    Thank you for your concern.

    I have 10years green card and applying for reentry permit to live in japan for a while.

    Sep 30th, I got biometrics appointment letter ( almost 3weeks after my application)

    The appointment dated on Oct 22nd, but I am leaving japan before, so will just go to get biometrics next week.

    Hope they don't question about scheduled date,,,

    I guess reentry permit can be done within a month, but still takes 3-4weeks...

  2. Do you have a 2 yr GC or 10yr GC? Moving address would be somewhere in the states not overseas. Your petitioner fills in the I-865 and the beneficiary fills in AR-11 my husband petitioner only got a receipt on our change of address I got nothing on the Ar -11. How long are you going to be in Denmark? They may think you have abandoned your GC status.

    I have my 10 year green card now. But then I don't understand what to do when you literally don't have an address in the states. I could have easily given them an address belonging to a family relative or friend, but that world be a "felony", correct?

  3. Your chance of getting in this time are ok- not brilliant, but I'd say due to your ties here in the USA you have a pretty good chance of being let in, maybe with a bit of a talking to.

    However, leaving again after just a couple of weeks, you will have difficulties getting in next time, unless you get that re-entry permit. How long do you plan to stay out of the country overall?

    Well, I'm taking some classes which will end in December - so will my husband's work permit here in Denmark. But there is a chance that he might renew his work permit so it is valid for another year(2012). In that case, I will probably keep taking classes and finish my degree in December 2012.

    Therefore, it is very important that I stay long enough to file for a re-entry permit and go to the biometrics appointment this time, wouldn't you agree?

    I'm living temporarily in Denmark with my husband. He is the american citizen and I have a greencard.

    When we moved here we moved out of our NYC apartment because our lease was up, and put all our furnitures and belongings in a storage space.

    I know it is important to let USCIS know when you move address, therefore we sent form I-865 with our current Danish address.

    Now, 4 months later, I'm starting to get a little concerned that we didn't file the right form? And if so, what can you expect from USCIS? That they send you some kind of acknowledgement letter of receival overseas???

    Please help, I don't wanna get in trouble with the USCIS!!!!

    My story is a little bit different from most other people in here, therefore I'm posting this hoping to receive help ASAP.

    I am a permanent resident (already had my conditions lifted). I have lived in New York and have had my Greencard since May 2008. My husband is the American:)

    Last year (2010) in August my husband and I travelled to my home country, Denmark, with the intention of staying for a approximately six months. He came to Denmark starting with a tourist visa and after the 90 days he went back to our place in New York. However, during his stay here in Denmark, he was offered an opportunity to sign a deal with a record label here in Denmark, which will be valid for the year of 2011. Therefore, shortly after he had left DK he came back, this time with a work visa.

    Anyway, my concern is obviously my situation. I can understand that if you, as a permanent resident, stay abroad for longer than 1 year, your resident status is most likely to be determined abandoned and you can lose your Greencard. That is obviously my biggest concern! I just booked a ticket to NYC leaving in four days (August 5th) - with a return ticket to Denmark scheduled a week later. On August 9th it has been exactly one year since I left NYC, therefore, I assume I still have a chance of going through Border Patrol pretty painless.

    To not waste my time out here while my husband is working, I have been taking classes at the local college.

    I have made preparations to show the officer that I did not abandon my residency even though I did stay out of the country for a long time without a re-entry permit. My "evidence" is gathered with not a lot of time to collect it, but here is what I have: Bank credit/debit cards, Receipt of storage space (where all our furnitures etc. are stored), a signed letter from my school counselor stating that I am attending school until the end of the year. My dad is also living in NY.

    I know that tax returns or proof of filed taxes as a resident are important but I simply waited too late to e-file, and it got rejected because of some information missing.

    What I really wanna know is how are my odds of passing border patrol in NYC, and NOT lose my Greencard?

    I'm considering filing for a EXPEDITED re-entry permit while I'm there, and if I have to stay a week or so longer for Biometrics, I will.

    And is the evidence I have enough to prove that I still have ties over there??

    Please help anyway you can!

  6. We are going to have the interview on May 6th, which we are thrilled about.

    Though I have some very crucial concerns... here it goes:

    My husband is on MedicAid. He's a serious astmatic and through his healthcare plan all his medicin is covered. He's working two times a week and gets paid the money straight in his pockets.

    When we filed the Affidavit of Support of course we were honest, and wrote his annual gross income in 2007 to be $10.400.

    Now, naturally I thought he should file taxes off of the $10.400 but he is worried that if he files taxes it will complicate him receiving MedicAid.

    Buy my big concern is that they are gonna ask at the interview if he filed his taxes, why he's on MedicAid when he's supposedly making $10.400 a year, and then it could escalate into an ugly thing, and that it's gonna be a reason for them to deny me the Greencard...

    Please try and help....

    it would so nice if my EAD has been approved as well. anyway, a heartfelt CONGRATULATIONS to those who got approved.

    Where can I see if my status has been touched????? I thought it was on uscis.gov but when i put in my receiptnumbers it only shows what cases i've filed.... why can that be??

  8. HOW AND WHERE CAN YOU SEE THAT YOUR CASE HAS BEEN "TOUCHED"????

    And also, I need to get one thing straight; An Advance Parole is only obtainable for emergency travels, right?!?!? I didn't file the Travel Permit with the I-485 package, since I thought it was only in certain cases you could travel while your case is pending. I really want to go home and see my family, but that wouldn't be an emergency........

    In the package was of course the I-864 Affidavit of Support with my stepmom (who's a US citizen) as a joint sponsor, but we forgot to fill out one from my husband who's the petitioner and enclose that too.

    Now I got a RFE asking for a I-864 from my husband and of course he's gonna have to enclose a Federal Tax Return for the most recent year.

    Now the thing is that, my husband hasn't paid taxes since the year of 2004,since he's been unemployed for a while and since the end of 2006 he has had a job that pays him "under the table". He makes a good amount but in his selfishness he hasn't filed taxes.

    His annual income is below the poverty guideline, that's why we're using my stepmother as a joint sponsor.

    I am just really uncertain of what to do. Do I just send back the form from him with no tax return, or is he going to have to file taxes for 2006???

    I'm sorry if it all sounds confusing, please feel free to ask me further questions if something is unclear, I just really need help since I don't know anything about taxes in this country.

    Depending on how much below the poverty line his income falls, he may not be required to file a tax return. Determine that here.

    You may substitute a statement indicating a tax return was not required due to low income, if applicable.

    Actually, now he told me that he didn't work at all in the year of 2006 which is the most recent tax year. Should I just enclose a written statement saying that???

    And maybe try to get tax returns from 2005 and 2004 where he did have a steady and official job...??

  11. Since I couldn't find a A-number in any of my papers, that leaves my whole package without both a Social Security Number and a A-number.... is that okay? Any of you know in the same situation???

    I didn't have an A-number of SSN for my package either. Now that I've received the NOA2s I see that they've assigned one, but prior to this I wasn't aware of any. Everything appears to be proceeding just fine even though I didn't list either of these on our package.

I'm filing for AOS these days, and of course I want to fill out the forms correctly, so here's a question for you: On the first page of the form under PART 2 - APPLICATION TYPE, I have to check one box from A-H. Since I arrived on a tourist visa almost two months ago and got married 3 days ago, I'm guessing that I should check box H? But what do I write as my explanation on the line underneath???? Any good advice???

    It is being asked all the time - you need to check A. 100% :)

  14. I thank everyone for their answers. It helped me out alot. At least it made me calm down a bit. It's frustrating because my husband and I feel so alone in this, and we have no clue where to start. But it lead me to have further questions, that I was hoping you could help me with.

    Since I'm applying having arrived on my tourist visa, do I file the exact same forms as for a spousal petition? I mean, the I-130 AND the I-485??
