improved recently, I wasn't so sure until i heard your case got approved in just 2 years! I wasn't expecting that quick, really good for you, you and your spouse are very blessed. Many of us couples, especially those who applied few years before you, had to wait and endure ~5 years; had to undergo a lot of painstaking issues with USCIS in updating us for any developments of our applications; asking US senate and congress for help to no avail, joining I-130 groups to spread awareness of the long wait. We hope, if not for us, it is paying off for future applicants/petitioners, so they never experience the same way we did.
Anyway, re: your question, yes my wife got her 1st NVC postal letter about a month after we got her NOA2 from USCIS as you can see what I put down in my timeline. It tells you what her NVC case number is, the rest of the letter is nothing but a reminder that visa is not yet available (unless again your case is different). Your case is F2A (family-based petition) right? And it's not a joint-in application (i.e., you included your wife in the application when you applied for your greencard)? If it is F2A like most of us, here's the visa bulletin webpage http://travel.state.gov/visa/frvi/bulletin...letin_4512.html This site will tell you what's the current visa availability for Philippines and the rest of the countries.
Now that your case is in NVC, I worry less about NVC than USCIS, for me NVC is more efficient from hereon. I would try emailing them to inform them of your wife's new email address at nvcinquiry@state.gov and they will respond accordingly (unlike USCIS). In order to ensure a prompt response:
- Enter your USCIS case number in the Subject Line of the e-mail.
- Include the applicant's name and date of birth, and the petitioner's name and date of birth in the body of the e-mail.
- If the petition is employment-based, include the company/organization name.
If you are here in the US, you can call NVC at 1-603-334-0700 and look for a customer rep, they will ask you your current contact phone and email without you even initiating, that's the time you can inform them of your wife's new email address... or probably one of the buttons will lead you to change contact info.
